SUBJECT: Text Amendment Regarding Permitted Residential Uses

INTRODUCTION:
For the near term staff has proposed language that would provide relief to owners of 1- and 2-
family dwellings in the Highway Business (B-1) zone who are currently unable to secure
mortgage financing. This would be accomplished by making these 2 uses permitted uses.
ALTERNATIVES:
1. Approve Ordinance No. 687, an ordinance regarding permitted residential uses in the Highway
Business Zone as presented.
2. Approve Ordinance No. 687, an ordinance regarding permitted residential uses in the Highway
Business Zone with revisions.
3. Do not approve Ordinance No. 687.
4. Table the matter for additional information.
PLANNING COMMISSION RECOMMENDATION:
The Planning Commission reviewed the proposed text amendment at its meeting of November 6,
2003, and recommended approval by a vote of 5-1 (Commissioner Clay dissenting) with changes that
have been incorporated into the draft ordinance.

ORDINANCE NO. 687, FOURTH SERIES
AN ORDINANCE OF THE CITY OF SHAKOPEE, MINNESOTA,
AMENDING CHAPTER 11, ZONING ORDINANCE, SEC. 11.36 REGARDING
PERMITTED RESIDENTIAL USES
THE CITY COUNCIL OF THE CITY OF SHAKOPEE, MINNESOTA, ORDAINS:
Section 1 - That City Code Chapter 11, Zoning, Section 11.36, is hereby amended by
adding the language that is underlined.
SEC. 11.36. HIGHWAY BUSINESS ZONE (B-1). Subd. 2. Permitted Uses.
K. Single-Family and Two (2) Familv Dwellings constructed before December 31,
2003. If a single-family or two (2) family dwelling originally constructed before
December 31. 2003 is destroyed. e. g. by fire. it may be reconstructed to a size,
configuration, and style consistent with the original structure.
Section 2 - Effective Date. This ordinance becomes effective from and after its passage
and publication.
Adopted in session of the City Council of the City of Shakopee, Minnesota
held the day of , 2003.
