City Clerk SUBJECT: 2004 Fee Schedule DATE: November 26, 2002 INTRODUCTION The City Council is asked to consider adopting the attached ordinance setting fees for licenses, permits, services, and documents for 2004. BACKGROUND Prior to the end of each year, the City Council adopts a fee schedule by ordinance for the ensuing year. The fee ordinance includes the fees for all licenses and permits issued within the City of Shakopee. Department heads have been asked to re-examine their fees and make appropriate recommendations for adjustments to the City Council. In the proposed ordinance, the stricken language is deleted and the underlined language is inserted. City Clerk - recommends increasing the license fee for pawn shops from $1,000 to $1,500, as recommended by the Police Department, page 5. Building Department - recommends adding a minimum commercial fee for heating, air conditioning, refrigeration, and ventilation permits, and clarifying the re-roofing permit fee for multiple residential units, page 8. The SAC charge is being increased from $1, 275/unit to $l,350/unit, page 9. This is dictated by the Metropolitan Council. The City SAC charge is being increased from $440 to $450, page 9. The water availability charge (WAC) that is passed on to Shakopee Public Utilities is going to be collected by SPUC beginning in 2004, and is being deleted from the fee schedule, page 9. Fire Prevention - Recommends fee increases as outlined on pages 9 and la, as well as some housekeeping changes. 2004 Fee Schedule November 26, 2003 Page -2- Finance Department - recommends increasing the fee for processing a replacement payroll check from $20 to $25, page 11. Police Department - recommends increasing the license fee for pawn shops from $350 in 2002 to $1,000 in 2003, $1,500 in 2004 and $2,500 in 2005, page 5, as recommended last year by Sgt. Forberg, after researching fee charged by other cities. The fee schedule eliminates the private vendor request for copies of State Accident Report at weekly and monthly fees, instead the fees will be consistent with computer researched reports at $5.00 and hourly wage of individual doing research, page 11. The fee for a background check for a permit to carry a handgun is eliminated, page 11. Public Works - recommends changing the minimum rental time from one hour to two hours for all drivable equipment rates including an operator, page 12. Planning Department - recommends raising the application fee for CUP appeals to the City Council from $75 to $150 and adding an application fee for a CUP for temporary seasonal sales in the amount of $25, page 14; increasing the application fee for a PUD concept review from $200 to $350 and adding an escrow deposit of $1,000 for a PUD and PUD amendment, page 14. Fees are added for maps for land use (11 ' , xl 7 ' , ) and for developments (11"x17") in the amount of $3, page 13. Fees for maps will also be printed in the Engineering Department section of the fee schedule. The $75 fee for the wetlands certificate of exemption review process is being moved from the Planning section to the Engineering section of the fee schedule, pages 13 and 18. Engineering Department - recommends adjustments for cost price index increases for trunk storm water, trunk storm water storage and treatment and trunk sanitary sewer, page 16. A fee of $45 is being added for the permit to work in public right of way for excavation of a hole for a new service connection, page 17. The fee for searching for lot corners with a metal detector is being eliminated because staff no longer provides this service due to the objection from Mr. Allen Hastings, page 18. Park and Recreation - I am advised by Mark Themig that the Park and Recreation Advisory Board recommends increasing the park dedication fees as outlined in his memo dated November 25, 2003, attached, and as noted on page 13. The Park and Recreation Advisory Board recommends changes to the fees for programs and facilities as outlined on pages 19-23, see memo from Mr. Themig dated October 29, 2003, attached. 2004 Fee Schedule November 26, 2003 Page -3- ALTERNATIVES 1- Adopt fee ordinance as proposed. 2. DISCUSSION 2004 Recommended Park Dedication Fees The Advisory Board discussed proposed 2004 park dedication fees at both their September and November meetings. The Advisory Board recommended the following 2004 park dedication fees: 2003 2004 Residential/Single Family/Duplex (per unit) $2,660 $3,615 Multi-Family/Apartment (per unit) $2,220 $3,012 Commercial/Industrial (per acre) $4,470 $5,344 The significant increase in the fee is based on recorded sale prices for land in the first six months of 2003. See Attachment A for calculations. Proposed Text Amendment to Park Dedication Ordinance The Advisory Board also asked staff to research how we could "close the gap" between the land value used in calculating the park dedication fee, and the amount developers can request in credits based on the fair market value of the land. The issue with the current ordinance is that the fair market value of the land that the credit is based on is typically higher than the average undeveloped land value used to calculate the park dedication fee. Any changes in the ordinance would require a text amendment application, public hearing at a Planning Commission meeting, and City Council approval. This process is underway. DISCUSSION AND RECOMMENDATIONS As part of the 2004 budget process, staff presented proposed fees and charges to the Parks and Recreation Advisory Board for review. The Advisory Board made several changes to Staff's proposed fees. The following is a summary of the major changes being proposed. Increase 10-punch resident punch card rate from $25 to $30. 2,000 Increase 20-punch resident punch card rate from $50 to $55. 4,000 Increase 10-punch nonresident punch card rate from $35 to $40. 1,500 Increase 20-punch nonresident punch card rate from $70 to $75. 1,500 Implement Season Pass program Unknown 1. Significant increase in rates would only be implemented if fitness enhancements are made. 2. Staff proposed a $10 increase in prime rates. After hearing testimony from the Hockey Association regarding the impact this increase would have, the Advisory Board recommended no increase for 2004. 3. Proposed revenue from staffing costs would be applied toward Public Works operating budget. ORDINANCE NO. 692, FOURTH SERIES AN ORDINANCE SETTING FEES FOR CITY LICENSES, PERMITS, SERVICES AND DOCUMENT WHEREAS, by Ordinance No. 644, the City Council established a fee schedule effective January 1,2002; and WHEREAS, amendments to the fee schedule were subsequently made with the adoption of Ordinance Numbers 646, 647, and 659; and WHEREAS, the City Council has determined that adjustments to those fees are reasonable and appropriate. NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Shako pee, Minnesota, that the Fee Schedule dated January 1, 2004, a copy of which is on file in the office of the City Clerk, is hereby approved and adopted in its entirety. BE IT FURTHER ORDAINED, that the Fee Schedule shall become effective on January 1,2004, unless indicated otherwise therein, and Ordinance Numbers 644, 646, 647, and 659 and all other ordinances and resolutions inconsistent herewith shall be repealed effective January 1, 2004. BACKGROUND Staff reviewed Scott County's records of four different land transactions in 2003 in the City of Shakopee. All four transactions occurred within the urban service areas of Shakopee. According to the County's Property Tax Records, the lowest transaction amounted to $78,000.00 per acre and the highest at $104,614.05 per acre. The average median "land value" of the four transactions came to $90,364.51. Using a median "land value" of $90,364.51 per acre, staff calculated the single-family unit at $3,614.58 and $3,012.15 for multi-family units. Staff recommends rounding off the figures accordingly. The' Commercial/Industrial increase is based on the average increase of the single-family units and multi-dwelling units. In other words, a development with 25 single-family homes, with an average of 3 people per household, creates a need for a one-acre of park. If the City prefers cash in lieu of land, then the cash contribution is based on the median "land value" without improvements. As a policy consideration, the City needs to determine if it wants to include rural land sales or exclude rural land sales. Our past practice has been to include rurallan~ sales to determine the overall median "land value" for the City. As a practical matter, most developments, and the need for park/open space, is occurring in the Urban Service Districts where land values are much greater than rural property. Perhaps, the fee schedule should only include land values in urban service districts and not rural areas. Calculation: Total up land sales at a per acre cost amount for the year. Then, divide the total amount by the number oflands sales. As noted by the appeals court, the U.S. Supreme Court has held that a governmental exaction "on the devel- opment or use of real property is a 'taking' under the Fifth Amendment unless there is an 'essential nexus' between the exaction itself and the goal that the exaction is designed to achieve." Moreover, "when an 'essential nexus' exists, the government unit imposing an exaction on development must make some sort of individualized determination that the extent of the burden imposed by the exaction is 'roughly proportional' to the impact that the proposed development would have and that the exaction would address.
