SUBJECT: Easement Acquisition for 2003 Reconstruction, Project No. 2003-3

INTRODUCTION:
On May 6,2003, the City Council adopted Resolution No. 5885, which ordered the improvement
and preparation of plans and specifications for the above referenced project. The purpose for this
agenda item is to have the Council consider the authorization of eminent domain proceedings in
acquiring easements for Fourth Avenue, from Naumkeag Street to Shenandoah Drive; Viking
Steel Road, from Fourth Avenue to C.R. 101; and Cavanaugh Drive, from Viking Steel Road to
the west terminus at the Union Pacific Railroad crossing.
BACKGROUND:
During the preparation of the plans and specifications, staff has determined additional easements
are required from property owners adjacent to the project. Staff has conducted an informational
meeting with property owners notifying them of possible easement acquisition.
Staff has been working with WSB & Associates, Inc. on the plans and right-of-way easement
descriptions needed for the project and Evergreen Land Services Company for the evaluations of
property needed for acquisition. Staff has reached an agreement with Kelley Fuels for right-of-
way acquisition.
Evergreen Land Services sent out offers to all property owners where right-of-way acquisitions
are needed, except for Kelley Fuels and the Shakopee Public Utilities parcel. Staff does believe
that some property owners may not be in agreement with the taking or the offer on the project. In
order to construct the project this year and to meet Shakopee Public Utilities timeline for their
new building, authorizing the acquisition of certain property for this project by eminent domain
proceedings is necessary. Staff will continue to work with property owners on possible
agreements. However, the authorization of eminent domain can establish a date certain in which
the City will have the right-of-way for construction.
ALTERNATIVES:
1. Move to authorize staff to continue easement acquisition negotiations with property
owners.
2. Offer Resolution No. 5993, a resolution determining the necessity for and authorizing the
acquisition of certain property by proceedings in eminent domain.
3. Table this item.
RECOMMENDATION:
Staff recommends Alternative No's 1 and 2.
ACTION REQUESTED:
1. Move to authorize staff to continue easement acquisition negotiations with the affected
property owner.
2. Offer Resolution No. 5993, A Resolution of the City of Shakopee, Minnesota,
Determining the Necessity for and Authorizing the Acquisition of Certain Property by
Proceedings in Eminent Domain and move its adoption.

WHEREAS, the City of Shakopee is a municipal corporation organized and operating
under Minnesota law, and is authorized by Minnesota Statutes Sections 412.211 and 465.01 to

MinnesotaStatutes,Chapter 117; and
WHEREAS, the City Council has determined that the City should construct Fourth
Avenue, from Naumkeag Street to Shenandoah Drive; Viking Steel Road, from Fourth Avenue

crossing ("Project"); and
WHEREAS, the City has identified the need to acquire perIl1anent and temporarY_
easements over certain real property described on the attached Exhibit A (the "Property") for
purposes of construction ofthe Project; and
WHEREAS, the City has been unable to successfully negotiate the acquisition of the
necessary easements for the Project.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF SHAKOPEE, MINNESOTA, AS FOLLOWS:
1. Acquisition by the City of the Property described on Exhibit A is necessary,
convenient and reasonable for the purpose of constructing the Project .
2. The City Council deems it necessary in order to meet the anticipated construction
schedule for the Project to acquire title to and possession of the Property prior to the
filing of a final report of commissioners, in accordance with Minnesota Statutes,
Section 117.042.
3. The City Attorney is authorized and directed on behalf of the City to acquire
permanent and temporary easements for street, highway, sidewalk, utility and
drainage purposes for the Project by the exercise of the power of eminent domain
pursuant to Minn. Stat. Chapter 117, and is specifically authorized to notify the
owners of intent to take possession pursuant to Minn. Stat. Sec. 117.042.
4. The amounts set forth on the attached Exhibit A represented the approved appraised
values of the easements to be acquired for each of the parcels impacted by the
Project, for purposes of Minn. Stat. Sec. 117.042. The City Engineer is authorized to
approve revised appraised values for any of the affected parcels, if the City Engineer
determines that a revised appraisal is necessary to reflect changes in the scope or
duration of an easement or the expected construction activities within an easement
area.
5. The City Attorney further is authorized to take all actions necessary and desirable to
carry out the purposes of this resolution.
