'I"~ <"", "<" If:i, I ,'I, ;x .'<t.~~ '~'.!', ",," ,,, ur\t~~~ TO: Mayor & City Council Mark McNeill, City Administrator FROM: Bruce Loney, Public Works Director SUBJECT: Authorize Payment for Easements on Parcel No.3 and Parcel No. 13 for the 2003 Reconstruction, Project No. 2003-3 DATE: March 1, 2004 INTRODUCTION: Attached to this memo is a pay authorization from Evergreen Land Service Company in regard to easements and payments for Parcel No.3, in conjunction with the 2003 Reconstruction Project. Also, staff received a verbal acceptance from the property owners of Parcel No. 13 in regard to the payment for the easement. The purpose of this agenda item is for Council to authorize payment for these easements. BACKGROUND: In association with the 2003 Reconstruction Project, additional easements are needed for the widening of Fourth Avenue and building of Sarazin Street with utilities to service the Shakopee Public Utility building. With this project design, the City did contract with WSB & Associates, Inc. for the plan preparation and also contracted with Evergreen Land Service Company to make the necessary appraisals and negotiations for obtaining the easements. An easement has been negotiated by Evergreen Land Service Company with Shakopee Council 1685 Home and the final amount is acceptable, according to the City Attorney and staff. Also, the easement offer made to Arthur and Martyne Hatch has also been agreed to, the owners of Parcel No. 13. These offers have been accepted in writing by the property owner and the easement executed from the Shakopee Council 1685 Home Association, Inc. of Knights of Columbus. Staff recommends Council authorization of payment to the property owner of Parcel No. 13 in the amount listed in the offer letter which was $6,550.00. Also attached for Council reference and consideration is the sketch of the easement area, as prepared by WSB & Associates for an easement on this parcel. ALTERNATIVES: 1. Approve a motion to authorize payment of $14,900.00 to Shakopee Council 1685 Home Association, Inc. of Knights of Columbus, the owner of Parcel No.3 (P.I.D. No. 27-905018-0) for easements associated with the 2003 Reconstruction, Project No. 2003-3; and to authorize payment of $6,550.00 to Arthur J. and Martyne J. Hatch, owners of Parcel No. 13 (P.I.D. No. 27-906053-0) for easements associated with the 2003 Reconstruction, Project No. 2003-3. 2. Deny the easement acquisition. 3. Table this item for additional information. RECOMMENDATION: Staff recommends Alternative No.1.
