CITY OF SHAKO PEE CONSE~JT Memorandum CASE NO.: 04-010 TO: Mayor and City Council Mark McNeill, City Administrator FROM: Mark Noble, Planner I SUBJECT: Waiver of Subdivision Criteria: 1215-1227 4th Avenue West DATE: March 2, 2004 INTRODUCTION Scott Wirth has submitted an application re~uesting approval of a waiver of subdivision criteria for property located at 1215-1227 4t Avenue West (Exhibit A). The property is zoned Medium Density Residential (R-2) Zone. The R-2 Zone allows single family detached and attached dwellings, and two (2) family dwellings, and requires lots to have a minimum lot width of 60 feet for single family and 70 feet for two-family dwellings, 5445 square feet in area and 10 foot minimum side yard setbacks. Mr. Wirth is the current owner ofthe property, on which he would like to construct two 2-unit structures. He received approval for a Registered Land Survey (RLS #182) in July, 2003, which created two lots. At that time, it was acknowledged that he intended to proceed with a minor subdivision application to split those two lots, therefore allowing each unit to be located on its own lot. For this to occur, he is requesting a waiver of subdivision criteria to allow a minor subdivision that would create 37.5 foot wide lots, where 60 feet is required for single-family detached structures and 70 feet is required for two-family structures, and zero foot side yard setbacks for that side ofthe structures that would have a common wall, where 10 feet is the required minimum setback. The lots will have an area of 5625 square feet. Shakopee Public Utilities has commented that the property owner will be granting them an easement by document, which will assure them access to the overhead electric line along the north property line. BACKGROUND The applicant has provided a letter describing his intent for the property, as well as a copy of the property survey (Exhibits B & C). If the waiver of subdivision criteria request is granted, the applicant will continue to work with staff on the minor subdivision process. ALTERNATIVES 1) Approve the requested waiver of subdivision criteria that would create 37.5 foot wide lots, where 70 feet is the required minimum lot width; and zero foot side yard setbacks for that side of the structures that would have a common wall, where 10 feet is the required minimum setback. 2) Do not approve the waiver of subdivision criteria. 3) Table the matter for additional information. STAFF RECOMMENDATION Staff recommends approval of the waiver of subdivision criteria request. This property is located just west of Adams Street, on 4th street and is zoned R2. We currently have two parcels, each parcel is 75ft. in width. (Tract A and Tract B) We have plans to build one twinhome on each parcel and would like to split the twinhome into two separate entities in order to allow us flexibility in selling the properties individually should we desire to in tlle future. Please see the attached proposed certificate of survey which was done for Generation Homes, our contractor. TIus minor subdivision is for land not zoned cOlmnercial, industrial, business park, or major recreation. There would be no change in existing streets, alleys, water, sanitary or stonn sewer, or other public improvements above and beyond what is currently permitted. No right-of-ways need to be dedicated. No easements will need to be changed for the subdivision and no new streets, utilities, or otller public improvements will be needed other than to directly serve the already permitted twinhomes.
