SUBJECT: City Code Amendment Regarding Compensation for Planning
Commission Members

Introduction
The City Council is asked to consider Ordinance No. 816, Amending Chapter 2, Administration
and General Government, Section 2.52, Planning Commission.
Background
The City currently pays members of the Planning Commission $50 per meeting attended. We
have received a request from one member of the Commission who would like to waive this
payment. Unfortunately, the City Attorney advises that state law and City Code do not allow us
to simply stop paying this Commissioner. Instead, he advises that we amend the section of City
Code that states that members of the Planning Commission shall receive compensation to read
members of the Planning Commission shall be eligible for compensation. This would allow
Planning Commissioners who wish to waive payment to do so by simply notifying us of their
desire in writing.
Relationship to Vision
This is a housekeeping item (F).
Requested Action: Ifit concurs, the Council is asked to offer Ordinance No. 816, Amending
Chapter 2, Administration and General Government, Section 2.52, Planning Commission, and
move its adoption.
ORDINANCE NO. 816, FOURTH SERIES
AN ORDINANCE OF THE CITY OF SHAKOPEE,
MINNESOTA, AMENDING CHAPTER 2, ADMINISTRATION AND
GENERAL GOVERNMENT, SECTION 2.52, PLANNING COMMISSION
THE CITY COUNCIL OF THE CITY OF SHAKOPEE, MINNESOTA, ORDAINS:
Section 1. That City Code Chapter 2, Administration and General Government, Section
2.52, Planning Commission is hereby amended by adding the language that is underlined and
deleting the language that is struck through.
City Code Sec. 2.52. Planning Commission.
A Planning Commission. composed of seven (7) members is hereby established. The
Planning Commission members shall serve staggered four (4) year terms. The Planning
Commission shall have such authority and perform such duties as prescribed by Minnesota
Statutes and the City Code. Each member of the Planning Commission shall be eligible for
receh!e such compensation per Planning Commission meeting or hearing, as shall be fixed
by the Council.
Section 2. Effective Date. This ordinance becomes effective from and after its passage
and publication.
Adopted in session of the City Council of the City of Shakopee,
Minnesota, held this _ day of ,2009.
