From: Jamie Polley, Director of Parks, Recreation & Natural Resources Meeting Date: April 7, 2009 Subject: 1 th Avenue Sports Complex Fencing/Netting Project INTRODUCTION This item is to request City Council's authorization to install a fence and netting at the 1 th Avenue Sports Complex utilizing funds received from liquidated damages collected as part of the 1 th Avenue Sports Complex construction. BACKGROUND Since the construction of the 1 th Avenue Sports Complex began it has been anticipated that a fence and netting would be installed along 1 th Avenue to stop balls from entering 1 th Avenue and the storm water pond. 440 feet of fence will be installed at the north end of the two soccer fields that border 1th Avenue. The netting will be 14 feet high and 60 feet long and will be installed behind each goal. A picture of the fencing and the layout of the sports complex are attached. Staff is aware of the fencing height restrictions in a residential area require the submittal of a conditional use permit (CUP) and fencing permit. Upon Council approval of funding staff will begin the CUP and fencing permit process. A concrete maintenance strip will also be installed under the fence as requested by the . Public Works Department. On December 16, 2008 City Council authorized Resolution No. 6838, A Resolution Accepting the Work of Gladstone Construction, Inc. on the 17th Avenue Sports Complex Improvements and Authorizing Final Payment, project PR 2005-2. DISCUSSION AND BUDGET IMPACTS The fence and netting costs were not included in the project scope of the 1 th Avenue Sports Complex construction and have not been budgeted for within the Park Reserve Fund. The cost of the fence, netting and maintenance strip is quoted at $17,500.00. Staff is requesting that a portion of the liquidated damages retained from the project be utilized to fund the installation of the fence and netting. The construction of the 17th Avenue Sports Complex is complete and the City has paid the Contractor the final amount due after the assessment of liquidated damages in the amount of $99,707.13. The contractor is contesting the amount of liquidated damages assessed and staff is working with the City Attorney on negotiation proceedings. However, staff is confident that the City will retain liquidated damages in excess of the cost of the fence and netting. RELATIONSHIP TO CITY VISION C.
