SUBJECT: Determination of Local Governing Unit for CSAH 83 Wetland Impacts

INTRODUCTION:
This agenda item is to consider formally acknowledging the City of Prior Lake will be the Local
Governing Unit (LGU) for wetland impacts associated with the CSAH 83 project.
BACKGROUND:
The proposed CSAH 83 project entails the construction of a four (4) lane, divided roadway from
CSAH 42 in the City of Prior Lake to a point just South of CSAH 16 (17th Avenue) in the City of
Shakopee.
Although a formal wetland delineation report and a wetland replacement plan have yet to be
reviewed by the Technical Evaluation Panel (TEP), it is known that wetland impacts will be
necessary as a result of the project. However, a majority of these impacts will occur in the City
of Prior Lake. The amount of wetland impacts in the City of Shakopee will be approximately
0.14 acres, while the impacts in the City of Prior Lake will be approximately 0.65 acres. Please
see the attached drawing denoting these impacts.
When wetland impacts are proposed in two jurisdictions and both have zoning authority, the
Wetland Conservation Act (WCA) of 1991 states the LGU will be the one in which the most
impacts will occur. This agenda item is to formally acknowledge this LGU determination.
It should be noted the City of Shakopee will still play an active role in the TEP review processes.
ALTERNATIVES:
1. Approve a motion determining the City of Prior Lake is the LGU for wetland impacts
associated with the CSAH 83 project.
2. Deny a motion determining the City of Prior Lake is the LGU for wetland impacts associated
with the CSAH 83 project.
3. Table for additional information from staff.
RECOMMENDATION:
Approve a motion determining the City of Prior Lake is the LGU for wetland impacts associated
with the CSAH 83 project.
ACTION REQUESTED:
