Background: SPUC currently owns a 11.02 acre parcel that will be bisected by CR 21. The split will result in a 5.52 acre parcel which will be used for a SPUC substation, a 2.12 acre parcel which will be CR 21 right of way, and a 3.38 acre parcel which SPUC wishes to sell. The remnant property is located within the City of Prior Lake. Both Shakopee and Prior Lake have been offered the opportunity to purchase the land at market rates; however, from Shakopee's standpoint, we have no need for the property. SPUC has asked for the City Council's concurrence to sell the land. For a number of years in the past, the City of Shakopee's name appeared on the titles of all SPUC-owned property. While in recent times that has changed, the City Attorney advises that in order to eliminate possible title issues, the City Council authorize the sale of this land. Budget Impact: There is no impact on the City's budget. Recommendation: I recommend the City Council authorize the sale of this property. Relationship to Visioning: This supports Goal F, "Housekeeping". Action Required: If the Council concurs, it should, by motion authorize the sale of a 3.38 acre parcel of land owned by Shakopee Public Utilities, located adjacent to CR 21, within the City of Prior Lake. lWf\W~uu Mark McNeill City Administrator SHAKOPEE PUBLIC UTILITIES COMMISSION "Lighting the Way - Yesterday, Today and Beyond" February 25, 2009 Mr. Mark McNeill, City Administrator City of Shakopee 129 South Holmes Street Shakopee,MN 55379 RE: Pike Lake Substation Property - Sale of Remnant Parcel Dear Mark: The Utilities Commission is seeking the City Council's concurrence on the sale of a 3.36 acre remnant parcel left after Scott County acquires a 2.12 acre Right of Way for CR 21 across the Commission's property located in Prior Lake. The Commission has the option to sell the remnant parcel to Scott County, but is first determining if the City of Prior Lake has any interest in acquiring the parcel for their use. In either case, the Commission, as is their practice, seeks the Council's concurrence in the sale of the remnant parcel. I've enclosed some maps depicting the location of the Commission's property in Prior Lake along with the proposed CR 21 Right of Way map. Thank you. Joseph D.
