DISCUSSION
ISD 720 has submitted an application for preliminary and final plat approval of 20 I 0 Elementary School.
Please see Exhibits A and B for location and proposed plat. The preliminary plat proposes the creation of
4 lots and I outlot while the final plat proposes the creation of 3 lots and 2 outlots.
The applicant does not intend to develop Outlot A but rather anticipates that the outlot would be sold at
some point in the future for commercial development.
PLANNING COMMISSION RECOMMENDATION
The Planning Commission reviewed the preliminary plat at its February 5, 2009 meeting, and
recommended approval of the preliminary plat application, subject to conditions. The Planning
Commission report is attached to this report for the Council's reference.

RESOLUTION NO. 6870
A RESOLUTION OF THE CITY OF SHAKOPEE, MINNESOTA APPROVING THE
PRELIMINARY AND FINAL PLAT OF 2010 ELEMENTARY SCHOOL
WHEREAS, ISD 720, applicant and property owner, has made application for preliminary and
final plat approval of2010 Elementary School; and
WHEREAS, the subject property is legally described as:
That part of the Northwest Quarter of the Northwest Quarter of Section 13, Township 115, Range 23,
Scott County, Minnesota, described asfollows: Beginning at Right of Way Boundary Corner B27 as
shown on Minnesota Department of Transportation Right-of-Way plat Numbered 70-2 as the same is on
file of record in the office of the county Recorder in and for said county; thence southerly on an azimuth
of 179 degrees 05 minutes 21 seconds along the boundary of said Plat No. 70-2 for 702.84 feet to Right
of Way Boundary Corner B28; thence on an azimuth of273 degrees 02 minutes 06 seconds along the
boundary of said plat for 1259.46 feet; thence northerly for 163.12 feet on a non-tangential curve,
concave to the east, having a radius of2764.80 feet, a delta angle of 03 degrees 22 minutes 49 seconds

WHEREAS, the Planning Commission reviewed the preliminary plat on February 5, 2009,
and recommended approval of the plat with conditions; and
WHEREAS, the City Council reviewed the proposed preliminary and final plat on February
17,2009.
NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Shakopee,
Minnesota that the preliminary and final plat of 20 I 0 Elementary School is hereby approved subject
to the following conditions:
I. The following procedural actions must be completed prior to the release of the
Final Plat' for recording:
1. The approval of the plat is contingent upon receiving approval of the
storm water management plan.
2. Approval oftitle by the City Attorney.
3. Execution of a Developer's Agreement, which shall include provisions
for security for all public improvements within the final plat and the
engineering review fees.
4. Payment of Trunk Sanitary Sewer Charges shall be made, as required
by the most current City of Shakopee Fee Schedule.
5. Payment of Trunk Storm Water Charges and Trunk Storm Water
Storage and Treatment Charges shall be made, as required by the most
current City of Shakopee Fee Schedule.
6. Payment of all storm water management review charges as required by
the most current City of Shakopee Fee Schedule.
7. The Provide electronic files (Auto CAD and Adobe Acrobat formats)
of the final plat to be recorded with datum on the Scott County
coordinate system.
8. The previous plat proposal for a medium density residential (R-2)
development was designed so as to preserve a majority of the existing
wetland complex and provide a natural buffer through the site. This
proposal requires additional impacts to the wetland complex and
approximately six-hundred ten (610) feet of sixty (60) inch reinforced
concrete pipe through the impacted wetland. The applicant will be
reimbursed for storm sewer oversizing costs based on the design set
forth in original medium density residential (R-2) proposal.
9. Easements need to be shown on the preliminary plat and the final plat
as approved by the City Engineer. They shall include, but not be
limited to, the following:
a) Minimum drainage and utility easements for public sanitary
sewer and public storm sewer need to be dedicated per the City
of Shakopee Design Criteria, Section 10.1 (A-D). The
easements need to be centered along the public utility
alignments.
b) Provide a drainage and utility easement over all of Outlot B.
c) For the proposed storm sewer from FES2 to CB (skimmer
structure located on the property lines of Outlot A and Outlot
B) to FES3, provide a minimum of thirty-six (36) feet of
drainage and utility easement, centered along the utility
alignment.
d) Provide adequate drainage and utility easements to encompass
the entire emergency overflow route from the wetland
mitigation area in Outlot B to the site's ultimate emergency
overflow.
e) For the proposed sanitary sewer from MHl (Existing) to the
existing downstream manhole, provide a minimum of forty
(40) feet of drainage and utility easement, centered along the
utility alignment.
f) Provide a minimum of fifteen (15) feet of drainage and utility
easement adjacent to the 1 ih Avenue and Marystown Road
(County Road 15) rights-of-way in Outlot A.
g) Provide a minimum of ten (10) feet of drainage and utility
easement along the interior property lines of Outlot A and
Outlot B not adjacent to the 17th Avenue and Marystown Road
(County Road 15) rights-of-way.
h) Provide a minimum of forty-six (46) feet of drainage and utility
easement in the rear of Lots 1 and 2 of Block 2.
i) For the existing and proposed sixty (60) inch storm sewer
located within Lot 1 of Block 2, provide a minimum of sixty-
two (62) feet of drainage and utility easement, centered along
the existing and existing and proposed utility alignment.
j) For the portion of the existing wetland complex left intact,
provide a conservation easement from FES3 to the property
line, centered along the bottom of the wetland as it drains
offsite. The width of the conservation easement will depend
upon the wetland delineation reVIew of the Technical
Evaluation Panel (TEP).
k) For the proposed portion of Lusitano Street exceeding thirty-
seven (37) feet in width, provide a minimum of eighty (80) feet
of right-of-way. The street needs to be centered in the right-of-
way.
1) Additional right-of-way, in the form of equidistant sight
triangles fifteen (15) feet in length, needs to be provided at the
intersection of Jutland Street and Lusitano Street.
m) Additional right-of-way, in the form of equidistant sight
triangles fifteen (15) feet in length, needs to be provided at the
future intersection of Lusitano Street and the access provided
to and from 17th A venue.
10. The preliminary plat and the final plat depend heavily on receiving
approval of the wetland delineation report and the wetland
replacement plan. Therefore, the approval of the preliminary plat and
the final plat needs to be contingent upon receiving approval of the
wetland delineation report and the wetland replacement plan by
members of the TEP and the City of Shakopee acting in its role as the
Local Governing Unit (LGU).
11. The applicant needs to provide wetland buffer easements and markers
per Section 16.12, Subd. 3 (A-C) of the City Code.
12. Full park dedication credit will be granted toward the applicant's park
dedication requirements for the construction of the north ball field,
future south ball field and for the hard and soft play areas subject to
the following:
a) The future ball field to the south of the school is to be
constructed at the time of or prior to the development of Outlot
A.
b) The proposed north ball field layout shall be evaluated and
shall be rotated if possible to allow for drainage to flow across
the entire outfield.
c) The trails shall be constructed to withstand the weight of the
Parks Division equipment.
d) The school district shall install team benches and safety
fencing as a part ofthe construction of the north ball field.
II. The following items shall he completed prior to the approval of a grading permit
and/or a street/utility plan:
1. No public improvements (site grading and street and utility
improvements) will be constructed until the City Engineer and the
Shakopee Public Utilities Commission (SPUC) approves the required
Final Construction Plans and Specifications.
2. The applicant will grade the entire site, as proposed on the submitted
plans, in one phase within one year from the date of approval of the
grading permit application. Grading will be defined as bringing the
site up to the proposed finished grade with materials deemed
acceptable by the City of Shakopee engineering department, providing
topsoil per City requirements and applying seed, mulch and/or sod per
City requirements and providing an as-built grading plan per Section
2.5 ofthe City of Shakopee Design Criteria.
3. The applicant needs to remove all proposed landscaping from within
conservation easements and drainage and utility easements per the
most recent version of the City of Shakopee Easement Fencing and
Landscaping Policy. Areas that are not in compliance include, but are
not limited to, the following:
a) Drainage and utility easements encompassing the approved
high water level of the wetland mitigation area.
b) Drainage and utility easements encompassing the emergency
overflow route from the wetland mitigation area in Outlot B.
c) The drainage and utility easement centered on the storm sewer
alignment from MHIOl to FESl (located in Outlot B)
d) The drainage and utility easement centered on the storm sewer
alignment from FES2 to CB (skimmer structure located on the
property lines of Outlot A and Outlot B) to FES3.
e) The drainage and utility easement centered on the sanitary
sewer alignment from MH 1 (Existing) to the next downstream
manhole.
4. CB shown on the property lines of Outlot A and Outlot B needs to be
replaced with a pond skimmer structure per the City of Shakopee
General Specifications and Standard Detail Plates for Street and Utility
Construction (Detail Number 4012).
5. The applicant needs to realign the proposed storm sewer and eliminate
the connection to the existing catch basin located at the rear property
corners of Lots 2 and 3, Block 10 of the Countryside Addition. The
two (2) approved connection points are located to the North at the rear
property corners of Lots 8 and 9, Block 10 and in the rear of Lot 13,
Block 10 of the Countryside Addition.
6. The applicant needs to provide wetland buffer easements and markers
per section 16.12, Subdivision 3 (A-C) ofthe City Code.
7. F or the proposed portion of Lusitano Street approaching 1 ih Avenue,
the street needs to transition from a width of thirty-seven (37) feet to a
width of forty-four (44) feet. This transition needs to begin at
approximately station 2+50.
8. The applicant shall meet the City's Woodland and Tree Management
Ordinance requirements.
9. Placement of 6 inches of topsoil. The soil compositions should be
similar to the MnDOT topsoil borrow requirements.
10. Rain sensors shall be subject included in the installation of any
irrigation system.
III. The following items need to be addressed/completed prior to the issuance of a
building permit:
1. Record plans need to be provided per the City of Shakopee Design
Criteria, Section 2.5 and Section 11.2 (A-L). The record plans need to
be submitted to the Engineering Department.

DISCUSSION
ISD 720 has submitted an application for preliminary and final plat approval of 20 1 0 Elementary
School. Please see Exhibits A and B for location and the proposed plat. The subject site is
approximately 28 acres in size.
The Planning Commission is charged with reviewing the preliminary plat only. Final plats are
reviewed only by the City Council. The preliminary plat proposes the creation of 3 lots and 2
outlots. Proposed Lot 1, Block 1 would be the site upon which the school is constructed. Lots 1
and 2, Block2 are single family residential lots and would, in all likelihood, be sold by the
school district and developed as such. Outlot B is intended to serve as a wetland mitigation site
and Outlot A is anticipated to be sold for commercial development and further subdivided at
some point in the future.
Other departments and agencies have reviewed the application and have provided comments.
Appropriate comments from these departments have been incorporated into the draft conditions
of approval. Please find attached copies of the comments received from the Engineering
Department and the Park and Recreation Department.
STAFF RECOMMENDATION
Staff recommends thatthe Planning ,Commission recommend to the City Council the approval of
the Preliminary Plat of2010 Elementary School, subject to the following conditions:

The application indicates a request for a concurrent preliminary plat and final plat approval, a
zoning realignment and a conditional use permit for a proposal to locate an elementary school on
a property zoned medium density residential (R-2). The property is located to the West of the
Countryside Addition at the intersection between US-169 and Marystown Road (County Road
15).
This review is preliminary, as more comments are to follow with additional submittals.
However, I offer the following comments at this time for the applicant and for the planning
department:
General Comments
The following items need to be addressed/completed prior to release of the Final Plat for
recording:
1. Execution of a Developer's Agreement, which needs to include provisions for security
for public improvements within the Final Plat and the engineering review fees.
2. Payments of Trunk Sanitary Sewer Charges need to be made, as required by the most
current City of Shakopee Fee Schedule.
3. Payments of Trunk Storm Water Charges and Trunk Storm Water Storage and Tre<;ltment
Charges need to be made, as required by the most current City of Shakopee Fee
Schedule.
4. The previous plat proposal for a medium density residential (R-2) development was
designed so as to preserve a majority of the existing wetland complex and provide a
natural buffer through the site. This proposal requires additional impacts to the wetland

complex and approximately six-hundred ten (610) feet of sixty (60) inch reinforced
concrete pipe through the impacted wetland. The applicant will be reimbursed for storm
sewer oversizing costs based on the design set forth in original medium density
residential (R-2) proposal.
5. Provide electronic files (Auto CAD and Adobe Acrobat formats) of the final plat to be
recorded with datum on the Scott County coordinate system.
The following items need to be addressed/completed prior to approval of a grading permit
and/or a street and utility plan:
1. No public improvements (site grading and street and utility improvements) will be
constructed until the City Engineer and the Shakopee Public Utilities Commission
(SPUC) approves the required Final Construction Plans and Specifications.
2. The applicant will grade the entire site, as proposed on the submitted plans, in one phase
within one year from the date of approval of the grading permit application. Grading will
be defined as bringing the site up to the proposed finished grade with materials deemed
acceptable by the City of Shakopee engineering department, providing topsoil per City
requirements and applying seed, mulch and/or sod per City requirements and providing
an as-built grading plan per Section 2.5 of the City of Shakopee Design Criteria.
3. The applicant needs to remove all proposed landscaping from within conservation
easements and drainage and utility easements per the most recent version of the City of
Shakopee Easement Fencing and Landscaping Policy. Areas that are not in compliance
include, but are not limited to, the following:
. Drainage and utility easements encompassing the approved high water level of the
wetland mitigation area.
. Drainage and utility easements encompassing the emergency overflow route from the
wetland mitigation area in Outlot B.
. The drainage and utility easement centered on the storm sewer alignment from
MHI0l to FESl (located in Outlot B)
. The drainage and utility easement centered on the storm sewer alignment from FES2
to CB (skimmer structure located on the property lines of Outlot A and Outlot B) to
FES3.
. The drainage and utility easement centered on the sanitary sewer alignment from
MHl (Existing) to the next downstream manhole.
4. CB shown on the property lines of Outlot A and Outlot B needs to be replaced with a
pond skimmer structure per the City of Shakopee General Specifications and Standard
Detail Plates for Street and Utility Construction (Detail Number 4012).
5. The .applicant needs to realign the proposed storm sewer and eliminate the connection to
the existing catch basin located at the rear property comers of Lots 2 and 3, Block 10 of

the Countryside Addition. The two (2) approved connection points are located to the
North at the rear property corners of Lots 8 and 9, Block 10 and in the rear of Lot 13,
Block 10 of the Countryside Addition.
6. The applicant needs to provide wetland buffer easements and markers per section 16.12,
Subdivision 3 (A-C) ofthe City Code.
7. For the proposed portion of Lusitano Street approaching 1 ih A venue, the street needs to
transition from a width of thirty-seven (37) feet to a width of forty-four (44) feet. This
transition needs to begin at approximately station 2+50.
The following items need to be addressed/completed prior to issuance ofa building permit:
1. Record plans need to be provided per the City of Shakopee Design Criteria, Section 2.5
and Section 11.2 (A-L). The record plans need to be submitted to the engineering
department.
Preliminary Plat and Final Plat
The following items need to be addressed/completed prior to release of the Final Plat for
recording:
1. Easements need to be shown on the preliminary plat and the final plat as approved by the
City Engineer. They shall include, but not be limited to, the following:
. Minimum drainage and utility easements for public sanitary sewer and public storm
sewer need to be dedicated per the City of Shakopee Design Criteria, Section 10.1 (A-
D). The easements need to be centered along the public utility alignments.
. Provide a drainage and utility easement over all of Outlot B.
. For the proposed storm sewer from FES2 to CB (skimmer structure located on the
property lines of Outlot A and Outlot B) to FES3, provide a minimum of thirty-six
(36) feet of drainage and utility easement, centered along the utility alignment.
. Provide adequate drainage and utility easements to encompass the entire emergency
overflow route from the wetland mitigation area in Outlot B to the site's ultimate
emergency overflow.
. For the proposed sanitary sewer from MHl (Existing) to the existing downstream
manhole, provide a minimum of forty (40) feet of drainage and utility easement,
centered along the utility alignment.
. Provide a minimum of fifteen (15) feet of drainage and utility easement adjacent to
the 1 ih A venue and Marystown Road (County Road 15) rights-of-way in Outlot A.
. Provide a minimum of ten (10) feet of drainage and utility easement along the interior
property lines of Outlot A and Outlot B not adjacent to the 1 ih Avenue and
Marystown Road (County Road 15) rights-of-way.
. Provide a minimum of forty-six (46) feet of drainage and utility easement in the rear
of Lots 1 and 2 of Block 2.

. For the existing and proposed sixty (60) inch storm sewer located within Lot 1 of
Block 2, provide a minimum of sixty-two (62) feet of drainage and utility easement,
centered along the existing and existing and proposed utility alignment.
. For the portion of the existing wetland complex left intact, provide a conservation
easement from FES3 to the property line, centered along the bottom of the wetland as
it drains offsite. The width of the conservation easement will depend upon the
wetland delineation review of the Technical Evaluation Panel (TEP).
. For the proposed portion of Lusitano Street exceeding thirty-seven (37) feet in width,
provide a minimum of eighty (80) feet of right-of-way. The street needs to be
centered in the right-of-way.
. Additional right-of-way, in the form of equidistant sight triangles fifteen (15) feet in
length, needs to be provided at the intersection of Jutland Street and Lusitano Street.
. Additional right-of-way, in the form of equidistant sight triangles fifteen (15) feet in
length, needs to be provided at the future intersection of Lusitano Street and the
access provided to and from 17th Avenue.
2. The preliminary plat and the final plat depend heavily on receiving approval of the
wetland delineation report and the wetland replacement plan. Therefore, the approval of
the preliminary plat and the final plat needs to be contingent upon receiving approval of
the wetland delineation report and the wetland replacement plan by members of the TEP
and the City of Shakopee acting in its role as the Local Governing Unit (LGU).
Storm Water Manaeement Plan Review
The applicant's engineer has yet to submit the appropriate documents to the City's storm water
consultant per an e-mail from the engineering department dated January 12, 2009, and thus has
yet to receive final approval of the site's storm water management plan. The approval of the
applications needs to be contingent upon receiving approval of the storm water management
plan.
Recommendation
Engineering staff recommends approval of the preliminary plat, the final plat, the zoning
realignment and the conditional use permit applications subject to the conditions listed above
being addressed by the applicant prior to recording of the Final Plat.

INTIODUCTION
. The larks and Recreation Advisory Board (PRAB)and Environmental Advisory
Corrnittee (EAC) are submitting recommendations regarding the ISD 720 Preliminary
Platfinal Plat Zoning Realignment & Conditional Use Permit for School Site - 2010
Elel1entary School application.
BACKGROUND AND DISCUSSION
The~RAB and EAC reviewed the ISD 720 Preliminary Plat, Final Plat Zoning
ReaJgnment & Conditional Use Permit for School Site - 2010 Elementary School at
thei~oint meeting on January 26,2009.
DIK::USSION ON PARK DEDICATION REQUIREMENTS
In tb past, the ISD 720 has not been required to pay park dedication fees because a final
platlas not been required. Following current park dedication requirements, ISD 720
worn owe park dedication fees for each residential lot (2 lots @$5340 (current fee
schdule amount) and the lot that the school will be constructed (fair market value of
10%fthe lot = $175980). Total park dedication fees collected would be $186,660.00.
The)istrict is requesting credit towards their park dedication requirements for.
conructing the single ball field/play area and for the hard and soft play areas.
Pars and Recreation Advisory Board Recommendation
The'arks and Recreation Advisory Board recommended approval subject to the
follwing conditions:
1. ;n 720 receives credit toward their park dedication requirements for the
mstruction of the north ball field, future south ball field and for the hard and soft
:ay areas.
2. he future ball field to the south of the school is to be constructed at the time of or
~fore Outlot A.
3. he proposed north field layout has the drainage flowing to right field. Staff has
.scussed this issue with the Parks Division. The PRAB is recommending that ISD
W evaluate the layout of the proposed field and rotate the field if possible in order
Ir the drainage to flow across the entire outfield.

4. The trail connections must be constructed to withstand the weight of the Parks
Division equipment.
5. The school district install team benches and safety fencing as part of the construction
of the north ball field.
WOODLAND REVIEW. EROSION. AND WETLANDS
A portion of the construction site is within the Natural Resources Corridor and therefore
the Natural Resources Corridor Design Criteria apply. The EAC discussed the quality of
the wooded area and supported the proposed tree replacement plan. A portion of the site
also contains a wetland. Staff discussed the proposed portion of the wetland to be
preserved as well as the storm water management of the site.
Environmental Advisory Committee R~commendation
The Environmental Advisory Committee recommended approval subject to the following
conditions:
1. The applicant must meet the City's Woodland and Tree Management Ordinance
requirements.
2. Placement of 6 inches of topsoil. The soil compositions should be similar to the
Mn DOT topsoil borrow requirements.
3. Rain sensors shall be included in the installation of any irrigation system.
4. Applicant shall be subject to the conditions. set forth from Engineering
Department.
