SUBJECT: Public Hearing for the 2009 Street Reconstruction Project,
Project No. 2009-2

INTRODUCTION:
As per Resolution No. 6865, a resolution receiving a report and calling for a public
hearing on the 2009 Street Reconstruction Project, Project No. 2009-2, a public hearing is
scheduled for February 17th. This agenda item is to conduct the public hearing for the
proposed improvements associated with the 2009 Street Reconstruction Project.
BACKGROUND:
On October 21, 2008, City Council ordered the preparation of a feasibility report for the
2009 Street Reconstruction Project. The report was completed and accepted by City
Council on January 20, 2009. This proposed project includes reconstructing the
following streets:
. Spencer Street, from Shakopee A venue to 10th Avenue
. Shakopee A venue, from Clay Street to Pierce Street
. Clay Street, from Shakopee A venue to South of 10th Avenue
. Pierce Street, from 6th A venue to 10th Avenue
On February 4, 2009, staff conducted an informational meeting for the property owners
being affected by the proposed project. Approximately 25 residents attended the meeting.
The residents in attendance at the informational meeting had some general questions
regarding the design, construction schedule and assessment payments. A number of
residents expressed interest in completing additional sewer service and driveway
improvements extending beyond the right-of-way line. If the project is ordered, staffwill
make a recommendation to the City Council at a future Council meeting regarding
additional work beyond City right-of-way. The residents in attendance seemed in favor
of extending sidewalk on both sides of Spencer Street.
PROJECT COSTS:
The total estimated project cost for the 2009 Reconstruction Project is $1,595,900.00.
30% of the street improvements ($277,995.00) will be assessed to the benefitting
properties. The remaining costs associated with the street improvements will be paid
from General Tax Levy Funds ($503,840.00) and the State Aid Fund ($212,465.00).

Storm sewer improvements ($81,900.00) will be paid from the Storm Sewer Fund.
Watermain improvements ($276,500.00) will be funded by Shakopee Public Utilities.
Sanitary sewer improvements ($243,200.00) will be paid from the Sanitary Sewer Fund.
ALTERNATIVES:
1. Adopt Resolution No. 6871, a resolution ordering the improvement and the
preparation of plans and specifications for the 2009 Street Reconstruction, Project
No. 2009-2.
2. Deny Resolution No. 6871, This action will halt the project until such time as the
City Council reconsiders the resolution.
3. Table Resolution No. 6871, to allow time for staff to prepare additional
information.
RECOMMENDATION:
If Council desires to proceed with this project, at this time, then Resolution No. 6871
needs to be adopted, a resolution ordering the improvement and the preparation of plans
and specifications. If City Council does not wish to pursue this project, then the
appropriate action would be to move the approval of Resolution No. 6871 and vote
against the motion.
ACTION REQUESTED:
Offer Resolution No. 6871, A Resolution Ordering an Improvement and Preparation of
Plans and Specifications for the 2009 Street Reconstruction, Project No. 2009-2, and

A Resolution
Ordering An Improvement And Preparation Of
Plans And Specifications For The
2009 Street Reconstruction
Project No. 2009-2
WHEREAS, Resolution No. 6865 adopted on January 20, 2009, fixed a date for Council
hearing on the proposed improvement of the 2009 Street Reconstruction Project and all appurtenant
work; and
WHEREAS, ten days published notice of the hearing through two weekly publications of
the required notice was given and the hearing was held on the 17th day of February, 2009, at which
all persons desiring to be heard were given an opportunity to be heard.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SHAKOPEE, MINNESOTA:
1. That the improvement is necessary, cost effective and feasible and is ordered as
hereinafter described:
2009 Street Reconstruction Project and all appurtenant work.
2. Bruce Loney, Public Works Director, is hereby designated as the engineer for this
improvement. He shall prepare plans and specifications for the making of such improvements.
3. The work of this project is hereby designated as part of the 2009-2 Public Improvement
Program.
4. The City Council shal11et the contract for all or part of the improvements as authorized
by Minnesota Statutes 429.041, no later than three years from the date of adoption of this resolution.
