City of Shako pee MEMORANDUM co~~sr~~T ' j'f &1-"" ".." -' , .~f~ TO: Mayor and City Council Mark McNeill, City Administrator FROM: Kris Wilson, Assistant City Administrato~ SUBJECT: Ratification of Modified 2009 Public Works Union Contract DATE: February 13, 2009 Introduction The City Council is asked to authorize the appropriate individuals to sign a modified labor agreement negotiated with the Minnesota Teamsters, Local No. 320 on behalf of employees in the Public Works Department. Background At its February 3 meeting, the Council approved the labor agreement negotiated with employees in the Public Works Department, who are represented by Minnesota Teamsters, Local No. 320. When the contract was delivered to the union for their signature, they noticed some language that was in the 2006-08 contract that had been dropped and asked that it be put back in. The language relates to what is commonly referred to as a "me-too" clause - stating that if the City awards a larger wage increase to non-union employees than what it has negotiated with this union, that we will extend the same wage increase to members of the union. Since what has been negotiated is a one-year contract and the City has already acted upon an identical wage increase for non-union employees, I originally didn't see a need to carry over the "me-too" clause from the previous contract. However, the union would like to see the contract language remain in place even though both sides acknowledge that neither a mid-year wage adjustment nor a general wage study is in the cards for 2009. Recommendation: I recommend that Council authorize the appropriate officials to enter into a 2009 labor agreement with the Minnesota Teamsters, Local No. 320 that retains the following wording from the 2006- 08 contract: "In the case that non-union employees of the City receive an annual Cost of Living Adjustment in 2009 that is in excess of two percent (2%), the wage scale shown in Appendix A shall be adjusted to provide an equal increase to employees covered under this agreement. In the case that the City completes a general wage study during the time period covered by this contract, and that study supports a wage change for employees covered by this contract, both the City and the Union shall agree to re-open this article and the corresponding Appendix for negotiation. " Budget Impact The additionallanguagehas no budget impact for the period ofthe contract, as long as no across the board increases are granted to non-union employees. Relationship to Vision This is a housekeeping item. Requested Action If it concurs, the Council is asked to authorize the appropriate officials to enter into the modified labor agreement with the Minnesota Teamsters, Local No. 320, on behalf of employees in the Public Works Department.
