SUBJECT: Setting Date for Alcohol Violation Hearing

INTRODUCTION:

City Council is asked to set a date to review the actions of two alcohol licensees.
BACKGROUND:
The City Code prohibits any person to sell, barter, furnish, or give alcoholic beverages to a minor
unless such person is the parent or guardian of the minor, and then only for consumption in the
household of such parent or guardian. Licensees are subject to a fine that may be imposed by the
City or by the State of up to $2,000 and revocation or suspension ofthe license of up to 60 days.
Staff is ready to proceed with the setting of a hearing date to consider alcohol violations that
occurred during the alcohol sales compliance check on June 17, 2008. This is the first violation for
Hoang's Southside Liquors, Inc. and for RT Minneapolis Franchise LLC dba Ruby Tuesday, within
a three-year period. Under the current ordinance, adopted by City Council on July 2, 2002, the
penalties for a first or second incident shall be imposed and administered by the City Administrator
upon an admission by the licensee that the licensee furnished or sold an alcoholic beverage to a
minor. Any licensee with a first or second violation within a three-year period who admits to the
violation and does not ask for a hearing will not need to appear before City CounciL

RECOMMENDED ACTION:
Set a hearing for Tuesday, March 3, 2009, at 7:00 p.m., or thereafter, to review the actions of
Hoang's Southside Liquors, Inc., 1667 17th Avenue East and RT Minneapolis Franchise LLC, dba
Ruby Tuesday, 4135 Dean Lakes Boulevard.
