'''' ..~ ".;;~'~, ,~) ~\iJ ~ ;- TO: Mayor & City Council Mark McNeill, City Administrator FROM: Jeff Weyandt, Assistant City Engineer SUBJECT: 2009 Bituminous Overlay, Project No. 2009-3 DATE: January 6, 2009 INTRODUCTION: Attached is Resolution No. 6866, a resolution receiving a report and calling for a hearing on the 2009 Bituminous Overlay Project, Project No. 2009-3. BACKGROUND: On October 21, 2008 the City Council ordered the preparation of a feasibility report to analyze a bituminous overlay of various streets throughout the City by Resolution No. 6827. The purpose of the feasibility report is to evaluate the existing infrastructure (streets, utilities,. drainage) and make recommendations for any improvements that are needed. The feasibility report also addresses the estimated costs for the improvements and the proposed assessments that result from the project being constructed. The attached resolution sets a public hearing for this project on February 17, 2009. The approval of Resolution No. 6866 does not order the project nor does it commit the Council to constructing any improvements. The intent of this resolution is to receive the feasibility report and set the public hearing date. The public hearing will allow the property owners adjacent to the project area and the general public the opportunity to address the City Council on this project. Staff will make a full presentation at the February 17, 2009 public hearing on the feasibility report to the public and the City Council. ALTERNATIVES: 1. Adopt Resolution No. 6866. This action will receive the feasibility report and set the date for the public hearing for February 17,2009. 2. Deny Resolution No. 6866. This action will halt the project until such time that City Council reconsiders the resolution. 3. Move to receive the feasibility report but do not set a date for the public hearing at this time. This action will place the project on hold until such time as the City Council sets a date for the public hearing. 4. Table Resolution No. 6866 to allow time for staff to prepare additional information and/or revise the feasibility report as directed by the City Council. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SHAKOPEE, MINNESOTA: 1. The Council will consider the 2009 Bituminous Overlay Project and all appurtenant work in accordance with the report and the assessment of abutting and benefited property for all or a portion of the cost of the improvements pursuant to Minnesota Statutes Chapter 429 at an estimated total cost of the improvement for the 2009 Bituminous Overlay of$1,038,948.00. 2. A public hearing shall be held on such proposed improvements on the 17th day of February, 2009, at 7:00 P.M. or thereafter, in the Council Chambers of City Hall, at 129 South Holmes Street, Shakopee, Minnesota, and the Clerk shall give mailed and published notice of such hearing and improvement as required by law. 3. INTRODUCTION I On October 21, 2008 the City Council ordered the preparation of a feasibility report to analyze an potential bituminous overlay of Boiling Springs Lane, from I Stagecoach Road to 900 Feet North of Preserve Trail; Stagecoach Road, from Preserve Trail to 600 Feet South of 13th Avenue; 13th Avenue, from Stagecoach Road to the City Limits; 4th Avenue, from Shenandoah Drive to the Certain-Teed I property; and Shenandoah Drive by Resolution No. 6827. This project is included in the City's 2009 Capital Improvement Program. I 2. SCOPE I This report will determine the feasibility of a bituminous overlay, and any necessary improvements to existing concrete curb & gutter and utilities. The I project has been separated into two project areas due to their location and nature of the improvements. Area "A" is Stagecoach Road, from Preserve Trail to 600 Feet South of 13th Avenue; 13th Avenue, from Stagecoach Road to the City Limits; I 4th Avenue, from Shenandoah Drive to the Certain-Teed property; and Shenandoah Drive. Area "B" is Boiling Springs Lane from Stagecoach to 900 Feet North of Preserve Trail. The report will also determine the cost effectiveness of the I proposed improvements, provide a cost apportionment, preliminary cost estimate and a preliminary assessment roll. I 3. BACKGROUND I The streets located within Area "A" were originally constructed between 1982 and 1987, which included bituminous pavement with aggregate shoulders with the I exception of 13th Avenue, which includes concrete curb & gutter. Stagecoach Road was formally a County road which may have been gravel for some time. I The residential streets located within Area "B" were originally constructed in 1983, which included bituminous pavement with aggregate shoulders. I Area "A" has numerous zoning uses which include RR, RIB, B1, CC, II, 12, and MR. Area "B" is zoned RR. I Streets in Area "A & B" have received routine maintenance which may have included crack sealing, seal coating, patching, and aggregate shouldering material. Due to a combination of increased traffic, wear and age, the bituminous surfaces I in both areas have deteriorated and are in need of resurfacing. PROPOSED IMPROVEMENTS I 4.1 Street I The proposed street improvements are identified in Drawings No.1 to 4 in the Appendix. I The proposed street improvements in Area "A" will consist of patching areas of sub-grade instability, edge milling of the existing pavement near the curb on 13th Avenue, placement of a 2-inch to a 2-1/2 inch bituminous I overlay over the existing pavement, and placement of aggregate shouldering material. I The proposed street improvements in Area "B" will consist of reclaiming the existing pavement, correcting areas with sub-grade instability, removal of a portion of the cul-de-sac remnant, placement of a 2-1/2-inch I bituminous pavement layer and placement of aggregate shouldering material. I The purpose of this project is to resurface the roadway to extend its life, provide a smoother driving surface and to reduce yearly maintenance costs by reducing the amount of patching and crack sealing that is needed on a I yearly basis. Due to the amount of traffic on some of these roads and their condition, it can be expected to see cracking of the surface (reflective I cracking) after the first freeze-thaw cycle. Overlaying the roadways now will delay the expense and inconvenience of a complete reconstruction. I The total estimated project cost for the proposed street improvements is $1.038.948. An itemized cost estimate is included in the Appendix. I 4.2 Sanitary Sewer I Most properties in this project area are served with Individual Onsite Sewage Treatment Systems (septic systems). These systems are not located within the roadway right of way and any maintenance and repairs I are the responsibility of the property owner. It is anticipated that municipal sanitary sewer will be made available to these properties in the future. At that time the property owners can petition the City for municipal sewer I and water service. When utilities are extended to this area, the streets will be completely reconstructed to the current City standard street design. The sanitary sewer was televised and evaluated prior to writing this report I and there are no proposed improvements to the existing sanitary sewer. I Feasibility Report Page 2 of 4 I 2009 Bituminous Overlay, Project No. 2009-3 City of Shakopee I I 4.3 Storm Sewer I The existing culverts will be evaluated in the rural areas and replaced if necessary as part of this project. The City's Public Works Department will I evaluate the storm sewer structures and will make necessary repairs prior to the overlay. I 4.4 Watermain Most properties in this project area are served with individual wells which I are the responsibility of the property owner. Shakopee Public Utilities will evaluate the water system where present and will make necessary repairs prior to the overlay. I 4.5 Easements I It is not anticipated that easement acquisition will be required for this project. I 5. SPECIAL ASSESSMENTS I 30% of the project costs for the street improvements are proposed to be assessed to the benefiting properties adjacent to the proposed improvements. I Properties adjacent to the improvements in Area "A" will be assessed on a front footage basis. Properties adjacent to the improvements in Area "B" will be I assessed on a unit basis. The remaining costs associated with the proposed street improvements, will be paid with Tax Levy Funds, and State Aid Funds. I The estimated assessment rate is $12.34 per front foot in Area "A" and $2.300.07 per unit in Area "B". A preliminary assessment roll is included in the Appendix. Actual assessments will be based on the fInal project costs. Final assessments I could range from $9.00 to $14.00 per front foot and $1,900 to $2,400 per unit depending on actual 2009 bid prices for bituminous. I It is proposed to cap the assessments for properties zoned Rural Residential (RR) with less than 300 feet of front footage at a maximum front footage of 100 feet. 100 feet is the smallest residential lot width in the project area. Not capping I assessments would result in residential property in the overlay area receiving a higher assessment than the Boiling Springs area, which is receiving a bituminous reclamation. There is one rural residential lot in Area "A" that has 972 feet of I front footage. Most likely this lot will be subdivided in the future. It is proposed to cap the assessable front footage of this lot at 600 feet. Capping the assessable front footage, as proposed using the current cost estimate, would result in an I additional City cost of $19,398.48. The City will also pay an estimated Feasibility Report Page 3 of 4 I 2009 Bituminous Overlay, Project No, 2009-3 City of Shakopee I I $28,011.80 for the north side of 13th Avenue, which is adjacent to Trunk Highway I 169 right-of-way. As a result, approximately 25.5% of the total project costs will be assessed. I Properties proposed to be assessed are identified on Drawings No. 5-9 in the Appendix. I 6. ESTIMATED COSTS Itemized cost estimates are included in the Appendix. The following costs were I prepared using 2008 construction costs. Due to the volatility of oil prices, bituminous prices in 2008 ranged from $49 to $75 per ton. This report used $70 per ton based on some recently bid 2009 projects in the Metro area. The I bituminous portion of these projects makes up approximately 85% of the total construction cost. All these estimated costs are subject to change, depending on the final design of the project, bids received and actual work performed. CONCLUSION From an engineering standpoint, the proposed improvements are feasible, cost I effective and necessary for the preservation of the existing infrastructure.
