SUBJECT: Resolution No. 6864, Denying a Taxicab License

INTRODUCTION AND BACKGROUND:
After holding the required public hearing on December 16,2008, City Council denied an
application for a taxicab license from Mr. Randy Busch d/b/a Southwest Metro Transportation
and directed staffto prepare a resolution setting forth the reasons for the denial.
The city attorney has prepared the attached Resolution No. 6864, A Resolution Denying a
Taxicab License to Randy Busch d/b/a Southwest Metro Transportation, for Council's
consideration.
Mr. Busch has submitted another application for a taxicab license for 2009 and this application is
elsewhere on the January 6,2009 City Council Agenda.
RECOMMENDED ACTION:
If Council concurs with the drafted resolution, they may
Offer Resolution No. 6864, A Resolution Denying a Taxicab License to Randy Busch
d/b/a southwest Metro Transportation, and move its adoption.

RESOLUTION NO. 6864
A RESOLUTION DENYING A TAXICAB LICENSE
TO RANDY BUSCH d/b/a SOUTHWEST METRO TRANSPORTATION
WHEREAS, Randy Busch has applied for a taxicab license for 2009 for three vehicles
under the name of Randy Busch d/b/a Southwest Metro Transportation; and
WHEREAS, the City Council held a public hearing on the application on December 16,
2008, as required by the City Code; and
WHEREAS, Mr. Busch made a presentation to the City Council to support his
application for taxicab license; and
WHEREAS, the Shakopee Police Department recommended denial of the taxicab license
application based on three citations that were issued in 2008 to Mr. Busch and his drivers; and
WHEREAS, the City Council denied Mr. Busch's application on December 16, 2008 and
directed that a Resolution be prepared setting forth the basis for the denial.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SHAKOPEE, MINNESOTA, that the denial of the taxicab license application for Randy
Busch d/b/a Southwest Metro Transportation is based on the follow reasons:
1. City Code Section 6.22, Subdivision 2 provides that it is unlawful for a
person to operate a taxicab business, or permit a taxicab owned or
controlled by that person to be operated, in the City without first obtaining
a license from the City.
2. City Code Section 6.22, Subdivision 10 provides that it is unlawful for a
person to operate a taxicab in the City without first obtaining a taxicab
driver's license from the City.
3. City Code Section 6.03, Subdivision 5 provides that the City Council may,
for any reasonable cause, refuse to grant any application, or revoke any
license and that no license shall be granted to a person of questionable
moral character or business reputation.
4. Randy Busch is the principal officer for Tri Taxi, Inc, which was issued a
taxicab license for 2008 for one vehicle. That license expired on
December 31, 2008.
5. On February 13, 2008, the Shakopee Police Department issued a citation
to one of Mr. Busch's taxicab drivers for failure to have a taxicab driver's
license. City records show that the driver did not have a valid taxicab
driver's license from the City as of February 13, 2008. Mr. Busch was
advised ofthe citation on February 13,2008. The driver was also cited for
failing to operate the taxi meter, which is required by City Code Section
6.22, Subdivision 19, and for failing to display the City's taxicab license,
which is required by City Code Section 6.22, Subdivision 16.
6. In August 2008, Mr. Busch requested to add two additional vehicles to the
taxicab license for Tri City Taxi, Inc. The City Council tabled that request
on August 5, 2008 because Mr. Busch had not provided adequate proof of
insurance for the two vehicles as required by City Code Section 6.22,
Subdivision 6. Mr. Busch never provided proof of such insurance to the
City in 2008.
7. On August 28,2008, Mr. Busch was issued a citation by the Shakopee
Police Department for operating a taxicab that was not licensed by the
City. The taxicab that Mr. Busch was operating was one of the vehicles
that Mr. Busch had requested to add earlier that month and for which
adequate proof of insurance had not been provided to the City.
8. On November 22, 2008, the Shakopee Police Department issued a citation
to a Tri City Taxi, Inc. driver for operating a taxicab that was not licensed
by the City. The vehicle that the driver was operating was the same
vehicle that Mr. Busch had been operating on August 28, 2008 and for
which he had been issued a citation. The driver was also cited for failure
to operate the taxi meter, failure to display the City's taxicab license, and
failure to display the rate card, which is required by City Code Section
6.22, Subdivision 20.
9. The above reasons demonstrate that in 2008 Mr. Busch and his company
violated City Code provisions relating to the operation and licensing of
taxicabs on numerous occasions and are the basis for the City Council's
decision to deny his application for taxicab license for 2009.
