HomeMy WebLinkAbout13.D.3. 2009 Bituminous Overlay Project No. 2009-3 I;), 0.3, CITY OF SHAKOPEE Memorandum TO: Mayor & City Council Mark McNeill, City Administrator FROM: Jeff Weyandt, Assistant City Engineer SUBJECT: 2009 Bituminous Overlay Project, Project No. 2009-3 DATE: December 16, 2008 INTRODUCTION: Prior to finalizing the feasibility study for the 2009 Bituminous Overlay Project, staff would like to discuss assessment issues including putting a cap on residential assessments and high assessments on certain properties. BACKGROUND: The 2009 project is being split into two project areas. The Boiling Springs area is 100% residential and is proposed to have a bituminous reclamation performed. It is proposed to assess this area on a unit basis with the estimated assessment at $2,300.00 per unit. Staff is not proposing to cap assessments in the Boiling Springs area. The remaining project area, consisting of collector routes, is proposed to receive a bituminous overlay (no reclamation) and is a mix of seven zoning districts. Typically, the City would assess residential property on a unit basis and non-residential property on a front foot basis. Staff is proposing to assess this area on a front foot basis, capping the residential lots at a maximum front footage of 100 feet. 100 feet is the smallest residential lot width in the project area. Not capping assessments would result in residential property in the overlay area receiving a higher assessment than the Boiling Springs area, which is receiving a bituminous reclamation. Not capping assessments could result in a number of assessment appeals. There is one rural residential lot on Stagecoach Road that has 972 feet of front footage. Most likely this lot will be subdivided in the future. Currently, staff is proposing to assess this property six times as much as the other property zoned Rural Residential. There is a high likelihood this property owner will appeal the assessment. It should also be noted that the estimated assessment for the Pinewood Estates Homeowner's Association is $11,500.00, which also has a high likelihood of being appealed. ALTERNATIVES: 1. Direct staff to finalize the report capping residential assessments, as recommended by staff. 2. Provide direction to staff regarding assessment method for the 2009 Bituminous Overlay Project.
