INTRODUCTION:
Attached is Resolution No. 6854, a resolution approving the C.R. 21 Extension Layout, as
requested by Scott County. Also attached is a resolution approving No Noise Mitigation by
Stratford Village.
BACKGROUND:
C.R. 21 Extension Project, from C.R. 42 to Southbridge Parkway, has been under design for the
past 1 and a half years. The design is at a point where the layout has been finalized and the
County policy is to request layout approval from the Cities prior to acquiring right-of-way. City
staff has been involved in the project management team meetings with Bruce Loney and Jeff
Weyandt working on the C.R. 21 improvements, Michael Leek working on the Eagle Creek
transit station improvements and Jamie Polley coordinating the C.R. 21 improvement impacts to
Shutrop Park and open space by C.R. 16 and C.R. 21.

The maior imorovements with the C.R. 21 extension would be as follows:
1. A re-design of C.R. 18/Southbridge Parkway and C.R. 21 intersection.
2. The roadway is a four lane divided urban roadway with trails on both sides.
3. A trail on the west side of C.R. 18 is also being included to connect to an existing trail in
the Riverside Fields area.
4. Pedestrian underpass is included to provide trail access under C.R. 21 to Shutrop Park.
5. C.R. 16 and C.R. 21 intersection will be signalized.
6. The Eagle Creek transit station design is included and in the southwest quadrant of C.R.
16 and C.R. 21.
7. A Blue Lake Channel crossing has been incorporated in the south end of the City Limits.
8. Shakopee Public Utilities future sub-station site design has been included in the project
design and their site is in the City of Prior Lake.
Previously, the City Council has executed an MOU to exchange certain properties that the City
owns along the C.R. 21 corridor for Parcel 75 in the Southbridge area. Part of that MOU is for
the City to execute a Cooperative Agreement which outlines those considerations. In the
resolution approving layout, the execution of a future Cooperative Agreement is mentioned.
Also included in the memo is a letter for a right-in/right-out access from Hansen Avenue to C.R.
18 from Lezlie Vermillion, Scott County Public Works Director. A draft MOU will be prepared
by April 1, 2009 per the letter from Ms. Vermillion and upon completion of the traffic study
previously authorized by the city and the county.
County staff and consultant staff will be present at the meeting to present the layout design and
answer questions. It should be pointed out that the extension layout approval is not a final design
or Cooperative Agreement, but rather approving the general layout of the design in order for the
County to proceed with right-of-way acquisition. A future Cooperative Agreement will be
presented with the final plans at a later date. Currently, the City's costs participation for this
project is estimated at $1.5 million, which is the amount that has been included in the City's
Capital Improvement Program. Michael Leek would be able to address the City's participation
level on the Eagle Creek transit station and layout.
ALTERNATIVES:
1. Approve Resolution No. 6854, a resolution approving C.R. 21 Extension Layout.
2. Do not approve Resolution No. 6854.
3. Approve Resolution No. 6858, a resolution declining the installation of a noise mitigation
wall for Stratford Village consistent with the formal action of the Stratford Village
Condominium Association (Stratford) Board of Directors.
4. Do not approve Resolution No. 6858.

RECOMMENDATION:
Staff feels that the preliminary layout design has been done to meet the City's concerns. Staff
has also been involved with the Stratford Village Homeowner's Association in regard to any
noise mitigation necessary. Stratford Village Homeowner's Association has approved no
additional noise mitigation desired on their part. The County is committing to a right-in/right-
out access of Hansen Avenue to CR 18 and will prepare a MOU by April 1, 2009 in regards to
that access.

RESOLUTION NO. 6854
A Resolution of the City of Shako pee Approving the Preliminary Design
Layout of the C.R. 21 Extension.
WHEREAS, the C.R. 21 extension project designed by Scott County is needed to meet future
traffic volumes; and
WHEREAS, the County has secured federal funding for more than $11,000,000.00 of the project
costs, which funding will expire in 2010 and 2011 unless the project is constructed; and
WHEREAS, the layout proposed by the County for the C.R. 21 extension project addresses City
transportation and pedestrian facility.needs.
WHEREAS, the County will prepare a draft Memorandum of Understanding (MOD) for the right
inJright out access of Hansen Avenue to C.R. 18 by April 1, 2009.
WHEREAS, the County and the City have executed a MOU for the City to provide certain
property for C.R. 21 in exchange for Parcel 75 from the County or MNDOT.
WHEREAS, a future Cooperative Agreement between the County and City and fmal plans for the
CR 21 extension project will be presented at a later date.

SUBJECT: Eagle Creek Station Park and Ride (Eagle Creek) Site Design Approval

INTRODUCTION:
At its December 16th meeting the Council will be asked to provide project design approval of the CR 21
project, which includes the Eagle Creek park and ride.
DISCUSSION:
In June of2006, the City joined with Scott County and the City of Prior Lake in a memorandum of
understanding (MOU) for the acquisition and construction of both a CR 18 park and ride site (Southbridge
Crossings Transit Station) and a CR 21/16 park and ride (Eagle Creek Station.). A copy of the MOU is
attached for the Council's information. The Southbridge park and ride was, of course, opened in July of
2007. Eagle Creek is to be constructed as a part of the overall CR 21 project that is being reviewed by the
Council. The MOU contemplated that the Cities of Shakopee and Prior Lake would pay the cost of site
acquisition. With the purchase of this land by the SMSC, Scott County has negotiated a 50-year lease for the
park and ride. Under the terms of this proposed lease, the annual cost would be $100.00, and it is expected
that the County would make the total $5,000.00 lease payments up front. The lease would be renewable for
an additional 50-year term. The City is responsible under the MOU for 60% of the local match for the
construction of the park and ride.
The plans for Eagle Creek Station have been developed with ongoing input from both the Scott County
Transit Review Board (TRB) and the Scott County Transit Planning Team (TPT). Councilmember Clay is
the City's representative to the TRB, and the author is the City's staff representative to/chair ofthe TPT. The
site plan for the park and ride provides for the initial construction of about 545 parking, and provides for
future expansion. The plan also utilizes and builds upon "green" features used at Southbridge, e.g. bio-
engineered drainage swales, permeable pavers for the bus lane.

INTRODUCTION:
Council is asked to approve a resolution informing Scott County that, the Board of Directors of the
Stratford Village Condominium Association has adopted a resolution (see attached) rejecting the
offer to construct a noise mitigation wall as part of the CR 21 project. In meeting with the
Association, county officials have agreed to work with the Association to maximize the landscaping
that will be provided on or adjacent to the Stratford Village site in order to offset the impacts of the
CR 21 proj~ct on its residents.

1. Offer and pass Resolution No. 6858, a resolution ofthe City of Shakopee declining the
installation of a noise mitigation wall for Stratford Village consistent with the formal action of

A RESOLUTION OF THE CITY OF SHAKOPEE DECLINING THE INSTALLATION OF
A NOISE MITIGATION WALL FOR STRATFORD VILLAGE CONSISTENT WITH THE
FORMAL ACTION OF THE STRATFORD VILLAGE CONDOMINIUM ASSOCIATION
(STRATFORD) BOARD OF DIRECTORS
WHEREAS, the environmental impact statement (EIS) for the CR 21 extension project
concluded that a noise mitigation wall was justified to mitigate noise impacts on Stratford Village in
the City of Shakopee; and
WHEREAS, the estimated cost of such noise wall is about six hundred thousand dollars
($600,000); and
WHEREAS, under the City's approval of the plat of Stratford Village, it is the responsibility
of the developer or the developers successors to bear the cost of noise mitigation; and
WHEREAS, the Stratford Village Condominium Association is the successor to the original
developer for purposes of paying for constructing a noise wall; and
WHEREAS, the board of directors of Stratford has formally declined the construction of a
noise mitigation wall as part of the CR 21 project; and
WHEREAS, Scott County has committed to working with Stratford on a landscaping plan for
that site that will help to offset the visual and possibly noise impacts of CR 21.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SHAKOPEE, MINNESOTA:
1. That the City of Shakopee hereby declines the construction of a noise mitigation wall for
Stratford Village.
2. That the appropriate City officials provide Scott County with a copy of this resolution.

The undersigned, being all of the members of the Board of Directors of Stratford Village
Condominium Association, a Minnesota nonprofit corporation (the "Association"), have, as of the date
above written, adopted the following resolutions, in accordance with Minnesota Statutes Chapter 317 A:
WHEREAS, the members of the Board of Directors are empowered to administer the affairs of the
Association, as more fully described in the Declaration of Common Interest Community Number 1100 for
Stratford Village Condominiums ("Declaration"), the Bylaws of the Association and the Minnesota
Common Interest Ownership Act, Minnesota Statutes Chapter 515B (the "Act"); and

WHEREAS, tIle Association has been notified by representatives of Scott County (the "County"r - .......;.~, .... . .
that the County intends to construct a road along property that adjoins the Association's property, and that
the County is willing to construct a noise mitigation wall between the road and the Association's property,
at a cost to the Association of approximately Six Hundred Thousand and nollOO Dollars ($600,000.00); and
WHEREAS thirty (30) Units within the Association would benefit from the construction of said
noise mitigation wall, and, thus, would likely bear the cost for construction of said noise mitigation wall
(such Units hereinafter referred to as the "Benefited Units"); and
WHEREAS, tbe Board, having consulted with the Owners of the Benefited Units, has determined
that the Owners of the Benefited Units do not desire to have the noise mitigation wall constructed, knowing
that the cost of such wall, as reflected above, will be allocated equally among the Benefited Units.
NOW, THEREFORE, after due consideration by the members of the Board of Directors of the
Association,
RESOLVED, that the Association hereby rejects the County's offer to construct a noise
mitigation wall between the road to be constructed and the Association property, where
the cost of such construction would be borne by the Association, which would allocate
the cost to the Benefited Units.

RE: Hanson Blvd., Stagecoach and County Highway 18
Dear Mr. McNeill;
Scott County understands the concerns regarding the County Highway 18 access issues and is
committed to working over the next 3 months to complete the technical study undertaken in
the Fall of 2008. We understand the City's desire to have commitments articulated in a formal
memorandum of understanding (MOU) between the City and County. We are committed to
completing the MOU by April 1, 2009.
The County is moving forward with the submittal of our "2030 Transportation Plan" to the
Metropolitan Council which changes the vision of County Highway 21 from a principal arterial
to a minor arterial. That change in roadway classification is made possible by our joint efforts
to look at County Highway 17, south of Trunk Highway (TH) 169, as a principal arterial and we
are appreciative of the city's support to date of that effort. It is imperative to the well being of
the entire County that we preselVe a true north-south principal arterial.
When the County Highway 18 study efforts began last fall, there was a desire to look at
alternatives to the freeway ramp connections in this complex area of the TH169 system. After
the initial technical meeting in which potential design options were brainstormed, the
Minnesota Department of Transportation freeway operations staff made it clear that adding or
changing ramp configurations on TH 169 was not a viable option as both City Staff and County
Staff had hoped. This resulted in the need to refocus the consultant's scope on the study.
The focus is now to evaluate a future connection of Stagecoach to TH 13 and the safe design
of the Hanson right in/right out at County Highway 18. We are currently working to move that
process forward and have had discussions with city staff regarding this.
An Equal Opportunity/Safety Aware Employer
We also have indicated to you that the county will support the City's request to move forward
with a right-in, right-out public street access on northbound County Highway 18 at Hanson
Blvd. The operational analysis the consultant is doing should provide recommendations to the
County on any the immediate, short term and long term modifications within the corridor that
may be needed to insure the safe operations of the right in/right out at Hanson Blvd. at
County Highway 18. We also are working with city staff to identify future conditions that may
necessitate alteration or closure of this access. We believe the MOU needs to address these
issues, insuring we clearly communicate to developers and their successors the potential
alterations based upon agreement in the MOU. Until the study and understanding of that
work is complete, it is premature for the City and County to approve a MOU.
We hope this letter insures you and your Council of our commitment to moving forward with a
positive resolution to the City's need for access and the County's operational and safety
considerations on this portion of County Highway 18.

I Scott County's transportation studies
in the early 1990's identified a need
to provide a connection from the County
Highway 42 intersection with County
Highway 21 to Trunk Highway 169. These
studies helped identify alternative
future County Highway alignments to
minimize Social, Economic, and
Environmental (SEE) impacts. In 2002,
Scott County began further refinement
of the alternative roadway alignments
by forming a committee of residents,
business owners, and environmental and
governmental agencies to help guide the
direction of the new roadway
alignments, recreational and pedestrian
accommodations. as well as identifying
environmental and wildlife mitigation
measures.
The County is proposing to construct a
four (4) lane divided highway with a
raised center island, 12-foot outside
shoulders, and turn-lane channelization
at intersecting roadways along a new
alignment from CSAH 42 to CSAH 18.
County Highway 21 has been identified
as a bus transit route due to its
direct access to Trunk Highway 169, and
therefore, the wider shoulders will be
utilized for buses on each side of
County Highway 21. The County is also
proposing to construct a Park & Ride
lot and a bus only (transit) ramp onto
northbound Trunk Highway 169 off of
Stagecoach Road as part of this project.
The project will be constructed in
three (3) phases, with the trees being
removed due to oak wilt concerns during
I the winter months in early 2009. The
second phase involves site grading,
pond excavation, and trunk storm sewer
construction anticipated to commence in
mid-summer 2009 and be completed in
mid-summer of 2010. This second phase
of construction will slightly impact
both CSAH 16 and Pike Lake Road traffic
to install the storm sewer which will
require a few short roadway closures to
complete this work. The last phase of
construction will involve roadway storm
sewer installation, signal construction,
and the permanent roadway pavement.
The last phase is scheduled to begin in
April 2011 and be substantially completed
and opened to traffic in October 2011.
The County will also be revegetating the
corridor with trees as part of the tree
preservation policies of both Cities.
