DISCUSSION
Shakopee Development, LLC, has submitted a request to amend the Pinal Plats of Shakopee
Landing and Vierling Estates 1st Addition. The purpose of the amendment is to eliminate the
condition for a requirement for a play area/tot lot in the Shakopee Landing development, and add
that same condition to the Vierling Estates 1 st Addition development. These plats were approved
in 2006; however, the developer has not had success with locating the play area/tot lot in the
Shakopee Landing development and is now asking to be able to locate this facility in the Vierling
Estates development. They have provided a plan that identifies a location that will provide the
necessary area for the required equipment.
Initially, the final plat proposal for Shakopee Landing did not include a recommendation for a
play area/tot lot by the Parks and Recreation Advisory Board; therefore, the plan submitted to the
City Council in 2006 did not include this feature in their development. The City Council did
approve the plat application, with the additional condition that they provide a play area/tot lot for
residents of this development. At this point, the developer has exhausted their search for a
location on the Shakopee Landing site and are now asking the Council to approve the amended
plats to allow them the opportunity to install this play facility in the Vierling Estates
development. The amendment to the attached resolutions include the elimination of that one
condition from the previously approved Shakopee Landing plat (Resolution No. 6518, Condition
No. II. J. approved October 17,2006), with that condition now included in the proposed
amendment of the preliminary and final plat approval of Vierling Estates 1st Addition (Resolution
No. 6845, Condition No. II. DD).
The applicant is asking the Council to address this proposal at their November 25th meeting
primarily due to timing concerning a letter of credit for the completion of this and other
development related items that is set to expire yet this month, as well as their desire to install the
play area/tot lot in the Vierling Estates development yet this year. The installation of the play
area/tot lot is the one remaining item that is holding up the release of their letter of credit. As
this item concerns the Pinal Plat approval for these developments, the Planning Commission is
not required to review the application prior to Council action. Typically, Pinal Plats are placed
on the consent agenda of the Council; however, the applicant has asked to have this item not
placed on the consent agenda as they would like to have some discussion with the Council on
their development.
ALTERNATIVES
1. Approve Resolution No. 6844, a resolution approving the Final Plat Amendment for
Shakopee Landing, subject to the conditions presented.
2. Approve Resolution No. 6845, a resolution approving the Preliminary and Final Plat
Amendment for Vierling Estates 1 st Addition, subject to the conditions presented.
3. Do not approve the Final Plat Amendment of Shakopee Landing and the Preliminary
and Final Plat Amendment for Vierling Estates 1 st Addition
4. Table the matter and request additional information from staff and/or the applicant.
STAFF RECOMMENDATION
Staff recommends that the Council approve Resolution No. 6844, a resolution approving the
Final Plat Amendment for Shakopee Landing, and approve Resolution No. 6845, a resolution
approving the Preliminary and Final Plat Amendment for Vierling Estates 1 st Addition, subject to
the conditions as presented by staff.
ACTION REQUESTED
Offer a motion to approve Resolution No. 6844, a resolution approving the Final Plat
Amendment for Shakopee Landing, and approve Resolution No. 6845, a resolution approving
the Preliminary and Final Plat Amendment for Vierling Estates 1 st Addition, subject to the
conditions as presented by staff, and move its adoption.

A RESOLUTION OF THE CITY OF SHAKOPEE, MINNESOTA APPROVING AN
AMENDMENT OF THE FINAL PLAT OF SHAKOPEE LANDING
WHEREAS, Shakopee Development, LLC, applicant and property owner, had made
application for an amendment of the final plat of Shakopee Landing; and
WHEREAS, the subject property is legally described as:
That part of the Northeast Quarter of the Southwest Quarter of Section 8, Township 115, Range
22, Scott County, Minnesota, described as follows:
Beginning at the southwest comer of HAUER'S 4TH ADDITION, according to the recorded plat
thereof, Scott County, Minnesota; thence North 81 degrees 54 minutes 58 seconds East, assumed
basis for bearings, along the southerly line of said HAUER'S 4TH ADDITION, 394.00 feet;
thence South 0 degrees 25 minutes 22 seconds East 373.00 feet to the northerly line of
MINNESOTA DEPARTMENT OF TRANSPORTATION RIGHT OF WAY PLAT NO. 70-6,
according to the recorded plat thereof, Scott County, Minnesota; thence South 80 degrees 34
minutes 40 seconds West along said Northerly line thereof to the intersection with the West line
of said HAUER'S 4TH ADDITION, extended Southerly from the point of beginning; thence

North line of said MINNESOTA DEPARTMENT OF TRANSPORTATION RIGHT OF WAY
PLAT NO. 70-6 and lying South of the South line of HERITAGE PLACE 3RD ADDITION,
according to the recorded plat thereof, Scott County, Minnesota.
WHEREAS, the Planning Commission reviewed the preliminary plat on February 9,
2006, and recommended approval of the plat with conditions; and
WHEREAS, the City Council reviewed the proposed preliminary and final plat on
March 6, 2006; and
WHEREAS, the applicant has requested a change of the name of the final plat, which the
Council considered and approved on October 17,2006; and
WHEREAS, the Council considered the request for amendment of the final plat on
November 25, 2008.
NOW THEREFORE, BE IT RESOLVED by the City Council of the City of
Shakopee, Minnesota that the amendment of the final plat of Shakopee Landing is hereby
approved subject to the following conditions:
I. The following procedural actions must be completed prior to the recording of
the Final Plat:
A. Approval of title by the City Attorney.
B. Execution of a Developer's Agreement, which shall include provisions for
security for public improvements within the plat and the engineering review
fees, and any other fees as required by the City's adopted fee schedule.
1. Shakopee Public Utilities Commission shall be contacted if the
applicant wishes to contract with them for security lighting.
2. Electrical system to be installed in accordance with the requirements
of the Shakopee Public Utilities Commission.
3. Water system to be installed in accordance with the requirements of
the Shakopee Public Utilities Commission.
4. The developer shall be responsible for payment of Trunk Storm Water
Charges, Trunk Sanitary Sewer Charges, Trunk Storm Water Storage
and Treatment Charges, security for the public improvements,
engineering review fees, and other fees as required by the City's most
recent adopted Fee Schedule.
5. No public improvements shall be constructed until the City Engineer
and the Shakopee Public Utility Commission approve the Final
Construction Plans and Specifications.
6. The applicant shall obtain an NPDES permit prior to any land
disturbing activity. A copy of this permit shall be provided to the City.
The applicant shall adhere to all MPCA NPDES requirements.
7. Verify the exact location of the high-pressure natural gas transmission
pipeline prior to the removal of the tree on the northeast comer of the
property.
8. Verify the exact location of the transmission pipeline prior to the
installation of the storm sewer crossing the transmission pipeline on
the northwest corner.
C. Easements shall be shown on the Final Plat as approved by the City Engineer.
D. Shakopee Public Utilities Commission requires the dedication of a ten (10)
foot wide drainage and utility easement around the perimeter of the property
and on either side of and including the private drive.
E. Easements shall be shown on the Final Plat as approved by the City Engineer.
They shall include, but not be limited to, providing a minimum of ten (10) feet
of trail easement for the bituminous trail adjacent to the Vierling Drive right-
of-way.
F. The storm water management plan shall be approved by City Engineering.
G. The survey data (length and bearings) shall be shown for each lot.
H. Park dedication requirements shall be met through a cash contribution in an
amount in accordance with the adopted fee schedule in place at the time of
final plat approval. The required park dedication fees shall be paid at the time
of the recording of the final plat. If any portion of the property is being
platted as outlots to accommodate a phased development, the park dedication
fees for each future phase shall be based on the fees in effect at the time of
final plat approval for those outlots and shall be paid before the final plat for
those outlots is recorded.
1. The applicant shall install an eight (8) foot bituminous trail along the property
line adjacent to Vierling Drive right-of-way, with construction to be
coordinated by the City Engineering Department. The trail shall be located
outside the public right-of-way.
J. All trails shall be ADA compliant.
K. The applicant shall only install benches and/or tables in common green space
where the proximity of ponding areas and slopes do not constitute a safety
hazard.
L. The applicant provide enhanced screening for "private" patio areas to the rear
of all units via installation of fencing and/or use of vegetation.
M. Screening elements shall not be allowed within drainage and utility
easements.
N. The applicant shall obtain a grading permit prior to any additional land
disturbing activity.
O. The applicant shall comply with MnDOT's recommendations concerning
storm sewer drainage/outlets and permit requirements for any work within or
affecting their right-of-way.
P. The applicant shall obtain the necessary permission, right-of-way and/or
easements to perform all proposed work offsite or within existing easements.
Q. The applicant shall obtain both a right-of-way permit prior to work within the
City of Shakopee's right-of-way and a grading permit prior to any land
disturbing activity.
R. The applicant shall work with City of Shakopee staff to eliminate all proposed
retaining walls from within drainage and utility easements.
S. No final graded slopes in non-paved areas shall exceed three (3) feet
horizontal to one (1) foot vertical (3:1), nor shall they be less than two (2)
percent.
T. All proposed driveways, sanitary sewer and storm sewer shall be considered
private.
U. The applicant shall provide an outlet control structure for the proposed storm
water basin as per City of Shakopee requirements.
V. The applicant shall work with City of Shakopee staff to provide the most
desirable connection point to the existing storm sewer system.
W. The applicant shall work with City of Shakopee staff to eliminate all proposed
curb drain openings and replace with storm sewer structures.
x. The applicant shall provide an ultimate Emergency Overflow (EOF) for the
site's storm sewer system. The location and elevation shall be approved by
the City of Shakopee.
Y. The applicant shall work with City of Shakopee staff to realign the proposed
sanitary sewer for a more desirable angle of connection to the existing sanitary
sewer system.
Z. The proposed entrance shall be aligned directly across from Limestone Drive.
AA. The entrance to Vierling Drive shall be thirty-seven (37) feet wide (measured
from back of curb to back of curb). The proposed concrete curb and gutter
matching into the existing curb and gutter in Vierling Drive shall have radii
measuring twenty-five (25) feet. All curb and gutter within the right-of-way
shall be B618.
BB. The applicant shall install a cross-pan, if necessary, as per the most recent
edition ofthe City of Shakopee's General Specifications and Standard Detail
Plates for Street and Utility Construction.
II. Following approval and recording of the final plat, the following conditions shall
apply:
A. Building construction, sewer, water service, fire protection and access will be
reviewed for code compliance at the time of building permit application(s).
B. The developer and/or their assigns shall be responsible for any required or
desired noise or dust mitigation measures.
C. Shall provide electronic (AutoCAD) files of the Final Plat to the Engineering
Department.
D. The applicant shall meet the screening and landscaping ordinance
requirements of the City Code.
E. The applicant shall provide six (6) inches of topsoil below areas to be sodded.
The soil composition should be similar to the MnDOT topsoil borrow
requirements.
F. The applicant shall provide rain sensors for any irrigation system.
G. The applicant shall implement the use of Best Management Practices for
erosion control and stormwater management during construction.
H. The applicant shall utilize the MPCA Protecting Water Quality in Urban
Areas as a technical reference for erosion control.
I. Silt fence and/or tree protection fence is to be removed following
establishment of vegetation as determined by an inspection by City staff.

K. Relocate the northerly trash enclosure. Provide screening of any proposed
trash enclosure areas consistent with the City Requirements.
L. Install an eight foot high sound wall along the south property line, consistent
with the traffic noise assessment report.
M. The applicant must meet the City's Woodland and Tree Management
Ordinance requirements.
N. There shall be the placement of at least one overstory shade deciduous tree in
the front yard.
O. There shall be sod placement in front yards and seed or sod placed in side and
rear yards.
P. The applicant shall adhere to the NPDES Phase II permit requirements for
erosion control before, during, and after earth moving activities.
Q. The applicant shall plant a diversity of tree species along the boulevard to
reduce the impacts of potential tree diseases or epidemics that may occur in
the future. The applicant must plant different species adjacent to each other
along the boulevard and may not plant more than 15 trees of the same
species. Recommended tree species to utilize in this area are:
a. Hackberry (Celtis occidentalis)
b. Northern Catalpa (Catalpa speciosa)
c. Bur oak (Quercus macrocarpa)
d. White cedar (Thuja occidentalis)
e. Eastern white pine (Pinus strobes)
R. The private roadway shall be constructed to City standards.

AMENDMENT OF THE PRELIMINARY AND FINAL PLAT OF VIERLING ESTATES
1 st ADDITION
WHEREAS, Shakopee Development, LLC, applicant and property owner, has made
application for amendment of the preliminary and final plat approval of Vierling Estates 1st
Addition; and
WHEREAS, the subject property is legally described as:
That part of the Northwest Y-i of the Southeast Y-i of Section 8, Township 115, Range 22, Scott
County, Minnesota lying Southerly of Hauer' s 4th Addition and Northerly of Minnesota Department
of Transportation Right of Way Plat No. 70-7, and Easterly of the following described line:
commencing at the Southwest comer of said Hauer's 4th Addition; thence North 81 degrees 54
minutes 58 seconds East, assumed basis for bearings, along the Southerly line of said Hauer's 4th
Addition, 871.50 feet to the point of beginning of said line; thence South 0 degrees, 25 minutes 22
seconds East 362.61 feet to the Northerly line of said Minnesota Department of Transportation
Right of Way Plat No. 70-7 and there terminating.
WHEREAS, the Planning Commission reviewed the preliminary plat on June 8, 2006,
and recommended approval of the plat with conditions; and
WHEREAS, the City Council reviewed the proposed preliminary and final plat on June
20, 2006; and
WHEREAS, the Council considered the request for amendment of the preliminary and
final plat on November 25,2008.

C. Shakopee Public Utilities Commission requires the watermain be looped with
two connections to existing watermain in Vierling Drive, one at either end of
the site.
D. Shakopee Public Utilities Commission plans to install two main line
underground electric feeders within the 10 foot drainage and utility easement
along the south property line of this property and adjoining properties.
E. Easements shall be shown on the Preliminary Plat and the Pinal Plat as
approved by the City Engineer. They shall include, but not be limited to, the
following:
. Provide a minimum of twelve (12) feet of trail easement for the
bituminous trail being constructed as part of this project.
. Provide a minimum of ten (10) feet of drainage and utility easement
between Lots II and 12 of Block I.
. Provide a minimum of ten (10) feet of drainage and utility easement
between Lots 18 and 19 of Block 1.
. Provide a minimum of ten (10) feet of drainage and utility easement
between Lots 21 and 22 of Block I.
. Provide a minimum of ten (10) feet of drainage and utility easement
between Lots 25 and 26 of Block 1.
. Provide a minimum of ten (10) feet of drainage and utility easement
between Lots 31 and 32 of Block 1.
. Provide a minimum of ten (10) feet of drainage and utility easement
between Lots 34 and 35 of Block 1.
. Provide adequate drainage and utility easements at the top and bottom of
all proposed retaining walls.
F. The storm water management plan shall be approved by City Engineering.
G. The applicantshall meet park dedication requirements by providing cash in
lieu of land dedication. Park dedication fees in the amount required by the
City Code and adopted City fee schedule shall be paid prior to the recording
of the final plat. If any portion of the property is being platted as outlots to
accommodate a phased development, the park dedication fees for each future
phase shall be based on the fees in effect at the time of final plat approval for
those outlots and shall be paid before the final plat for those outlots is
recorded.
H. The applicantshall construct an eight (8) foot wide bituminous trail along the
property line adjacent to Vierling Drive along the edge of the public right-of-
way, where possible, with construction to be coordinated by the City
Engineering Department.
I. All trails shall be ADA compliant.
1. The applicant shall provide and install trail boundary signage as determined to
be needed by the city along the trail.
K. The applicant shall obtain a grading permit prior to any additional land
disturbing activity.
L. The applicant shall comply with MnDOT's recommendations concerning
storm sewer drainage/outlets and permit requirements for any work within or
affecting their right-of-way. The applicant shall obtain the necessary MnDOT
approvals for the proposed emergency overflow directed to their right-of-way.
The applicant shall be financially responsible for all MnDOT approvals.
M. The applicant shall obtain the necessary permission, right-of-way and/or
easements to perform all proposed work offsite or within existing easements.
N. The applicant shall obtain a right-of-way permit prior to work within the City
of Shako pee's right-of-way.
O. The applicant shall obtain the appropriate Wetland Conservation Act (WCA)
permits and approvals prior to issuance of a grading permit.
P. The applicant shall work with City of Shakopee staff to eliminate all proposed
retaining walls from within drainage and utility easements.
Q. No final graded slopes in non-paved areas shall exceed three (3) feet
horizontal to one (1) foot vertical (3:1), nor shall they be less than two (2)
percent.
R. All proposed driveways, sanitary sewer and storm sewer shall be considered
private.
S. The applicant shall provide an outlet control structure for the proposed storm
water basin as per City of Shakopee requirements.
T. The applicant shall provide an ultimate Emergency Overflow (EOF) for the
site's storm sewer system. The location and elevation shall be approved by
the City of Shako pee. The City of Shako pee's engineering department shall
inspect these private improvements and the developer shall pay all
administrative, plan review and inspection costs as though the improvements
were public.
U. The applicant shall adjust all elevations to comply with freeboard
requirements set forth by the City of Shakopee as they relate to the approved
High Water Level (HWL) of the existing storm water basin/wetland.
V. The applicant shall eliminate all proposed impacts to the existing storm water
basin/wetland.
W. The applicant shall work with City of Shakopee staff to mitigate impacts to
the existing storm water basin adjacent to Vierling Drive.
X. The applicant shall work with City of Shakopee staff to provide additional
water quality treatment volume in the existing storm water basin adjacent to
Vierling Drive.
Y. The applicant shall eliminate all retaining walls and their associated
foundation from below the approved High Water Level (HWL). Proposed lots
may be eliminated to accommodate.
Z. The minimum allowable storm sewer pipe diameter shall be twelve (12)
inches.
AA. The proposed private driveway within the site shall be a minimum of twenty-
eight (28) feet wide (measured from back of curb to back of curb).
BB. The proposed private driveway, private sanitary sewer and private storm
sewer within the site shall be designed to standards approved by the City of
Shakopee.
CC. The applicant shall work with City of Shakopee staff to move the proposed
sanitary sewer to the centerline of all driveways.
DD. The applicant shall work with City of Shakopee staff to provide nine (9) feet
of cover over all proposed sanitary sewer.
EE. The entrance to Vierling Drive shall be thirty-seven (37) feet wide (measured
from back of curb to back of curb). The proposed concrete curb and gutter
matching into the existing curb and gutter in Vierling Drive shall have radii
measuring twenty-five (25) feet. All curb and gutter within the right-of-way
shall be B618.
III. Following approval and recording of the final plat, the following conditions

H. The applicant shall implement the use of Best Management Practices for

O. There should be ADA compliant curb cuts (with truncated dome panels) at all
trail and sidewalk connections and crossings.
P. The entire trail width should not be impacted by utility structures.
Q. The tree planting detail should note that "wood mulch should be kept 4" from
the base of the trunk." This reduces potential girdling of the tree due to rodent
damage.
R. The applicant shall design the storm pond to provide a natural appearing
shoreline with an irregular edge with points and bays. The applicant shall
provide more rounded slopes for the proposed storm water basin.
S. The applicant shall meet the requirements of the Noise Assessment Report or
staff conditions regarding the height of the sound wall, whichever is
applicable.
T. The proposed trail alignment along Vierling Drive is over existing light poles
and utility boxes.
U. The proposed storm pond and disturbed existing storm pond be seeded with a
native wetland seed mixture and erosion control blanket be placed four feet
either side of the normal water level and around outlets to prevent erosion and
sediment deposits into the wetland mitigation sites and enhancement areas.
V. The proposed location of the silt fence around the existing stormwater pond
shall be located above NWL.
W. The proposed sound wall location on the grading plan does not match the
proposed sound wall location on the landscape plan. This shall be corrected
and approved by the city, as this discrepancy effects the locations of the
proposed trees.
X. The landscape plan proposes to re-establish native v~getation in the existing
storm pond and proposed storm pond from the emergent zone to the top of
pond. Indicate seed mixtures information on this plan as it corresponds to the
SWPPP.
Y. Do not plant trees or shrubs in drainage and utility easements.
Z. Plant trees and shrubs a minimum of 5 feet from property lines.
AA. The applicant shall plant a diversity of tree species to reduce the impacts of
potential tree diseases or epidemics that may occur in the future. The
applicant must plant different species adjacent to each other and may not plant
more than 15 trees of the same species. Recommended tree species to utilize
in this area are:

BB. Provide 18 parking spaces along the main road and cul-de-sac, as identified in
