No. 6839 ~. it, CITY OF SHAKOPEE Memorandum TO: Mayor & City Council Mark McNeill, City Administrator FROM: Bruce Loney, Public Works Director SUBJECT: Assessment Hearing for the Beckrich Park Estates and Kristal Estates Extension of Sanitary Sewer and Water, Project No. 2007-10 DATE: November18,2008 INTRODUCTION: Attached is Resolution No. 6839, a resolution which adopts the assessment for the above referenced project. BACKGROUND: This project has essentially been completed and all project costs identified. The final project cost is $1,117,797.52, which consists of construction costs, trunk utility charges, financing costs and engineering/administration costs. A breakdown of the project costs are as follows: Description Amount Beckrich Assessment Cost $ 914,978.08 Kristal Estates Assessment Cost $ 96,215.84 City Cost(Trunk Sanitary Sewer) $ 14,818.75 City Cost (Trunk Storm Sewer) $ 13,411.92 SPUC (Trunk Water) $ 37,561.89 City Cost (Tax Levy) $ 40.811.04 TOTAL PROJECT COSTS $1,117,797.52 For this project, 100% of the lateral benefit of sanitary sewer and water extension were assessed. Oversizing costs for trunk sewer and trunk water were paid by City and SPUC funds. Reconstruction of Hampton Circle was assessed at 30%, as per City Policy, with the remaining 70% paid by general tax levy. Repairs to an existing storm water channel were paid out of drainage funds. In addition to the lateral sewer and water extension, the City agreed to assess the trunk sanitary sewer charges as well as trunk water and water connections charges from SPUC. Beckrich Park Estates area was assessed on a per unit basis and the rate per lot is $26,911.12. Kristal Estates is a parcel that has received preliminary and final plat approval and it's assessment rate is $96,215.84. A presentation of the final costs and assessments will be made at the Council meeting. AL TERNA TIVES: 1. Adopt Resolution No. 6839. 2. Deny Resolution No. 6839. 3. Table Resolution No. 6839 for specific reasons. RECOMMENDATION: Staff recommends Alternative No.1, as the assessment amount is less than the amount in the waiver signed by the residents and developer of Kristal Estates. ACTION REQUESTED: Offer Resolution No. 6839, A Resolution Adopting Assessments for the Beckrich Park Estates and Kristal Estates Addition Sanitary Sewer and Water Improvements, Project No. 2007-10 and move it adoption. ~~ Public Works Director BUpmp ENGRl2007-PROlECTSIBECKRICH-PARK/WORDIMEM6839-ADOOPT-ASSESSMENTS RESOLUTION NO. 6839 A Resolution Adopting Assessments For Beckrich Park Estates And Kristal Estates Addition Sanitary Sewer And Water Improvements Project No. 2007-10 WHEREAS, pursuant to proper notice duly given as required by law, the City Council of the City of Shako pee met and heard and passed upon all objections to the proposed assessments of: Beckrich Park Estates and Kristal Estates Addition Sanitary Sewer and Water Improvements NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SHAKOPEE, MINNESOTA: 1. That such proposed assessment together with any amendments thereof, a copy of which is attached hereto and made a part hereof, is hereby accepted and shall constitute the special assessment against the lands named herein and each tract therein included is hereby found to be benefitted by the proposed improvements in the amount of the assessments levied against it. 2. Such assessments shall be payable over a period of ten years, the first installment to be payable on or before the ftrst Monday in January, 2009, and shall bear interest at the rate of 5.25 percent per annum from the date of the adoption of this assessment resolution. To the :first installment shall be added the interest on the entire assessment from the date of this resolution until December 31, 2009. 3. The owner of any property so assessed may, at any time prior to certification of the assessment to the County Auditor, pay the whole of the assessment on such property, with interest accrued to the date of payment, to the City Treasurer, except that no interest shall be charged if the entire assessment is paid within thirty (30) days from the adoption of this resolution; the owner may thereafter pay to the County Treasurer the installment and interest in process of collection on the current tax list, and may pay the remaining principal balance of the assessment to the City Treasurer. 4. The Clerk shall file the assessment rolls pertaining to this assessment in her office and shall certify annually to the County Auditor on or before November 30th of each year the total amount of installments and interest on assessments on each parcel of land which are to become due in the following year.
