Introduction This item is to request City Council's acceptance of the development of a neighborhood park by College City Homes. Backaround The Glacier Estates final plat included the following conditions to be completed prior to recording the final plat: . The applicant shall meet park dedication requirements by providing a total of .99 acres as an outlot shown on the final plat . The remaining park dedication requirements shall be met by providing a cash contribution in the amount of $112,349. The applicant shall provide security to the city in the full amount of the required cash contribution prior to recording the final plat. . The wetland complex shall be provided to the city as an outlot and incorporated into the city's park and open space system. . Trail easements shall be provided for trail segments on Lot 10 and 11, Block 4; Lots 17, 18, and 19, Block 2; and Lots 11 and 12, Block 2. The Glacier Estates final plat included the following conditions to be completed following the approval and recording of the final plat: . The applicant shall work with staff to design and construct the park as part of the construction of the development. Construction costs shall be credited toward the applicant's cash contribution requirement. . Sidewalk and trails shall be constructed as proposed in Block 2 and 4. . The applicant shall install park, open space, and trail boundary signage as determined to be needed by the city. The city shall provide the signage, and the applicant shall provide the posts and installation of the signage. . The applicant shall continue to work with the City and Scott County to determine a trail connection to the Riverside Fields trail, and design/develop the trail segment. . The applicant shall provide a trail connection from the park area to Portage Lane, at a location approved by the city. . In the park area, the developer shall: 0 Fine grade the site, picking rocks and dirt clumps %" and greater in size 0 Provide a finished grade that is approved by the city as suitable for park use. 0 Ensure a minimum of 6" of topsoil. 0 Apply a grass seed mixture "Pro Turf Lawn Mix" at a rate of 60 pounds per acre that meets the following criteria: Item %of Minimum Purity Mix Germination Alene Kentucky 30 90 95 Bluearass Denim Kentucky 30 90 95 Bluearass Secretariat 20 90 99 Perennial Rye Mardigras 20 90 99 Perennial Rye The park land dedicated is .99 acres, which includes an active use area and a wooded area. The trail connection from the Riverside Fields trail has been completed. The remaining park dedication requirements will be met through cash contribution as follows: Park Dedication Cash Contribution Calculation The preliminary plat conditions require that the applicant meet park dedication requirements through a combination of land and cash. The total park dedication value, calculated at time of final plat approval, totaled $226,968 or 1.96 acres. As stated in the Resolution No 6312, land was dedicated on the plat (.99 acres) and the cash dedication required was $112,349.00. The cash contribution was calculated for the entire development as follows: Park dedication cash contribution shall be: Cash Contribution: 49 Lots X $4,632/lot $226,968 Land Contribution: 49 Lots X 3 persons per lot/75 people/acre = 1.96 acres Credit: 0.99 acres of land dedicated/1 .96 acres reauired = 50.5% of dedication met Cash Contribution Due: 49.5% of dedication remaining X $226,968 =$112,349 A letter of credit in the amount of $112,349.00 has been held by the City for the park construction. The developer is also required to submit a two-year maintenance bond to the City for maintenance of the improvement to the Glacier Neighborhood park, as per Division 1 of the Supplementary Special Provisions of the project specifications S.G.R. 01740 which states that the CONTRACTOR for this work shall guarantee and maintain the stability of all his work, equipment and materials for a period of two (2) years from the date of final payment. Due to the financial market the contractor is unable to provide the City with a two -year maintenance bond. If a maintenance bond cannot be provided to the City, the City can draw the funds from the letter of credit for the required cost of the maintenance bond. The City will therefore draw $25,000 from the contractor's letter of credit to cover the maintenance bond. The Contractor has documented that they will maintain and warrant the park improvements for the warranty period per the City guidelines (Attachment A). The park Glacier Neighborhood Park is complete. The final cost breakdown for the park development is described below: Letter of Credit $112,349.00 Developer's Responsibilities Includes concrete, seeding, erosion control subs ($56,552.48) Playground Equipment -installed (Flanagan Sales ) ($26,000.00) Site furnishings (S1. Croix Recreation) ($5,578.47) Engineering & Surveying (5% total project Improvements ($5,352.86) Landscaping (God's Country) ($11,026.24) Liohtino Connection (Cedarview Electric) ($7.900.00) Total Park Construction Costs ($ 112,410.05) Remaining Park Dedication Payable to City 0.00 The developer has met the cash contribution for park improvements and land dedication. The City will draw $25,000 from the letter of credit as the maintenance bond. This has satisfied the total park dedication amount of $112,349.00 and the letter of credit under the development agreement can be released minus $25,000 to the developer. Visionina Relationship B. RESOLUTION NO. 6831 A Resolution Accepting the Construction of Glacier Neighborhood Park Improvements, Project PR 2007-1 in the Glacier Estates Development and Authorizing the Release of the letter of credit Whereas, pursuant to park dedication requirements for the Glacier Estates Development, College City Homes has satisfactorily completed the Glacier Neighborhood Park pursuant to the requirements of Resolution No. 6312, A Resolution of the City of Shakopee, Minnesota Approving the Final Plat of Glacier Estates. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SHAKOPEE, MINNESOTA that the work completed for the development of the park in Glacier Estates Development and guaranteed under the letter of credit in the amount of $112,349.00, under the development agreement is hereby accepted and approved; and BE IT FURTHER RESOLVED, that the City Clerk is hereby authorized to release and return the letter of credit minus $25,000 under the development agreement and retain the $25,000 in lieu of the two year warranty bond from the developer for the improvements. In lieu of this bond we have agreed that the City will maintain our letter 'o.f Credit #448 with Mainstreet Bank at 'On amo~nt of $25,000 for the warrantY- perio~. .
