Cox, City Clerk SUBJECT: Temporary Liquor License - Fraternal Order of Eagles #4120 DATE: October 14,2008 INTRODUCTION: The City Council is asked to consider an application from The Fraternal Order of Eagles #4120 (Eagles Club) for a temporary on-sale intoxicating liquor license for November 1,2008 for their annual Volunteer Appreciation Day. BACKGROUND: The Eagles Club holds an on sale club liquor license which includes a small fenced in area for outside dining and drinking. For the Volunteer Appreciation Day, the Eagles Club plan to putup an enclosed tent adjacent to the fenced in area to accommodate additional participates and would like to serve alcohol in this additional space. Entrance to the tent will be through the Eagles Club and through the already licensed fenced in area. Captain Tate has advised that the Police Department has no issue with the request. Because the Eagles Club is a nonprofit organization and because they are sponsoring this event, they are eligible to apply for a temporary license for this additional space. A Conditional Use Permit was granted when the outside dining was originally approved. This CUP allows the outside consumption of alcohol until 11 :00 p.m. only. The Eagles Club has been reminded of this time restriction and is fine with it. I have been advised that the Eagles Club has amended their liquor liability insurance to include the additional outside dining area for this event. Make community welcoming RECOMMENDED ACTION: Move to approve the application and grant a temporary on-sale liquor license to the Fraternal Order of Eagles #4120, 220 2nd Avenue West, for November 1,2008, conditioned upon meeting all licensing requirements.
