Cox, City Clerk SUBJECT: Setting Date for Alcohol Violation Hearing DATE: September 11, 2008 INTRODUCTION: City Council is asked to set a date to review the actions of a certain alcohol licensee. BACKGROUND: The City Code prohibits any person to sell, barter, furnish, or give alcoholic beverages to a minor unless such person is the parent or guardian of the minor, and then only for consumption in the household of such parent or guardian. Licensees are subject to a fine that may be imposed by the City or by the State of up to $2,000 and revocation or suspension ofthe license of up to 60 days. Staff is ready to proceed with the setting of a hearing date to consider an alcohol violation that occurred during the alcohol sales compliance check on November 9, 2007. This is the first violation for the Great Lakes Inc., dba Shakopee Ballroom, 2400 East 4th Avenue, within a three-year period. Under the current ordinance, adopted by City Council on July 2, 2002, the penalties for a first or second incident shall be imposed and administered by the City Administrator upon an admission by the licensee that the licensee furnished or sold an alcoholic beverage to a minor. Any licensee with a first or second violation within a three-year period who admits to the violation and does not ask for a hearing will not need to appear before City Council. RECOMMENDED ACTION: Set a hearing for Tuesday, October 21,2008, at 7:00 p.m., or thereafter, to review the actions of Great Lakes mc., dba Shakopee Ballroom, 2400 East 4th Avenue. I:LiquorWiolations RESOLUTION NO. 6811 A RESOLUTION OF THE CITY OF SHAKOPEE, MINNESOTA APPROVING AN APPLICATION FROM THE SHAKOPEE LIONS CLUB TO CONDUCT OFF-SITE GAMBLING WHEREAS, the 1990 legislature adopted a law which requires municipal approval in order for the Gambling Control Board to issue or renew premises permits and issue off-site gambling permits; and WHEREAS, the Shakopee Lions Club is seeking permission to conduct off-site gambling on September 27,2008 as a fund raiser during the Shakopee Fire Department's 125th Anniversary celebration, at the Shakopee Fire Station, 2700 Vierling Drive East, Shakopee, Minnesota. NOW, THEREFORE, BE IT RESOLVED BY" THE CITY COUNCIL OF THE CITY OF SHAKOPEE, MINNESOTA, that the application from the Shakopee Lions Club to conduct off- site gambling at the Shakopee Fire Station, 2700 Vierling Drive East, Shakopee, Minnesota, is hereby approved.
