O'Brien Contracting, LLC on the Huber Park Shelter Construction and Authorizing Final Payment, Res. No. 7583 (A) Action Sought If Council concurs, offer Resolution No. 7583, A Resolution Accepting the Work of R.W. O'Brien Contracting, LLC and Authorizing Final Payment. Background/Discussion In 2012 the City received an intergovernmental grant of$150,000 from the Shakopee Mdewakanton Sioux Community. The City Council chose to utilize the grant for the construction of an open air shelter at Huber Park that could be rented in conjunction with the amphitheater. The City Council awarded the contract for the construction of the Huber Park open air shelter to R.W. O'Brien Contracting, LLC on September 2, 2014. R.W. O'Brien Contracting, LLC. was responsible for the construction elements including carpentry and masonry. The City's Parks Division completed the site work, painting and contracted the electrical work. The project completion date was May 25, 2015. The contract portion of the project was completed as scheduled. The total project costs are as follows: •Construction Contract: $99,410.00 •Electrical/plumbing: $4,998.50 • Sod: $3,200.00 •Picnic Tables: $949.38 • Surveying: $1,535.50 •Public Works Wages: $10,948.00 •Total Project Costs: $121,041.38* *The only item left to complete on the shelter is painting the gable ends and steel columns, adding a minimal amount to the total cost for staff time to paint and painting supplies. Budget Impact and Transfer By aggressively managing the contract, we were able to have no change order costs and complete the project on time and within the grant amount. When the grant was originally received in 2012 the use was unknown and the grant was placed in the Capital Improvement Fund. On July 15, 2014 the City Council authorized the use of the grant for the Huber Park Shelter. All fees to date for the shelter have been paid from the Park Reserve Fund. The City Council is asked to authorize the transfer of the $150,000 grant from the CIF fund to the Park Reserve Fund. The remaining grant dollars not used on the Huber Park shelter will then remain in the Park Reserve Fund. Relationship to Vision A. Keep Shakopee a safe and healthy community where residents can pursue active and quality lifestyles. Requested Action If Council concurs, 1. Offer resolution No. 7583, A Resolution Accepting the Work of R.W. O'Brien Contracting, LLC and Authorizing Final Payment. 2.Authorize the transfer of$150,000 from the Capital Improvement Fund to the Park Reserve Fund. FOR THE CONSTRUCTION OF THE HUBER PARK SHELTER AND AUTHORIZING FINAL PAYMENT WHEREAS, pursuant to a written agreement, signed with the City of Shakopee, R.W. O'Brien Contracting, LLC has satisfactorily completed the construction of the Huber Park Shelter in accordance with such agreement. NOW, THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SHAKOPEE, MINNESOTA that the work completed under said agreement is hereby accepted and approved; and BE IT FURTHER RESOLVED, that the City Finance Director and Mayor are hereby directed to issue a proper order for the final payment on such agreement in the amount of $39,165.75, taking the contractor's receipt in full; and Adopted in session of the City Council of the City of Shakopee, Minnesota, held this 16th day of June, 2015.
