Action Sought
The Council is asked to offer a motion approving a suspension of City Code Sec.
10.60, Noise Elimination and Noise Prevention, Subd. 3, Hourly Restrictions on
Certain Operations, D, beginning July 6, 2015 and continuing until the County's
overlay project on CSAH 17 is completed, and directing staff to publish notice of
the suspension terms with the conditions as recommended by staff
Background
At the June 2 Council meeting, overnight construction work on Marschall Road was
approved beginning July 20. However, Scott County and Knife River Corporation -
North Central, the contractor for the County's 2015 Overlay Project, have now
requested that start date be moved up to July 6 instead due to a change in the
contractor's schedule.
The requests pertains to City Code Sec. 10.60, Noise Elimination and Noise
Prevention, Subd. 3, Hourly Restrictions on Certain Operations, which restricts
construction hours to 7:00 a.m. to 10:00 p.m. on weekdays and 9:00 a.m. to 9:00
p.m. on weekends and holidays.
As with the previous request, the County is asking now requesting that work be
allowed between the hours of 9:00 p.m. and 6:00 a.m. beginning the week of July 6,
2015 until the project is completed. Although the project should only take
approximately five (5) to seven (7) working days, the proposed start date is
tentative and could change based on weather and previously scheduled projects.
Concrete work and restoration will take place during regular working hours with
temporary lane restrictions during off-peak hours.
The project scope includes CSAH 17 (Marschall Rd) from 10th Avenue to CSAH
101 (1st Ave.). This request is being made to help expedite the work and avoid
traffic impacts on CSAH 17 during the morning and evening rush hours.
Staff would recommend that if the suspension of hours is granted, that the approval
be subject to the following conditions:
1. Approval is contingent upon minimizing noise exposure.
2. If noise complaints are received by the City, the suspension can be revoked at
the discretion of the City Engineer.
If Council approves the suspension, a public notice to meet the City Code
requirements and notice such as a news release would be submitted to the Shakopee
Valley News.
Recommendation
Staff recommends approving the suspension of City Code Sec. 10.60, Noise
Elimination and Noise Prevention, Subd. 3, Hourly Restrictions on Certain
Operations, per this memo, and direct staff to publish notice of the suspension terms
with the conditions as recommended by staff

Re: Request for Extended Working Hours
Scott County 2015 Overlay Project
Dear Mr. Loney:
Scott County has contracted with Knife River Corporation to complete the Overlay projects this year. Mill
and overlay projects are not temperature dependent so can be performed at any time during the day or night.
One of the roads we are overlaying is CSAH 17 from 10th Avenue to CSAH 101 in the City of Shakopee. This
road has considerable traffic during the day and active construction during the daytime hours would add to the
congestion and cause delays to travelers.
To minimize disruption to the daytime traffic, Scott County is proposing working hours of 9:00 p.m. to 6:00
a.m. tentatively starting the week of July 6, 2015, weather permitting. The project is expected to take
approximately five (5) working clays.
Scott County respectfully requests that the City of Shakopee standard working hours be extended during the
Overlay Project to include the hours of 9:00 p.m. to 6:00 a.m. for this specific project only.
