TO: Mayor & City Council Mark McNeill, City Administrator FROM: Bruce Loney, Public Works Director SUBJECT: ApJ'roval of County Road 83 Reconstruction, from 17 AvenuetoCSAH42 DATE: July 15,2008 INTRODUCTION: This memorandum is intended to request approval from the City Council of Shakopee on movin~ forward with an agreement with Scott County on the reconstruction of C.R. 83, from 17 A venue to CSAH 42. BACKGROUND: City staff did update City Council at the July 1, 2008 workshop on the possibility of reconstructing C.R. 83 in 2009, with the Shakopee Mdewakanton Sioux Community (SMSC) contributing approximately $4.5 million dollars towards the project. Discussions that have occurred, so far, is that the Cities of Prior Lake and Shakopee would have an agreement with Scott County to the cost share that would be required for the project, and Scott County would have an agreement with the SMSC for the project. The reconstruction of C.R. 83 would result in a four-lane divided urban roadway with sidewalk and trails and improved drainage along the CR. 83 corridor. Per Lezlie Vermillion, Scott County Public Works Director, the general agreement structure would be that the City of Shakopee would pay approximately $290,000 for construction only, and would not have to pay this amount back until the year 2015. This project cost amount would be interest free and there would be no engineering or right-of-way costs associated with this cost participation amount. The estimated total project cost is at $8.1 million dollars and the SMSC's share has been mentioned at $4.5 million. With SMSC's contribution, the City's cost can then be lowered by that percentage and at no interest, engineering or right-of-way costs. If the County were to do the project in 2015, the City's share would be $640,000 in construction plus 20% engineering costs. Staff feels that the future reconstruction of C.R. 83, at the participating levels that are being suggested, is a reasonable amount and a good value for the City of Shakopee. The City of Shakopee will be obtaining additional State Aid Funds, due to the gas tax increase that occurred earlier this year and can use these funds to pay our share. . Scott County is requesting approval of moving forward with the reconstruction of C.R. 83 from the City of Shakopee, or not, in order to determine what is the overlay that would occur this summer. If a reconstruction project is to move forward by both the City of Shakopee and Prior Lake, a minimal I-inch to 1 ~- inch overlay will be done yet this summer. If the parties cannot come to an agreement on a reconstruction of C.R. 83, then a 4-inch mill and overlay would be done and paid for by the SMSC. ALTERNATIVES: 1. Approve a motion that the City of Shakopee is interested in moving forward in the reconstruction of c.R. 83 at the cost sharing levels that have been quoted, with no interest and no engineering costs, and this amount would be paid back in 2015. 2. Do not approve a motion for the City of Shakopee to move forward on the C.R. 83 reconstruction project. 3. Table for additional information. RECOMMENDATION: Staff believes that the cost sharing arrangement by Scott County and the SMSC is a very fair and equitable apportionment for the City. The benefits from this project to the City of Shakopee would be an improved roadway with turn lanes, trails, sidewalk for pedestrian and bicycle movements and improved drainage in the area east of C.R. 83. A traffic control signal could also be an improvement at Valley View Road and C.R. 83, if warrants are met and could be included in the project. If a signal is added, the City of Shakopee's share would increase per County's Cost Participation Policy. ACTION REOUESTED: Approve a motion that the City of Shakopee is interested in moving forward in the reconstruction of C.R. 83 at the cost sharing levels that have been quoted, with no interest and no engineering costs, and this amount would be paid back in 2015. ~Jwi Bruce Loney, P. .
