Steve Soltau Request for Minor Subdivision Approval i$I S. fi.l., CITY OF SHAKOPEE Memorandum CONSr:t*~T CASE NO.: 08-037 ~hj' TO: Mayor and City Council Mark McNeill, City Administrator FROM: Mark Noble, Planner II SUBJECT: Minor Subdivision - Southbridge Crossings MEETING DATE: July 15, 2008 REVIEW PERIOD: June 4 - October 1, 2008 DISCUSSION Steven Soltau, Shakopee Crossings Limited Partnership, has submitted an application for Minor Subdivision of property located in Southbridge Crossings (north of Old Carriage Road, east of Old Carriage Court North, and west of County Road 18). The intent is to subdivide the parcel (approximately 10 acres) that presently includes the Best Buy building into two parcels, for future development opportunities. Typically, city staff review and approve Minor Subdivisions administratively, however, Section 12.05, Subdivision 2 of the City Code (Subdivision Regulations) states that when the minor subdivision proposes the division of property zoned for commercial, industrial, business park or major recreation use, the Planner may not approve the minor subdivision; rather, the City Council must act on the minor subdivision application. In this particular case, the property is zoned B-1, Highway Business Zone; therefore, the Council is asked to act on the request. RECOMMENDATION Staff recommends approval of this minor subdivision, subject to compliance with the following conditions: 1. A special assessment fee of $883.17 shall be paid prior to the County recording of this minor subdivision. 2. The City shall retain all existing drainage and utility easements. 3. The applicant shall provide electronic (Auto CAD) files of the property line adjustment to the Engineering department. 4. Municipal water service is available subject to Shako pee Public Utilities (SPUC) standard terms and conditions. These include but are not limited to: installing a lateral water main distribution system in accordance with utility policy, paying the associated inspections costs, paying the Trunk Water Charge, and paying the Water Connection Charge. There is an existing 8-inch watermain stub located at the northeast property corner of parcel A that must be extended south and west across parcel A to connect to an existing 8-inch watermain located at parcel A 's south (parcel B's north) property line. This extension shall occur prior to or at time of building construction on this parcel. 5. Underground electric service is available subject to SPUC standard terms and conditions. These include, but are not limited to: entering into an Underground Distribution Agreement, granting any necessary easements, and paying the associated fees. 6. Street lighting installation is avai.fable subject to SPUC standard terms and conditions. These are contained in the current City of Shakopee Street Lighting Policy. Applicant must pay the associated fees. 7. The applicant must contact SPUC directly for specific requirements relating to their project. Approve the Minor Subdivision for property located in Southbridge Crossings, subject to the conditions presented. 2. Approve the Minor Subdivision for property located in Southbridge Crossings, subject to revised conditions. 3. Do not approve the Minor Subdivision and direct staff to prepare a letter of denial consistent with the direction of the Council. 4. Table the matter and request additional information from staff and/or the applicant.
