SUBJECT: Wetland Replacement Plan for Dean Lakes

INTRODUCTION:
Ryan Companies US, Inc. has submitted a complete Wetland Replacement Plan application.
Staff along with a Technical Evaluation Panel (TEP) has reviewed the application and
determined the requirements of the Wetland Conservation Act (WCA) have been met by this
plan. The replacement plan must be acted upon by the City Council in their roll as the Local
Governing Unit (LGU) for the WCA of 1991. Attached for Council consideration is Resolution
No. 6006, a resolution approving the Wetland Replacement Plan for Dean Lakes,
BACKGROUND:
The Wetland Replacement Plan, as proposed by Ryan Companies US, Inc., would fill
approximately 0.33 acres of wetland. The impacted wetland is proposed to be replaced by
constructing approximately 0.33 acres of new (replacement) wetland and the establishment of
2.60 acres of wetland buffers and vegetation management areas. The total of 2.98 acres of
wetland mitigation exceed the 2 to 1 replacement ratio required by the WCA.
The City requested a site visit and review of the plan by the TEP, which consisted of myself, Pete
Beckius from the Scott Soil and Water Conservation District (SWCD) and Lynda Peterson and
Tom Mings from the Board of Soil and Water Resources (BWSR). The TEP, established by the
WCA, provides professional, technical review of wetland issues to the LGD. The TEP has
reviewed the site and the replacement plan and is recommending approval of the plan as
submitted on December 22, 2003. Please see the attached memo from the SWCD recommending
approval.
At its January 14, 2004 meeting, the Environmental Advisory Committee (EAC) reviewed and
acknowledged Ryan Companies US, Inc. submitted all information requested during the
Preliminary Plat approval process by submitting a wetland replacement plan prior to Final Plat
approval. Please see the attached memo from Mark McQuillan, Natural Resource Director.
The Wetland Replacement Plan is being proposed to accommodate residential development and
utility construction that would impact the wetlands directly. The alignment of the proposed
streets and lot configurations was designed so as to minimize the amount of wetland impacted.
ALTERNATIVES:
1. Adopt Resolution No. 6006.
2. Deny Resolution No, 6006.
3. Table for additional information from staff.
RECOMMENDATION:
Staff recommends Alternative No.1.
ACTION REQUESTED:
Offer Resolution No. 6006, a Resolution Approving a Wetland Replacement Plan for Ryan
Companies US, Inc. and move its adoption. 0~~

A Resolution Approving A Wetland Replacement Plan
For Dean Lakes
WHEREAS, the City has received a Wetland Replacement Plan from Ryan
Companies US, Inc. for the proposed Dean Lakes plat; and
WHEREAS, the applicant has demonstrated that the proposed Wetland
Replacement Plan complies with Minn. Rules Parts 8420.0540 and 8420,0550; and
WHEREAS, all interested parties on file in the office of the City Engineer or
identified in Minn. Rule 8420.0230 have been mailed notice of the proposed Wetland
Replacement Plan; and
WHEREAS, the Technical Evaluation Panel reviewed the proposed Replacement
Plan and considered the public values, location, size and type of wetland being altered
and recommended approval of the Wetland Replacement Plan.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF SHAKOPEE, MINNESOTA:
1. Based on the replacement standards in Minn. Rules Parts 8420.0630, and
on the recommendation of the Technical Evaluation Panel, the Wetland
Replacement plan is hereby approved.
2. Approval of the Wetland Replacement Plan shall become effective upon
its adoption.
3. A copy of this decision shall be mailed to all interested parties and to the
applicant.
Adopted in session of the City Council of the City of Shakopee,
Minnesota, held this day of ,2004.

Re: Review of Wetland Delineation Report and Wetland Replacement Plan for the Proposed Dean Lake
Development
The Technical Evaluation Panel (TEP) for the Wetland Conservation Act met on December 17, 2003 to discuss the
wetland delineation report and review a draft wetland replacement plan application for the proposed Dean Lake
Development. The project is located in the SW 1/4 of Section 10, Township 115, Range 22, City of Shako pee, Scott Co.
MN. Members of the TEP present were Joe Swenteck, City of Shako pee (LGU), Tom Mings, Board of Water and Soil
Resources and Peter Beckius, Scott Soil and Water Conservation District. The LGU will be submitting a TEP report to
summarize the discussions at the meeting.
The Scott Soil and Water Conservation District was requested to submit written documentation on our review of the
wetland delineation report and wetland replacement plan application once [mal documents became available, On
December 22, 2003 we received [mal documents for the wetland delineation and wetland replacement plan. The wetland
delineation report was completed by STS Consultants, LTD in consultation with RLK Kuusisto. The wetland replacement
plan was completed by STS Consultants, LTD. The following comments are submitted for your consideration:
. We concur with the identification and delineation of all wetlands found on the above-described parcel of land.
. We reviewed the wetland replacement plan application to detennine if it was complete and compliant with Wetland
Conservation Act rules. Enclosed is a "Replacement Plan - Determination of Complete Application" checklist used
by the SWCD to evaluate the plan. The checklist indicates that all items found under the Sequencing Analysis (8420-
0520) and Replacement Plan Components (8420.0530) are complete.
. The Scott Soil and Water Conservation District supports the wetland replacement plan application as submitted.
. The LGU (City of Shako pee) will need to make a decision on this application and notice their decision to the
appropriate agencies.

INTRODUCTION
At its Wednesday, January 14,2004 meeting, the Environmental Advisory Committee
reviewed and acknowledged, by motion, that the Applicant of the West Dean Lake
Residential and Corporate Center PUD, Ryan Company, has submitted a final Wetland
Delineation Report and Replacement Plan prior to Final Plat approval.
BACKGROUND
On April 9, 2003, theEAC reviewed the Conceptual Plan for the Valley Green Corporate
CenterlW est Dean Lake Residential Development. At that meeting, the EAC requested
that the Applicant provide the following information as a condition of final plat approval:
1. The Ground Water Study Report (Concern over groundwater divide).
2. The Storm-water Management Plan.
3. An Ecological Stewardship Program Manual and/or Document.
4. A document of the Master Development Association's Stewardship Plan for trails
and environmental restoration.
5. The Conservation Easement Plan or delineations.
6. The Wetland Delineation Report and wetland replacement plan.
7. A Comparative Analysis between the Original Conceptual Plan w/275 residential
units and the new Conceptual Plan w/580 residential units. What are the
ecologicaVenvironmental differences or pros & cons?
8. There was a concern expressed over the housing in the southeast comer of the
propose plat.
During Preliminary Plat approval process, the Applicant submitted all ofthe above
information except for item #6 The Wetland Delineation Report and Replacement Plan.
The Applicant has now met all conditions requested by the EAC during the preliminary
plat approval process.
