Michael Leek, Community Development Director SUBJECT: Final Plat of Dean Lakes MEETING DATE: January 20,2004 REVIEW PERIOD: December 11,2003 - April 12, 2004 INTRODUCTION: Ryan Companies U.S., Inc. has made application for final plat approval for the first phase of development ofthe Dean Lakes PUD, i.e. the residential component. CONSIDERATIONS: The primary criterion for approval of a final plat is that it be in substantial conformance with the approved preliminary plat (see City Code Sec. 12.09, Subd. 4). The final plat drawing as submitted is in substantial conformance with the preliminary plat approved by the City Council on December 9, 2003. There has been some reconfiguration of outlot areas, and therefore some re-designation of them, however they are relatively minor changes. Comment: The Engineering Department has submitted comments, a copy of which is attached for the Council's information. These comments have been incorporated into the draft resolution prepared for Council consideration. The Building Official has commented that temporary street signs will be required for inspections and emergency vehicle access, and this requirement has been included in the draft resolution for Council's consideration. The City Clerk has submitted comments, a copy of which is attached for the Council's information. To the extent applicable, these comments have been addressed in the draft resolution prepared for Council consideration. 2901838,2 1 The Minnesota Department of Transportation (MNDOT) has reiterated its comments from the preliminary plat review, and these comments are carried forward from the preliminary plat resolution. Shakopee Public Utilities Commission has submitted comments, a copy of which is attached. The applicant should work directly with the Commission to address its requirements. Comment was received from the Scott County Highway Department. A copy ofthose comments is attached for the Council's information, and those comments have been incorporated into draft Resolution No. 6003. ALTERNATIVES: 1. Approve Resolution No. 6003, approving the Final Plat of Dean Lakes subject to the conditions presented. 2. Approve Resolution No.6003, subject to revised conditions. 3. Do not approve the final plat and direct staffto prepare a resolution consistent with the direction of the Council. 4, Table the matter and request additional information from staff and/or the applicant. STAFF RECOMMENDATION: Staffrecommends Alternative No.1, approval of Resolution No. 6003, approving the Final Plat of Dean Lakes. Michael Leek Community Development Director 2901838.2 2 RESOLUTION NO. 6003 A RESOLUTION OF THE CITY OF SHAKOPEE, MINNESOTA APPROVING THE FINAL PLAT OF DEAN LAKES [FIRST ADDITION] WHEREAS, Ryan Companies U.S., Inc., applicant and Valley Green Business Park, property owner, has made application for preliminary plat approval of Dean Lakes; and WHEREAS, the subject property is legally described as shown on Exhibit A: WHEREAS, the Shakopee Planning Commission conducted a public hearing on the proposed preliminary plat on November 6 and 20,2003; and WHEREAS, all required public notices regarding the public hearing were posted and sent; and WHEREAS, the Shakopee Planning Commission recommended approval subject to the conditions listed below; and WHEREAS, the City Council reviewed the preliminary plat request at its meeting of December 9,2003, and approved the preliminary plat of Dean Lakes; and WHEREAS, the City Council reviewed the request for approval ofthe final plat for the first phase of development of the Dean Lakes PUD. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SHAKOPEE, MINNESOTA, that the proposed final plat of Dean Lakes is in substantial conformance with the preliminary plat approved by the City Council on December 9, 2003. BE IT FURTHER RESOLVED that the final plat of Dean Lakes [First Addition] is hereby approved subject to the following conditions; I. The following procedural actions must be completed prior to the recording of the Final Plat: A. Because this is the first phase of a multi-phase project, the final plat shall be renamed "Dean Lakes First Addition." B. Approval of title by the City Attorney. C. The signature block for the final plat should be revised to state "City Clerk" not "City Manager." D. Execution of a Developers Agreement with provisions for Plan A and Plan B improvements, as well as payment of Trunk Sanitary Sewer Charges, Trunk Storm Water Charges, Trunk Storm Water Storage and 2901838.2 3 Treatment Charges, engineering review fees, and any other fees as required by the City's adopted fee schedule. 1. The applicant may apply to the City and Shakopee Public Utilities Commission for a special lighting district in order to provide more decorative lighting. Street lighting to be installed in accordance with the requirements of the Shakopee Public Utilities Commission. 2. Electrical system to be installed in accordance with the requirements of the Shakopee Public Utilities Commission. 3. Water system to be installed in accordance with the requirements of the Shakopee Public Utilities Commission. 4. Installation of sanitary sewer and storm sewer systems, and construction of streets in accordance with the requirements of the Design Criteria and Standard Specifications of the City of Shakopee. 5. Payment of fees as required by the City's adopted Fee Schedule for the entire plat, except as determined by the City Engineer. 6. No grading shall take place until the City Engineer has approved the grading plans, and no public improvements shall be constructed until the City Engineer and the Shakopee Public Utility Commission approve the Final Construction Plans and Specifications. 7. Park dedication requirements as set forth in PUD approval resolution No. 5986 shall be met. E. Easements shall be shown on the Final Plat as approved by the City Engineer. The following shall apply to easements in this plat; 1. The applicant shall provide ten (10) feet of drainage and utility easement adjacent to all right-of-way. 2. All of Lot 19, Block 7 shall be a drainage and utility easement. 3. All drainage and utility easements that vary from the typical shall be dimensioned. 4. The applicant shall verify the reference to Outlot F on Sheet 7 of 8 is correct. 5. The specified drainage and utility easements shall be dedicated on all lots adjacent to the following sanitary sewer alignments: . Twelve (12) feet North ofMH-234 to MH-233. . Ten (10) feet East ofMH-292 to MH-291. . Ten (10) feet North ofMH-294. . Twelve (12) feet East ofMH-213 to MH-212. . Ten (10) feet East ofMH-360 to MH-330. . Ten (10) feet North ofMH-271 to MH-270. . The applicant shall comply with the conditions of approval set forth in the Planned Unit Development (PUD) approval (Res. No. 5986) and the Planned Unit Development Agreement. H. The survey data (length and bearings) shall be shown for each lot. I. The Property or Homeowners Association documents shall be approved by the City Attorney, and shall contain provisions for the perpetual maintenance and ownership of any outlot, conservation open space easement area, and any other common areas. J. The proposed full access on to the west leg of CSAH 16 shall be redesigned to meet Scott County access spacing guidelines, and Scott County shall approve the redesigned access. K. Payment of cash park dedication fees totaling $245,155. II. Following approval and recording of a final plat for any phase of the development, the following conditions shall apply; A. Building construction, sewer, water service, fire protection and access will be reviewed for code compliance at the time of building permit application(s), B. All NURP ponds shall have either 12 inches of topsoil, or a depth of topsoil recommended by the City Engineer to ensure infiltration benefits. C. Permanent, well-designed posts, SIgnS or other markers shall selectively be placed at the comer of "Lakeside" lots to inform property owners and others using the trail system of the existence of the shore land buffer zone, D. A drainage permit( s), as well as Metro District access permit for Dean Lake Boulevard, will need to be obtained from the Minnesota Department of Transportation (MNDOT). E. An access permit(s) from Scott County will be required for both Dean Lake l'rail and Dean Lake Boulevard. Scott County has indicated that the developer will be required to remove the curb cut and corresponding right turn lane on the east leg of CSAH 16 as part of the access permit(s). F. Any work within Scott County right-of-way, including any trail connections, will require a Scott County permit. G. No landscaping, ponding, berming, or signage shall be permitted within Scott County right-of-way. 2901838.2 5 H. A street light be installed at the developer's expense at the intersection 0:( CSAH 16 and Dean Lakes Trail. I. The base opening of all structures shall be established at an elevation no lower than the 753' mark. J. Any dwelling that is subject to a violation of state noise standards shall be constructed using appropriate climate control systems, STC-rated windows, or other appropriate materials. K. All irrigation systems shall utilize rain sensors, and shall comply with the City of Shako pee's water restrictions. L. The developer shall be responsible for payment of any Trunk Storm Water Charges, Trunk Sanitary Sewer Charges, security for the public improvements, engineering review fees, and other fees. M. Approval of title by the City Attorney. M. Security will be provided under the Developers Agreement for completion of improvements to the open space areas. N. Easements shall be shown on the Final Plat as approved by the City Engineer. O. The survey data (length and bearings) shall be shown for each lot. P. The applicant shall provide 10 feet of total easement between all building clusters. Q. Any change in drainage entering Scott County right-of-way will require the submittal of detailed storm water calculations to the Scott County Engineer for review and approval. R. The May 2003 revision to the AUAR for this project notes the potential for violation of state daytime noise standards for the 2901838.2 6 proposed residences. Responsibility for the cost and installation of any required future noise mitigation measures shall be the developers, property owners association( s) or their successors and assigns. S. Temporary street signs shall be installed at the developer's expense to facilitate inspections and emergency vehicle access. Date: January 13,2004 Re: Valley Green Corporate Center / Dean Lake Residential Development Storm water Maltagemeltt Plait Review Sltakopee, MN WSB Project No. 1566-00 The purpose of this memorandum is to provide stonnwater management review comments for the Valley Green Corporate Center / Dean Lake Residential Development within the City of Shakopee, The site plan and calculations have been previously reviewed. The documents provided by Ryan Companies for this review included the following: 1. Stormwater Report-Dean Lake-Shakopee, MN- - RLK Kuusisto Ltd., December 24,2003. Summary The Stormwater Management Plan for the Valley Green Corporate Center / Dean Lake Residential Development was previously reviewed on October 31, 2003 and November 13, 2004. The comments made in that review regarding "stormwater management review" were not completely addressed by the documents provided. The "preliminary plat review" and "preliminary plan review" comments and issues could not be evaluated as part of this review because residential development grading plan and revised plat were not submitted. The stormwater quality treatment volumes for the drainage area tributary to Dean Lake indicated in the stormwater modeling calculations appears to provide the required volume necessary to meet the City's criteria, Please be advised that the 4-foot average depth of water quality treatment criteria is not being achieved by the proposed grading plan. 4150 Olson Memorial Highway The stormwater quantity discharge rates appear to meet the City's criteria for the Kmart Suite 300 Linear Pond and Dean Lake. OU ' qua ppor unl y poyer Stormwater Management Plan Review January 13, 2004 Page 2 of 4 The City freeboard requirements could not be completely evaluated based on the documents provided for review. The emergency overflow route elevations, low building opening elevations, and low floor elevations were not provided for the residential development. It is assumed that the required elevations will be incorporated into future residential development area plans. The stormwater modeling results indicate that minor modifications will be required to the Pond 7 outlet which serves the Outlot H loading dock area and the Pond CP and 10 stage storage input. Based on discussions with Mr. Boyer from RLK & Associates, the storm sewer design may be revised based on the review comments below. The following review comments, outlined below, represent modifications or design issues for the stormwater management of the site. Stormwater Modelio2 1. The proposed Pond 9 outlet should be modified to limit the depth of water in the loading dock depression. The use of an 8" orifice in a control structure does not appear to be feasible. The stage storage input for the depression to elevation 951 was not reflected in the documents provided. It is recommended that the loading dock area be discharge to the proposed downstream ponds at the lO-year event discharge rate. 2. The stage storage input for Pond CP and 10 at elevation 951 appears to be duplicated for each pond. The surface area input at elevation 951 should only reflect the area for each pond or the proposed pond could be modeled as one basin with combined surface areas above the outlet elevations. 3. The 10- Day runoff event could not be evaluated due to the drainage area CN not being changed to 100 to simulate the frozen-impervious condition ofthe site. The model input should be modified and resubmitted for review. 4. The current design of pond outlet structures does not incorporate the City's requirements for skimming. The pond outlets will need to accommodate skimming and details provided for review. Stormwater Quality 1. The proposed stormwater quality volume in Pond 7, 8, CP, and 10 appears to meet the City policy. The dead storage calculations appear to contain errors in the pond volume incremental and cumulative results. The spread sheet formulas should be verified by the developer's engineer. The proposed treatment ponds 7, 8, and CP tributary to Dean Lake do not provide the 4-foot average depth required by the City's Stormwater Plan. 3. The City has issued a concern related to the infiltration of storm water from the commercial development ponding areas. To address this concern, it is requested that the ponds provide two cells; the upstream cell to provide removal of pollutants and the downstream cell to allow infiltration. Freeboard Reauirements 1. The freeboard requirements for the Commercial sites appear to meet the City requirements. 2. The freeboard requirements for the Residential portion ofthe site could not be evaluated based on the documents provided. Residential Gradin2 Plan The comments outlined below were contained in our previous memo and could not be evaluated until the revised residential grading plans have been forwarded for review. 1. The grading plan is anticipated to require modifications with respect to the low floor elevations and contours illustrated within the residential development for this site. The grading plan low floor elevations do not appear to be consistent with the proposed contours. The low floor elevations should be verified and adjusted as necessary to be in agreement with the proposed contours. 2. The proposed grading plan is missing the 758 and 760 contour elevations in the vicinity of the residential portion of the site. The grading plan for the residential portion of the development should be reviewed and adjusted as necessary to incorporate the proposed contours which will correspond to the garage floor and finish floor elevations. The low building opening and finish floor elevations should be added to the grading plan to evaluate the freeboard requirements for the emergency overflow routes within the development. The emergency overflow elevations should also be added from all street lowpoints, rear yard depressions, and ponding areas within the development. 3. The proposed maximum driveway slopes for the development could not be evaluated until the garage elevations are defined on the grading plan. It is anticipated that the driveway slope will be defined in the future for this development. The Residential storm sewer design elevation for the connection from Bulrush Blvd. to Coneflower Lane at station 3+00 appears to have an invert error at Structure #931. The design calculations indicated that the invert at Structure # 931 should be at the 952.35 elevation. The Outlot I storm sewer design appears to also contain the same error. The Residential design indicates that the invert at structure #930 should be at elevation 750.89 based on the upstream connection from structure #932 to # 931 and the proposed pipe slope from # 931 to # 930. The invert elevation of structure #930 should be verified. The system design for the 900 series structures should be consistent between the Residential and Outlot I design data. 2. The storm sewer system design calculations do not appear to be utilizing the cumulative time of concentrations to incorporate corresponding storm intensity in the pipe design flow. It appears that the pipe design is oversized and undersized due to this time of concentration assumption. It is recommended that the cumulative time of concentration be utilized to determine if the system contains the 10- year event capacity. 3. The storm sewer design contains drainage area input that does not correspond to the drainage areamap. The drainage area input should be verified with the drainage area map acreage. The Outlot A design contains the majority of the discrepancies from structure 108 to 102. The drainage area input for structure # 744 & # 632A Res, Outlot B # 203, # 610, #101C, and 10lB should be verified. The Outlot I drainage area of 0.82 Acres for the east building roof does not appear to be included in either 322R or the 323R design. The design requires additional review of the drainage areas. 4. The design calculations have been redlined with the portions of the design that require redesign or explanation. The redlined copies ofthe design calculation are attached to this review. 5. The Outlot I storm sewer design for structure #326, #325, and #324 should be reviewed. It appears that the invert elevation for # 325 is above the upstream connection. In addition, the upstream pipe is a 30" diameter cortnecting to a 24" diameter pipe leaving structure # 325. The design ofthis system should be reviewed and revised as necessary. 6. Since this is the first of five phases, should the title of the plat be the first addition and if so how does this affect any agreements identifying the plat as Dean Lakes? 2. A draft petition for the City to construct public improvements identifies Dean Lake Boulevard, Dean Lake Trail and Meadow Lane. Names on the final plat drawing do not reflect these names. 3. The parties signing the petition should be the same as those signing the plat. Mr. Thomson was going to point this out to the attorneys. 4. Signature block should state "City Clerk" not "City Manager". 5. Developer has signed the following agreements and they are on file with the City Clerk to be recorded behind the plat: Master Development Agreement and PUD Agreement. In addition there is a signed Conservation Agreement that cannot be recorded until legal descriptions are prepared. 6. Delete conditions in the final resolution that have been addressed i.e.: has the EAC been provided a document of the proposed master/property owners association that details expected performance measures for restoration efforts, and the conservation easement documents? 7. What are the improvements to the open space areas that the city desires security for? What amount is desired for the security? 8. Development shall be in conformance with the preliminary plat approval and the PUD approval. (Note the PUD resolution requires that payment of park dedication fees shall be made prior to approval of the first final plat for Dean Lakes or in accordance with the City's Developer's Agreement.
