SUBJECT: City Holiday - Christmas Eve Day

INTRODUCTION:
The Council is asked to give direction on implementation of the one-half day holiday
observed on Christmas Eve Day, by City employees.
BACKGROUND:
Approximately three years ago, the City approved an additional .5-day (based on 8 hours)
holiday that is observed on Christmas Eve Day. It is now in the contract for the Police
Officers and Public Works unions, and in the employee handbook for the non-contract
employees. (Police Sergeants have one-half day on the day following the fourth
Thursday in November).
When a holiday falls on a Saturday, by practice it is observed on the preceding Friday
(conversely, if the holiday falls on a Sunday, the following Monday is observed as a
holiday). For the first time in 2004, we will conflict with that language, as Christmas
Day holiday (on a Saturday) will be observed on Christmas Eve Day, December 24th.
Therefore, the one-half day intended for Christmas Eve Day needs to have direction as to
when it will be observed, The logical thing to do would be to observe that on the
workday preceding the day when the Christmas holiday is observed.
This proposal was deferred from consideration at the January 20th Council meeting, when
a question was raised as to whether staff could stagger taking the .5 day holiday during
the week, so that it would not require City Hall to be closed for a day and a half (when
combined with Christmas Day being observed on December 24th.) After further
discussion, staffs recOlmnendation is to have Council consider the original proposal. It
was noted that the last week in December is often in a new pay year (thus making it more
complicated ifthe staggering of the observance creates differing rates of pay between
employees), and that business from the public is traditionally very slow on the days
immediately preceding Christmas.
RECOl\1MENDATION:
I recollU11end that the Council approve a change in the employee persOlmel policy, which
reflects that the Christmas Eve holiday will be observed on the workday preceding the
day that the Clu"istmas Day holiday is observed.
This change would also be practiced, and would be eligible for negotiation into the
contract language for the Public Works and Police Officers contracts.
ACTION REQUIRED:
If the Council concurs, it should, by motion, adopt the following resolution:

A RESOLUTION OF THE CITY OF SHAKOPEE MINNESOTA AMENDING
RESOLUTION NO, 4231, ADOPTING A PERSONNEL HANDBOOK
WHEREAS, on May 2, 1995, the City Council adopted Resolution No. 4213,
adopting a new PersOlmel Handbook for the Employees of the City; and
WHEREAS, non-contract employees of the City of Shakopee, Milmesota, have as
a benefit a one-half day holiday, based on an eight hour shift, that is nonnaUy taken on
December 24th, beginning at noon (or mid-shift); and
WHEREAS, because of the calendar there can be a conflict with observing
Clu'istmas Eve Day on December 24th, when the Christmas Day Holiday is otherwise
n0l111ally taken;
NOW, THEREFORE BE IT RESOLVED BY THE CITY COUNCIL that the
following paragraph is hereby amended for the purposed of inseliion into the City's
employee handbook:
Holidays - Regular employees who regularly work 30 or more hours per week are
entitled to time off with pay on holidays. City offices shall be closed for business on
each such holiday, but employees maybe required by their department heads to work on
holidays when the nature of their duties or other conditions require. An employee
required to work on a holiday shall be paid or receive compensatory time at the rate of
one and one-halftimes the employee's base pay, plus the employee's regular rate of pay
for the holiday. When a holiday falls on a Saturday, the proceeding Friday is a holiday.
When a holiday falls on a Sunday, the following Monday is a holiday. The Christmas
Eve one-half day holiday shall be observed the workday preceding; the day Christmas is
officially observed.
Adopted in session of the City Council of the City of Shako pee,
