Memorandum TO: Mayor & City Council Mark McNeill, City Administrator FROM: Bruce Loney, Public Works Director SUBJECT: Authorize Payment for Easement on Parcel No.' s 2, 4 & 10 for the 2003 Reconstmction Project No. 2003-3 DATE: February 3, 2004 INTRODUCTION: Attached to this memo are letters from Evergreen Land Service Company in regard to the easements and payments for Parcel No.'s 2, 4 & lOin conjunction with the 2003 Reconstruction Project. The purpose of this agenda item is for Council to authorize payment of easements. BACKGROUND: In association with the 2003 Reconstruction Project, additional easements are needed for the widening of Fourth A venue and building of Sarazin Street with utilities to service the Shakopee Public Utility building. With this project design, the City did contract with WSB & Associates, Inc. for the plan preparation and also contracted with Evergreen Land Service Company to make the necessary appraisals and negotiations for obtaining the easements. Easements has been negotiated by Evergreen Land Service Company with William and Renelda Hauer, Shakopee Cemetary Association and Randolph and Lisa Kubes and the final amounts are acceptable according to the City Attorney and staff. These offers have been accepted in writing by the property owners and easements executed. Staff recommends Council authorization of payment to these property owners in the amount listed in the offer letters. Also attached for Council reference and consideration is the sketch of the easement area, as prepared by WSB & Associates for easements on these parcels. ALTERNATIVES: 1. Approve a motion to authorize payment of $6,200.00 to William A. Hauer and Renelda D. Hauer, the owners of Parcel No.2 ( P.I.D. No. 27-906028-2) and payment of $l4,OOO.OO to Shakopee Cemetary Association, the owner of Parcel No.4 (P.LD. No. 27-905019-0) and payment of$14,100.00 to Randolph J. Kubes and Lisa Marie H. Kubes, owners of Parcel No. 10 (P.LD. No. 27-068004-0) for easements associated with the 2003 Reconstruction, Project No. 2003-3 2. Deny the easement acquisition. 3. Table this item for additional information. RECOMMENDATION: Staff recommends Alternative No.1. ACTION REQUESTED: Approve a motion to authorize payment of $6,200.00 to William A. Hauer and Renelda D. I have recorded the Right of Way and Utility Easement. We should be receiving them back in about 6 weeks and I will send them to you. The Temporary Construction Easement is not being recorded.
