Parcel No. 1 for the 2003 Reconstruction Project No. 2003-3

INTRODUCTION:
Attached to this memo is a letter from Evergreen Land Service Company in regard to an
easement and payment for Parcel No. 1 in conjunction with the 2003 Reconstruction
Project. The purpose of this agenda item is for Council to authorize payment of this
easement.
BACKGROUND:
In association with the 2003 Reconstruction Project, additional easements are needed for
the widening of Fourth Avenue and building of Sarazin Street with utilities to service the
Shakopee Public Utility building. With this project design, the City did contract with
WSB & Associates, Inc. for the plan preparation and also contracted with Evergreen
Land Service Company to make the necessary appraisals and negotiations for obtaining
the easements. An easement has been negotiated by Evergreen Land Service Company
with Shakopee 62 Partnership and the final amount is acceptable according to the City
Attorney and staff.
This offer have been accepted in writing by the property owner and the easement
executed. Staff recommends Council authorization of payment to the property owner in
the amount listed in the offer letter. Also attached for Council reference and
consideration is the sketch of the easement area, as prepared by WSB & Associates for an
easement on this parcel.
ALTERNATIVES:
1. Approve a motion to authorize payment of $10,050.00 to Shakopee 62
Partnership, the owner of Parcel No.1 (P.I.D. No. 27-906018-0) for an easement
associated with the 2003 Reconstruction, Project No. 2003-3
2. Deny the easement acquisition.
3. Table this item for additional information.
RECOMMENDATION:
Staff recommends Alternative No.1.
ACTION REQUESTED:
Approve a motion to authorize payment of $10,050.00 to Shakopee 62 Partnership for
Parcel No. 1 (P.LD. No. 27-906018-0) for an easement associated with the 2003
Reconstruction, Project No. 2003-3.

THIS STIPULATION is made by and between the Petitioner City of Shako pee ("City") and
Respondent Shakopee 62 Partnership ("Respondent").
Recitals
A. Respondent is the fee owner of the real property located at l428 Fourth Avenue
South, Shakopee, Minnesota, which is identified as Parcell in this action (the "Property").
B. The City has commenced an action in condemnation to acquire certain easements
over Parcell.
C. The parties have reached a full and final settlement and compromise concerning the
matters in dispute.
