SUBJECT: Consider Awarding a Contract for the
Beckrich Park Estates and Kristal Estates
Sewer and Water Improvements, project no. 2007-10

INTRODUCTION:
Attached is Resolution No. 6775, which accepts the bids and awards a contract for the
Beckrich Park Estates and Kristal Estates Sanitary Sewer and Water Improvements,
Project No. 2007-10.
BACKGROUND:
On March 5, 2008, City Council adopted Resolution No. 6737, which approved the plans
and specifications and authorized staff to advertise for bids for the Beckrich Park Estates
and Kristal Estates Sanitary Sewer and Water Improvements, Project No. 2007-10.
On April 29, 2008, a bid opening was held for the Beckrich Park Estates and Kristal
Estates Sanitary Sewer and Water Improvements Project, in which there were nine bids
opened for this improvement project. The bids are summarized in the attached
resolution. From the bid opening, the apparent low bidder is S.M. Hentges & Sons, Inc.
with a bid of $552,770.63. The Engineer's estimate for this project is $650,000.00.
The feasibility study contained a construction cost estimate of approximately
$713,169.99 and a project cost estimate of approximately $891,451.87. Adding a 5%
contingency to the actual low bid and 25% indirect costs, the estimated project cost is
approximately $725,511.45, which is below the estimated project cost in the feasibility
study.
If Council awards the contract, staff is also requesting a contingency amount equal to 5%
of the contract to cover minor change orders and quantity adjustments that may occur on
the project.
At the time of writing this memo, Shakopee Public Utilities Commission (SPUC) has
received 23 of 34 property owner's signatures for the Water Service Agreements and
have 6 property owners indicating they will sign. It is anticipated that more signatures of
the agreement will be received and an update will be presented at the Council meeting.
Attached is a list of municipal water agreement signatures dated May 14, 2008.
These owners that do not sign up for service will have their water service turned off once
the system is hooked up to the municipal water system. The Beckrich Park Estates
properties have a common private system, thus everyone connected to this system must
convert to the SPUC system requirements. Also attached is an extension agreement with
WSB & Associates, Inc. on surveying work needed for this project.
ALTERNATIVES:
1. Accept the low bid of S.M. Hentges & Sons, Inc. and adopt Resolution No. 6775.
2. Reject the low bidder and award to another bidder.
3. Reject all bids and rebid.
4. Approve a 5% contingency amount on this project for use by the City Engineer in
authorizing change orders or quantity adjustments on this project.
5. Authorize the appropriate City officials to execute an extension agreement with
WSB & Associates, Inc. to perform construction staking service on the Beckrich
Park Estates and Kristal Estates improvements.
6. Table for additional information.
RECOMMENDATION:
Staff recommends Alternative No. 1 No. 4 and No. 5 in order for this project to
commence.
ACTION REQUESTED:
1. Offer Resolution No. 6775, A Resolution Accepting Bids on the Beckrich Park
Estates and Kristal Estates Sanitary Sewer and Water Improvements
Improvements, Project No. 2007-10 and move its adoption.
2. Approve a 5% contingency amount on this project for use by the City Engineer in
authorizing change orders or quantity adjustments on this project.
3. Authorize the appropriate City officials to execute an extension agreement with
WSB & Associates, Inc. to perform construction staking service on the Beckrich
Park Estates and Kristal Estates improvements.

A Resolution Accepting Bids For
For The Beckrich Park Estates and Kristal Estates Addition
Sanitary Sewer and Water Improvements
Project No. 2007-10
WHEREAS, pursuant to an advertisement for bids for the Beckrich Park Estates and
Kristal Estates Addition, Project No. 2007-10, bids were received, opened on Apri129, 2008, and
tabulated according to law, and the following bids were received complying with the advertisement:

WHEREAS, it appears that S.M. Hentges & Sons, Inc., P.O. Box 69, Jordan, MN 55352
is the lowest responsible bidder for the Beckrich Park Estates and Kristal Estates Sanitary Sewer
and Water Improvements.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
SHAKOPEE, MINNESOTA:
1. The appropriate City officials are hereby authorized and directed to enter into a
contract with S.M. Hentges & Sons, Inc. in the name of the City of Shakopee for the Beckrich Park
Estates &Kristal Estates Sanitary Sewer and Water Improvements Project according to the plans
and specifications therefore approved by the City Council and on file in the office of the City Clerk.
2. The City Clerk is hereby authorized and directed to return forthwith to all bidders
the deposits made with their bids, except that the deposits of the successful bidder and the next
lowest bidder shall be retained until a contract has been signed.

Construction Surveying Services
Beekrich Park Estates Utility Improvements
Shakopee, MN
Dear Mr. Weyandt:
According to our Agreement for Professional Services within the City of Shakopee and Section I-C-2 (Major
Projects), this extension agreement is written to provide you with an estimate of cost for construction
surveying services for the above-referenced project.
We propose to provide the following construction surveying services for this project:
• Attend pre-construction conference
• Provide stakes as needed for removals
• Provide line and grade stakes as needed for sanitary sewer
• Coordinate wye locations with field representative
• Provide line and grade stakes as needed for watermain, gate valves, and hydrants
• Provide line and grade stakes for curb and gutter replacement
• Provide cut-sheets for all survey stakes
• Provide as-built survey data including top nut of hydrant elevations, curb stops, top of casting and
invert elevations.
WSB is proposing to complete the work as described above on an hourly basis in accordance with our fee
schedule with anot-to-exceed fee of $14,500.00. Additional staking that may be required due to lost stakes
and addendums would be billed at our normal hourly rate of $140.00 per hour fora 2-person survey crew.
We are available to start on this work when needed and we will be available as needed through the duration of
this project.
The City of Shakopee agrees to reimburse WSB & Associates, Inc., for these services in accordance with
Section IV of the Agreement for Professional Services. If this agreement meets with your approval, please
sign below and return one copy to our office.
