No. 6776 CITY OF SHAKOPEE MEMORANDUM To: Mayor and City Council, City Administrator ~ ~ ~ ' From: Andrea Weber, Park and Landscape Designer Meeting Date: May 20, 2008 Subject: Resolution No. 6776, A Resolution Accepting the Construction of Autumn Hill Neighborhood Park Improvements, Project No. PR 2006-6, in the Valley Creek Crossing Addition Introduction This item is to request City Council's acceptance of the development of a neighborhood park by Associated Capital Corporation. Background The Valley Creek Crossing preliminary plat included the following conditions ¦ The developer provide a combination of land and cash to meet park dedication requirements ¦ The developer will work with staff to design and construct the park area as part of the construction of the development (with review of the design by the Parks and Recreation) ¦ That the costs for constructing the parks be credited toward their cash contribution. ¦ The developer shall work with the City to identify and establish a trail connection from the South to facilitate pedestrian access to the park. The park land dedicated is 2.58 acres, which includes an active use area and a wooded area. There are privately held woodland conservation easements adjacent to the park. The trail connection from the south has not been made. Due to the steep slopes and wooded ravine with a natural creek in it, a trail connection would be very costly. The trail would also require agreements and/or easements to connect to the privately owned Becketridge Estates open space to Barrington Drive or to 22"d Avenue (CR 78). At this time staff has not pursued this connection, but it is still possible to complete in the future if the Comp Plan supports it and the affected residents agree. Sidewalk connections have been installed as per the plat which provide access from the south to Valley Creek Crossing residents. The remaining park dedication requirements will be met through cash contribution as follows: Park Dedication Cash Contribution Calculation The preliminary plat conditions require that the applicant meet park dedication requirements through a combination of land and cash. The total park dedication value, calculated at time of final plat approval, totaled $361,500. As stated in the Resolution No 6087, land was dedicated on the plat (2.58 acres) and the cash dedication required was $128, 358.00. The cash contribution was calculated for the entire development as follows: Park dedication cash contribution shall be: Cash Contribution: 100 Units X $3,615/unit $361,500 Credit: 2.58 acres of land dedicated X $90,365/acre ($233,142) Cash Contribution Due: $12$,358 A letter of credit in the amount of $128,358.00 has been held by the City for the park construction. The developer is also required to submit cone-year maintenance bond to the City for maintenance of the improvement to the Autumn Hill Neighborhood park, as per the Developers Agreement and the City code 12.19 Subsection 3 which states that the developer must submit a maintenance bond guaranteeing the improvements for a period of one year after final acceptance by the City. Improvements are defined as any public improvements. The amount of the Warranty bond is 60% of the value of the improvements The park Autumn Hill Neighborhood Park is complete. The final cost breakdown for the park development is described below: Letter of Credit $128,358.00 Developer's General Contractor (Chard Tiling and Excavating Inc.) Includes concrete, seeding, landscaping, erosion control subs ($69,150.23) Playground Equipment -installed (MN/Wi Playgrounds) (39,928.10) Site furnishings (St. Croix Recreation) ($7,590.00) Engineering & Surveying (Kallio Engineering) ($3,237.50) Irrigation connections Ries Electric ($900.00) Irri ation connections-Valley Plumbing ($846.25) Total Park Construction Costs 121,652.08) Remaining Park Dedication Payable to City (includes $5,000 for city design/CA) $6,705.92 Upon receipt of the check for $6,705.92, the developer will have met the cash contribution for park improvements and land dedication. Aone-year Warranty Bond starting May 20, 2008 for 60% of $69,150.23=$41,490.14 has been submitted by the general contractor. This has satisfied the total park dedication amount of $128,358.00 and the letter of credit under the development agreement can be released to the developer. Visioning Relationship B. Great Place for Kids to Grow Up Requested Action If Council concurs, offer Resolution No. 6776, A Resolution Accepting the Construction of Autumn Hill Neighborhood Park Improvements ,Project PR 2006-6 in the Valley Creek Crossing Addition, and Authorizing the Release of the letter of credit, and move its adoption. RESOLUTION NO. 6776 A Resolution Accepting the Construction of Autumn Hill Neighborhood Park Improvements, Project PR 2006-6 in the Valley Creek Crossing Addition, and Authorizing the Release of the letter of credit Whereas, pursuant to park dedication requirements for the Valley Creek Crossing Addition, Associated Capital, Inc. has satisfactorily completed the Autumn Hill Neighborhood Park pursuant to the requirements of the final plat approval for Valley Creek Crossing. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SHAKOPEE, MINNESOTA that the work completed for the development of the park in Valley Creek Crossing Addition and guaranteed under the fetter of credit in the amount of $128,358.00, under the development agreement is hereby accepted and approved; and BE IT FURTHER RESOLVED, that the City Clerk is hereby authorized to release and return the letter of credit under the development agreement and retain the one year warranty bond from the developer for 60% of the improvements.
