Regarding Hourly Restrictions on Construction Activities on the
County Road 101 Bridge Replacement Project

INTRODUCTION:
By letter dated April 13, 2008, Redstone Construction Company, the contractor for the
County Road 101 Bridge Replacement Project has requested that City Code Sec. 10.60,
Noise Elimination and Noise Prevention, Subd. 3, Hourly Restrictions on Certain
Operations, D, be suspended for Saturday work hours.
DISCUSSION:
The above named section of the City Code restricts the hours of operation from 7:00
A.M. to 10:00 P.M. on weekdays, and from 9:00 A.M. to 9:00 P.M. on weekends and
holidays.
Redstone Construction Company is requesting a suspension on the hours as follows:
Saturday 7:00 A.M. to 9:00 P.M.
The contractor is not anticipating working on Saturdays but would like the flexibility if
weather becomes an issue.
Staff would recommend that if the suspension of hours is granted, that the approval is
subject to the following conditions:
1. Approval is contingent upon minimizing noise exposure near residential areas.
2. If residential complaints are received by the City, the suspension can be revoked at the
discretion of the City Engineer.
3. Blasting activities, if any, must be done from 10:00 A.M. to 6:00 P.M on Saturdays.
If Council approves the suspension, a public notice to meet the City Code requirements
and notice such as a news release would be placed in the Shakopee Valley News.
ALTERNATIVES:
1. Approve the suspension of City Code Sec. 10.60, Noise Elimination and Noise
Prevention, Subd. 3, Hourly Restrictions on Certain Operations, D, as requested by
Redstone Construction Company, as per their letter dated April 13, 2008 and direct
staff to publish notice of the suspension terms with the conditions as recommended by
staff.
2. Approve the suspension of City Code Sec. 10.60, Noise Elimination and Noise
Prevention, Subd. 3, Hourly Restrictions on Certain Operations, D, for some other
period of time as determined appropriate by the City Council, and direct staff to
publish notice of the suspension terms.
3. Do not approve the suspension of City Code Sec. 10.60, Noise Elimination and Noise
Prevention, Subd. 3, Hourly Restrictions on Certain Operations, D.
RECOMMENDATION:
Staff recommends Alternative No. 1.
ACTION REQUESTED:
Offer a motion approving suspension of City Code Sec. 10.60, Noise Elimination and
Noise Prevention, Subd. 3, Hourly Restrictions on Certain Operations, D, as requested by
Redstone Construction Company, as per their letter dated April 13, 2008 and direct staff
to publish notice of the suspension terms with the conditions as recommended by staff.

Redstone Canstrpctian is performing the Bridge Constructkon on FIwy 101 NE of town.
''UVe are attempting to complete this project as quickly as passible without working
Saturdays. Qn the occasion tl'ia1; Redstone elects to work a Saturday, we request city
council's perrnissian to start work at 7:OQ AM. The noise level production on the job
from this point on will be fairly low, The loudest equipment to be operated are probably
the crane and cement trucks. Na mare use of a pile liamrner (very loud piece of
equipment) will be necessary, Thank you for your consideration,
