Cox, City Clerk SUBJECT: Changing Precinct Boundaries DATE: Apri129, 2008 BACKGROUND: City Council is asked to adopt Ordinance No. 797 which adjusts the precinct boundary between Precinct 9 and Precinct 11. BACKGROUND: In 2004, City Council divided Precinct 9 into two precincts by adding a Precinct 11. Because precinct boundaries must follow a clearly recognizable physical feature, and because 17th Avenue was not constructed to CR 83, the available options for boundaries for the new Precinct 11 were limited. Now that 17th Avenue has been constructed to CR 83, it is advisable to change the boundaries of Precinct 9 and Precinct 11. It is proposed that the boundary between Precinct 9 and Precinct 11 be changed so that Precinct 11 would be expanded to include the area north of 17th Avenue and to the east at CR 83. The boundary for Precinct 11 would be described as: beginning at TH 169 and Marschall Road, south to Valley View Road, east to Independence Drive, north to 17th Avenue, east to CR 83, north to TH 169 and west to Marschall Road. The polling place for Precinct 11 (Shakopee Area Catholic Education Center) can better accommodate the growing population than can the polling place for Precinct 9 (Cross of Peace Lutheran Church). ALTERNATIVES: 1. Status quo, make no boundary changes 2. Change the precinct boundaries as proposed between Precinct 9 and Precinct 11 3. Other Changing Precinct Boundaries Apri129, 2008 Page 2 RECOMMENDATION: Staff recommends alternative number 2, change the precinct boundaries between Precinct 9 and Precinct 11. Ninth Precinct. The Ninth Precinct shall be bounded on the north by a line beginning at the intersection of 17th Avenue and Canterbury Road (County Road 83), thence west along 17th Avenue to Independence Road, thence south along Independence Road to Valley View Road, and thence west along Valley View Road to Marschall Road (County Road 17); on the west by Marschall Road (County Road 17); on the east and south by a line beginning at the intersection of 17th Avenue and Canterbury Road (County Road 83) and extending south along Canterbury Road to the corporate City limits, thence following the corporate City limits west, thence south, thence west, thence south to Marschall Road (County Road 17) Section 2 -Section 2.20, Subd. 11, Eleventh Precinct, is hereby repealed and replaced by the following: Subd. 11. Eleventh Precinct. The Eleventh Precinct shall be bounded on the north by U.S. Highway 169; on the west by Marschall Road (County Road 17); on the south and east by a line beginning at the intersection of Valley View Road and Marschall Road (County Road 17), thence east along Valley View Road to Independence Drive, thence north along Independence Drive to 17th Avenue, thence east along 17th Avenue to Canterbury Road (County Road 83) and thence north along Canterbury Road (County Road 83) to U.S. Highway 169. Section 3 -Effective Date. This ordinance becomes effective from and after its passage and publication. Adopted in session of the City council of the City of Shakopee, Minnesota, held this day of , 2008. -Mayor of the City of Shakopee.
