No. 6774 V~ ~..J• CITY OF SHAKOPEE Memorandum CASE NO.: 08-022 TO: Mayor and City Council ~ ~ Mark McNeill, City Administrator FROM: Mark Noble, Planner II SUBJECT: Set Public Hearing for Vacation of Easements within Evergreen Heights MEETING DATE: May 5, 2008 INTRODUCTION Gregory McClenahan, on behalf of Evergreen Heights Townhomes Limited Partnership, has requested a vacation of easement for property located on Lot 2, Block 1, Evergreen Heights, adjacent to Balsam Trail. There presently is a 10 foot drainage and utility easement around the perimeter of this lot, and the property owner is requesting the vacation of that portion of easement along the southwesterly portion of property to allow for the construction of a maintenance building. Evergreen Heights Townhomes Limited Partnership has submitted an application for preliminary and final plat to combine a triangular shaped parcel they acquired from MNDOT with property in Evergreen Heights 1St Addition; thereby negating the need for that portion of the existing easement. The applicant has worked with City staff and Shakopee Public Utilities Commission (SPUC) on the proposed easements submitted with the plat application of proposed Evergreen Heights 2°d Addition. DISCUSSION The attached resolution sets a public hearing for Tuesday, June 3, 2008. On that date, comments from staff members and utilities, as well as a recommendation from the Planning Commission, will be presented to the City Council for consideration. The Planning Commission will consider the request at its May 8, 2008 meeting. ACTION REQUESTED Approve Resolution No. 6774, a resolution setting the public hearing date to consider the vacation of a portion of drainage and utility easement on Lot 2, Block 1, Evergreen Heights. Mark No Planner II h:\cc\2008\OS-OS\VAC PH Evergreen.doc 1 RESOLUTION N0.6774 A RESOLUTION SETTING THE PUBLIC HEARING DATE TO CONSIDER THE VACATION OF A PORTION OF DRAINAGE AND UTILITY EASEMENT ON LOT 2, BLOCK 1, EVERGREEN HEIGHTS WHEREAS, it has been made to appear to the Shakopee City Council that the public easement serves no public use or interest; and WHEREAS, a public hearing must be held before an action to vacate can be taken and two weeks published and posted notice thereof must be given. WHEREAS, two weeks published notice will be given in the SHAKOPEE VALLEY NEWS and posted notice will be given by posting such notice on the bulletin board on the main floor of the Scott County Courthouse, the bulletin board at the U.S. Post Office, the bulletin board at the Shakopee Public Library, and the bulletin board in the Shakopee City Hall. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SHAKOPEE, MINNESOTA, that a hearing be held in the Council Chambers on the 3rd day of June, 2008, at 7:00 P.M. or thereafter, on the matter of vacating a portion of drainage and utility easement on Lot 2, Block 1, Evergreen Heights.
