No. 6761 V• CITY OF SHQKOPEE Y ~ ~ MEMORANDUM ~ To: City Council and Mark McNeill, City Administrator From: Jamie Polley, Director of Parks, Recreation & Natural Resources Meeting Date: May 5, 2008 Subject: Huber Park and Related Riverfront Redevelopment, Fillmore Street Extension, and Alley Improvement -Sitework Package, PR2005-3 Final Pay Authorization Introduction This item is to request City Council's authorization for acceptance of work and final payment to K.A. Witt Construction Company for the Huber Park and Related Riverfront Redevelopment, Fillmore Street Extension, And Alley Improvement -Sitework Package, . Project No. PR2005-3. Backs~round The construction of Huber Park began in 2006 with the City issuing contracts to two general contractors, Greystone Construction Company and K.A. Witt. We finalized Greystone Construction's contract on September 18, 2007. K.A. Witt was responsible for the site work construction elements, which included the sanitary sewer and water main construction, electrical plan, site grading and site landscaping. K.A. Witt Construction Company delivered the project on time; within budget, and with high quality workmanship. The K.A. Witt Construction Company final contract budget is as follows: Funding Original Contract: $2,145,573 5% Contincaency $ 107,279 Total Funding $2,252,852 Final Cost Final Contract Amount $2,069,391 Change Orders 1-3 $ 89,289 (4.16%) Final Cost $2,158,680 A two-year maintenance contract was also included as part of the site work package. Thetwo-year maintenance agreement is in addition to the total contract cost. The City will pay K.A. Witt $4,500 for maintenance at the time that the maintenance requirements are completed per the contract specification. The payment will be paid in two installments. The first payment of $2,250 will be made in June of 2008 and the second payment of $2,250 will be paid in June of 2009. The $4,500 will be set up in a separate ` escrow account and does not affect the final acceptance of this project. K.A. Wift will provide the City with written confirmation of their maintenance obligations and a maintenance timeline prior to the final payment. By aggressively managing the contract, we were able to keep the change order costs for this portion of the contract to under 5%. The building package was $31,920 under budget. The site work package was $94,172 under budget. The final cost for the entire project minus the $4,500 maintenance contract fee was under budget by $121,592. Visioning Relationship F. Witt Construction on Huber Park and Related Rivertront Redevelopment, Fillmore Street Extension, and Alley Improvements -Sitework Package, Project No. PR2005-3 Whereas, pursuant to a written contract, signed with the City of Shakopee on July 5, 2006, K.A. Witt Construction has satisfactorily completed Huber Park and Related Rivertront Redevelopment, Fillmore Street Extension, and Alley Improvements - Sitework.Package in accordance with such contract. NOW, THEREFORE BE lT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SHAKOPEE, MINNESOTA that the work completed under said contract is hereby accepted and approved; and BE IT FURTHER RESOLVED, that the City Clerk and Mayor are hereby directed to issue a proper order for the final payment on such contract in the amount of $22,797.12, taking the contractor's receipt in full.
