SUBJECT: Extended Work Hours for Marschall Road Overlay (D)
Action Sought
The Council is asked to offer a motion approving a suspension of City Code Sec.
10.60, Noise Elimination and Noise Prevention, Subd. 3, Hourly Restrictions on
Certain Operations, D, allowing work beginning on July 20, 2015 and continuing
only until the County's Overlay project on CSAH 17 is completed, and directing
staff to publish notice of the suspension terms with the conditions as recommended
by staff
Background
Scott County and Knife River Corporation - North Central, the contractor for the
County's 2015 Overlay Project, have requested that City Code Sec. 10.60, Noise
Elimination and Noise Prevention, Subd. 3, Hourly Restrictions on Certain
Operations, be suspended for certain work hours.
The above named section of the City Code restricts the hours of construction
operations from 7:00 a.m. to 10:00 p.m. on weekdays and from 9:00 a.m. to 9:00
p.m. on weekends and holidays.
The County is requesting that work be allowed between the hours of 8:00 p.m. and
6:00 a.m. beginning the week of July 20, 2015 until the project is completed.
Although the project should only take approximately five (5) to seven (7) working
days, the proposed start date is tentative and could change based on weather and
previously scheduled projects.
Concrete work and restoration will take place during regular working hours with
temporary lane restrictions during off-peak hours.
The project scope includes CSAH 17 (Marschall Rd) from 10th Avenue to CSAH
101 (1st Ave.). This request is being made to help expedite the work and avoid
traffic impacts on CSAH 17 during the morning and evening rush hours.
Staff would recommend that if the suspension of hours is granted, that the approval
be subject to the following conditions:
1. Approval is contingent upon minimizing noise exposure.
2. If property owner complaints are received by the City, the suspension can be
revoked at the discretion of the City Engineer.
If Council approves the suspension, a public notice to meet the City Code
requirements and notice such as a news release would be placed in the Shakopee
Valley News.
Recommendation
Staff recommends approving the suspension of City Code Sec. 10.60, Noise
Elimination and Noise Prevention, Subd. 3, Hourly Restrictions on Certain
Operations, per this memo, and direct staff to publish notice of the suspension terms
with the conditions as recommended by staff
