No.7577 (B) Action Sought Offer a motion to approve Resolution Number 7577, a resolution approving a Registered Land Survey for property owned by Shakopee Public Utilities Commission at 835 First Ave W and the vacated portion of Cass Street for the First Avenue Substation. Introduction: Shakopee Public Utilities has made application for a Registered Land Survey to combine properties that are currently part of the First Avenue Substation. The eastern property, located at 835 First Ave W was purchased by Shakopee Public Utilities in 2014, which was most recently Mr. Pigstuff. The building was originally constructed as a Dairy Queen. The building has recently been razed. Cass Street was vacated in 1965 by referendum. The existing substation sits on the western half of the former Cass Street right-of-way. The City Council recently approved the transfer of ownership of the substation site from the City of Shakopee to Shakopee Public Utilities. The eastern portion of the Cass Street right-of-way is currently part of the former restaurant site. Discussion: The existing substation and expansion would be located on proposed Tract A, and proposed Tract B is currently Highway easement for County Road 69. The Board of Adjustment and Appeals approved a conditional use permit and variance for the expansion of the substation in 2014. The substation expansion involves construction of a electrical equipment for the substation and a storm water basin. Once the substation is completed, the substation will be screened by evergreen trees on the south side of the fenced area. Comments Received: The Engineering Department has commented that easements will need to be dedicated for existing infrastructure facilities as noted in the attached resolution. The Parks and Recreation Director has commented that Park Dedication will be required to be paid and the sidewalk along County Road 69 shall remain and be maintained. Recommendation: Staff is recommending approval of the request, subject to the conditions in the attached resolution. As you are aware,last year the City approved a Conditional Use Permit for the Commission to update and replace its substation equipment now located on the City owned parcel. The Commission acquired the vacant parcel adjacent to the east of the City parcel to also accommodate the new equipment. This was the parcel formerly owned by Mr.and Mrs. Plaisted that had been the location of the original Dairy Queen and other subsequent fast food restaurants. The Commission would like to consolidate the two parcels into one under a Registered Land Survey to accommodate the substation project. The new substation will replace not only SPU's equipment, but also the Xcel Energy equipment that is located to the west. • Attached is a copy of City Resolution#63 A Resolution Vacating Part of Cass Street adopted in May of 1965. Also attached is a Quit Claim Deed transferring the west half of the vacated Cass Street adjacent to Lot 5, Block 13,Shakopee Plat from Northern States Power to the City of Shakopee. This is the parcel that the Commission is now requesting be transferred from the City to the Commission. Also attached is a Quit Claim Deed with associated documents dated June 18,2002 transferring several other City owned parcels to the Commission as an example of what I believe is necessary to accomplish the current requested action. COPPNaIT2011.LEOIOS ENINEERNG NL NOTES RESERVED RESOLUTION NO. 7577 A RESOLUTION OF THE CITY OF SHAKOPEE, MINNESOTA,APPROVING THE REGISTERED LAND SURVEY FOR PROPERTY LOCATED AT 835 FIRST AVENUE WEST AND A VACATED PORTION OF CASS STREET WHEREAS, Shakopee Public Utilities, applicant and property owner, has submitted a request for approval of a Registered Land Survey for property that is located at 835 First Avenue West and a vacated portion of Cass Street; and WHEREAS,the property upon which the request is being made is legally described as: See Attached Exhibit; and NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SHAKOPEE,MINNESOTA,as follows: That the Registered Land Survey submitted by Shakopee Public Utilities is hereby approved, subject to the following conditions: 1. The applicant must work with the Engineering Department to dedicate the necessary drainage and utility easements for this project. The applicant is responsible for any legal and recording fees incurred by the City of Shakopee involving the preparation and recording of the easements. 2. The applicant must provide the Engineering Department with electronic files (CAD and PDF) of the subdivision. The CAD file shall be recorded with datum in the Scott County Coordinate System. 3. Prior to recording, Park Dedication fees for parcel areas not encumbered by drainage and utility or roadway easements must be paid in accordance with the current fee schedule. The current rate is $6,930 /net acre. The net area calculation for the site shall be submitted to the Parks and Recreation Director for fee calculation. 4. The existing sidewalk along County Road 69 shall remain and be maintained to City and County standards. BE IT FURTHER RESOLVED,that the Mayor and City Clerk are hereby authorized and directed to approve and accept said Registered Land Survey.
