SHAKOPEE TO: Mayor and City Council FROM: Kris Wilson, Assistant City Administrator DATE: 04/07/2015 SUBJECT: Memorandum of Understanding with Police Sergeants Union (E) Action Sought The Council is asked to authorize the appropriate officials to enter into the attached Memorandum of Understanding with Law Enforcement Labor Services, Local No. 279. Background Law Enforcement Labor Services (LELS), Local No. 279 represents the City's eight Police Sergeants. The City and LELS currently have a settled union contract covering calendar years 2014, 2015 and 2016. However, the contract contains what is known as "re-opener" language specific to Article 30: Special Duty Pay. That article states "The Union and the Employer agree that this article, and only this article, may be reopened at the request of either party during the term of contract in the event that the Department adds additional special duty assigments for the position of Sergeant." Effective March 9, 2015 the City has added the special duty assignment of Administrative Sergeant. The City and LELS have proceeded to negotiate additional compensation for this position in the amount of$200 per month. This agreement would be implemented through the signing of the attached Memorandum of Understanding and back pay will be provided to the Administrative Sergeant to the effective date of his appointment, which was March 9. Budget Impact The additional $200 per month in wages for a single employee can be accommodated within the Police Department's adopted operating budget for 2015. Recommendation I recommend that the Council authorize the appropriate officials to enter into the attached Memorandum of Understanding. Relationship to Vision A fair and competitive compensation structure for City employees contributes to Goal E: Deliver effective and efficient public services by a staff of well-trained, caring and professional employees. Requested Action The Council is asked to authorize the appropriate officials to enter into the attached Memorandum of Understanding with Law Enforcement Labor Services, Local No. 279. Attachments: Memorandum of Understaing for Administrative Sergeant Pav il MEMORANDUM OF UNDERSTANDING No. 2 BETWEEN CITY OF SHAKOPEE AND LAW ENFORCEMENT LABOR SERVICES, Local No.279 This Agreement is entered into between Law Enforcement Labor Services, Local No. 279 (Union)and the City of Shakopee(Employer): WHEREAS, Law Enforcement Labor Services Local 279 is the certified exclusive representative for Sergeants with the Shakopee Police Department;and WHEREAS,the parties have negotiated and agreed upon the terms and conditions of employment for bargaining unit employees through December 31,2016;and WHEREAS,the Employer has established the special duty assignment of Administrative Sergeant, effective March 9, 2015; WHEREAS,the parties mutually agree that this assignment imposes added duties and responsibilities warranting additional compensation; NOW THEREFORE,the Union and the Employer hereby agree that for the duration of the existing contract any employee assigned as the Administrative Sergeant will be paid an additional two hundred dollars($200) per month in Special Duty Pay.
