No. 7575 (B) Action Sought The Council is asked to offer Resolution No. 7575, a resolution approving the Final Plat for Shenandoah East First Addition, and move its adoption. Introduction Seefried Properties has submitted an application for Final Plat approval of property located north of 4th Avenue East, east of Shenandoah Drive, and south of CH101. The applicant is proposing to plat the 69.214 acre parcel as one (1) lot to accommodate an 855,000 square foot industrial building, with approx. 60,000 square feet of office space. The applicant has provided a site plan that includes over 1750 parking spaces and over 175 loading dock/semi-trailer parking spaces within a fenced truck court, accessible via a guard house/gate. The building and parking lot/sidewalks will cover 71% of the site, where 75% is the max. lot coverage for this property. There will be 2 accesses to/from the site each on Shenandoah Drive and 4th Avenue. There will be trails constructed along the north side of 4th Avenue, and along the east side of Shenandoah Drive. The building will have multiple mezzanine levels, with an overall height of 52' feet, and will be constructed of precast panels, utilizing 5 different colors, with substantial glass along the south elevation. Specific design and performance standards shall be reviewed at time of building permit, if this request is approved. That would include a review of the building materials, landscaping, parking lot(and curbing) design, trash and rooftop screening requirements, and other criteria(including lighting, noise, and odor regulations) as specified in the City Code. Several city departments and outside agencies have provided memorandums which note comments/conditions as a result of their review of the project. These memorandums have been attached to this report. The Engineering Department has reviewed the application and provided a memorandum that includes a significant number of conditions that have been incorporated into the draft resolution. Included with their memorandum is a reference that the applicant will obtain final approval of the storm water management plan prior to issuance of a grading permit and/or building permit. There are several storm water ponds proposed on this site, totaling over 7 acres in area. Shakopee Public Utilities provided a memorandum, noting that street lighting installation is available subject to their standard terms and conditions, and that they must pay the associated fees. They also commented on the water and electric service availability. Scott County Community Services reviewed the application, specifically commenting on proposed traffic improvements. Additional comments will be forthcoming, and City staff anticipate significant discussions with the County and the applicant's consultants regarding the proposed improvements. They additionally commented that any work proposed within the County right-of-way shall require a County permit, and no berming, landscaping, ponding or signage shall be permitted in the County right-of-way. The Director of Parks and Recreation provided a memorandum noting a number of conditions of approval, specifically noting construction of trails and sidewalks in compliance with the City Code regulations, and that park dedication fees will be required in an amount established by the City Code. The Natural Resources Technician provided a memorandum outlining requirements for tree replacement, and landscaping requirements based on the size of the building and parking lot. Securities will be required for the tree replacement and landscaping requirements, and detailed review of the proposed plantings and required sidewalks in the parking lot will occur at time of building permit review. Recommendation The Planning Commission reviewed the Final Plat of Shenandoah East First Addition at their May 7, 2015 meeting, and by a 6-0 vote, they recommended approval, subject to the conditions noted in Resolution No. 7575. The building will be constructed with conventional structural steel and insulated precast concrete wall panels. The project will contain approximately 60,000 sf of office area, 50 dock doors, 1,700 parking spaces with 90 spaces for trailer parking and fenced truck courts with a guard house at entry. Grading is defined as bringing the site to the proposed finished grade with materials deemed acceptable by the City of Shakopee engineering department, providing topsoil per City requirements and applying seed, mulch and/or sod per City requirements and providing an as-built record grading plan per Section 2.5 of the City of Shakopee Design Criteria. If the grading is not completed within one (1)year from the date of approval of the grading permit, a new permit will be required. 2. Should blasting techniques of rock formations be utilized, the grading permit and/or building permit applicant will be responsible to contact and inspect all nearby properties prior to the blasting operations. The applicant will be responsible for all damages caused by the blasting operations. 3. The applicant's storm water management plan will accommodate drainage from Shenandoah Drive and a three (3) lane urban design of 4th Avenue. The downstream system will adequately treat, control the discharge rate and infiltrate/filtrate this runoff per requirements set forth by the City of Shakopee's Comprehensive Water Resources Management Plan. 4. The applicant will work with the City of Shakopee engineering department to address storm water runoff from the northwest corner of this site. At this time, the downstream system is inadequate and will need to be upgraded. 5. The applicant will provide an adequate number soil samples/tests in close proximity of the infiltration systems to verify the infiltration rates of the existing soils. The system designs may need to be altered based on the results. 6. The applicant will provide wetland vegetation, native prairie vegetation or some other type of minimum maintenance vegetation below the approved high water levels of the storm sewer systems. 7. The applicant will provide adequate slopes in all areas designated as maintenance access points by the City Engineer. Access points will only be required in storm water systems encompassed by drainage and utility easements. 8. The applicant will provide reinforced turf (Geogrid or similar product) in all areas designated as maintenance access points by the City Engineer. The applicant will eliminate all curb cuts in storm water basins encompassed by drainage and utility easements. The curb cuts will be consolidated into one (1) flared end section outlet. 12. A certain amount of landscaping will be allowed in the filtration/infiltration areas encompassed by drainage and utility easements. However, the quantities and species will need to be approved by the City Engineer. The maintenance of this landscaping will be the responsibility of the property owner. 13. Landscaping will need to be adequately set back from all storm sewer structures, storm sewer pipe and maintenance access points encompassed by drainage and utility easements. 14. Landscaping will need to be removed from within the drainage and utility easement encompassing the existing trunk sanitary sewer line along the east property line. 15. The proposed 4th Avenue accesses will be aligned with the two (2) existing accesses along the south side of the roadway. 16. The applicant will install a bituminous trail along Shenandoah Drive and 4th Avenue. The minimum boulevard width is eight (8)feet. 17. The design of the bituminous trail along 4th Avenue will slope towards the roadway. The following item needs to be addressed/completed prior to issuance of a building permit: 1. If a grading permit is approved, record plans need to be provided per the City of Shakopee Design Criteria, Section 2.5 and Section 11.2 (A-L). The record plans need to be submitted to the engineering department. Both options assume a building size of 855,000 sf and 1,149,730 sf of impervious surface beyond the building pad. 1. A portion of the trees are preserved, resulting in a number of replacement trees between option 1 & 2. • Currently, there are 33 trees left on this site, 30 of which are white oak trees. 20 of these oaks are very larger(20+ diameter inches , 8 over 30"). These trees are located in 3 separate clusters on the NE side of the site which combined amount to less than 1 ac of the site. The City encourages you to preserve as many of these trees as possible, as it would be an asset to your site and the community. As seen in the tree replacement calculations, credits are received for preserving the trees. • With the number of tree installations/landscaping islands required on this site I would encourage you to look into the MN PCA Stormwater Manual as they offer stormwater credits for infiltration/retention in landscape islands. With this large employment generator, traffic and the impact to the regional County road system is a concern to the County. The County hired a consultant to provide technical assistance on reviewing the developer's traffic report that will be provided to the City and developer early next week. Some key findings are summarized below along with additional County comments. CH 101 and Shenandoah Drive • The Amazon Traffic Study recommended installing a traffic signal. The County agrees a signal may be needed in the future, but the need is not immediate. Reviewing the traffic data, it appears on the day of opening the traffic Amazon generates at this intersection will only meet the peak hour warrant for a signal and therefore not require a signal on the day of opening. However, the intersection should be monitored and intersection readied for future signal installation as traffic volumes increase. • The Amazon Traffic Study did not recommend any additional geometric improvements at the intersection of CH 101 and Shenandoah Drive. After reviewing the traffic study, we recommend • Installation of a future additional left turn lane to be installed on CH 101 at Shenandoah at the time of a traffic signal installation. This will accommodate the Amazon traffic and provide efficient signal operations. • To receive the left turning traffic, Shenandoah will need to remain a four lane road. • Installation of a median at the railroad tracks to prevent cross over traffic at the current four lane undivided roadway. • Any future traffic signal shall require interconnect between the two traffic control devices and provide preemptive signal timing with the railroad crossing. • The trail/sidewalk to be constructed along Shenandoah should extend north of the railroad crossing to CH 101 and meet ADA requirements. CH 83 and 4th Avenue • The Amazon Traffic Study recommended constructing a northbound left, southbound right, and eastbound right and left turn lanes. The County agrees with these recommendations. • There are several private accesses near this intersection that do not meet requirements of the County's access management policy and hinder the safety and efficiency of this intersection. These accesses need to be relocated. This will require a fourth leg to be added to the CH 83 and 4th Avenue intersection. The County's consultant will be preparing a sketch of the needed improvements at and near this intersection. Page 2 Amazon Plat • The Amazon Traffic Study recommended a signal at CH 83 and 4th Avenue. Reviewing the traffic data, it appears on the initial traffic projections at this intersection generated by the Amazon development will only meet the peak hour warrant for a signal and therefore not require a signal on the day of opening. However, the intersection should be monitored and intersection readied for future signal installation as traffic volumes increase. NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Shakopee,Minnesota that the final plat of Shenandoah East First Addition is hereby approved, subject to the following conditions: I) The following procedural actions must be completed prior to the recording of the Final Plat: A. City of Shakopee Resolution No. 7164 (Preliminary and Final Plat approval of Shenandoah East),recorded as Document No. T214034 in the Office of the Registrar of Titles, Scott County, Minnesota is rescinded. B. Approval of title by the City Attorney. C. Execution of a Developer's Agreement, which needs to include provisions for security for public improvements within the subdivision and payment of the Street and Utility Fee and the Watermain Fee. D. Payment of all Storm Water Management Plan Review Fees need to be made, as required by the most current City of Shakopee Fee Schedule. E. Payment of the Trunk Storm Water Charge needs to be made, as required by the most current City of Shakopee Fee Schedule. F. Provide electronic files (AutoCAD and Portable Document Format)of the Final Plat to be recorded with datum on the Scott County coordinate system. G. Regarding Park Dedication, given the location of the development, cash in lieu of land is recommended. Park dedication fees in the amount required by the City Code and adopted City fee schedule shall be paid at the time of recording of the final plat. Preliminary park dedication calculations(to be confirmed at time of final plat recording) are as follows: (Gross Acreage—Public utility easement(PUE)acreage) x $6,930/acre= Park Dedication required Based on current information(69.214 acres—PUE)X$6,930.00/acre= Max$479,653.02. The exact amount of acreage accepted by the City for public utility easements must be submitted to the Parks and Recreation Director for the exact Park Dedication calculation. H. Right-of-way, in the form of sight triangles fifteen(15)feet in dimension, will be provided at the intersection of Shenandoah Drive and 4th Avenue. A minimum of fifty(50) feet of right-of-way will be provided east of the centerline of Shenandoah Drive. J. Easements will be shown on the Final Plat as approved by the City Engineer. They include, but are not be limited to,the following: • Minimum drainage and utility easements for public sanitary sewer and storm sewer need to be dedicated per the City of Shakopee Design Criteria, Section 10.1 (A-D). • The applicant will provide a minimum of ten(10) feet of drainage and utility easement adjacent to all lot lines. • Provide a minimum of eleven(11) feet of drainage and utility easement west of the centerline of the existing trunk sanitary sewer along the east property line. • The applicant will provide adequate drainage and utility easements along the Shenandoah Drive storm sewer system to encompass all drainage from public rights-of-way. The easements will encompass flows resulting from the approved 100-year high water levels. • A bituminous trail easement will be required for portions of trails outside of the Shenandoah Drive and 4th Avenue rights-of-way. II) The following items need to be addressed/completed prior to approval of a grading permit and/or a street and utility plan: A. No public improvements(site grading and street and utility)will be constructed until the City Engineer and the Shakopee Public Utilities (SPU) approves the required storm water management plan,the storm water pollution prevention plan,the grading and erosion control plan and the street and utility plan. B. The applicant will grade the entire site, as proposed on the approved plans, in one phase within one (1)year from the date of approval of the grading permit application. Grading is defined as bringing the site to the proposed finished grade with materials deemed acceptable by the City of Shakopee engineering department, providing topsoil per City requirements and applying seed, mulch and/or sod per City requirements and providing an as-built record grading plan per Section 2.5 of the City of Shakopee Design Criteria. If the grading is not completed within one(1)year from the date of approval of the grading permit, a new permit will be required. C. Should blasting techniques of rock formations be utilized,the grading permit and/or building permit applicant will be responsible to contact and inspect all nearby properties prior to the blasting operations. The applicant will be responsible for all damages caused by the blasting operations. D. The applicant's storm water management plan will accommodate drainage from Shenandoah Drive and a three(3)lane urban design of 4th Avenue. The downstream system will adequately treat, control the discharge rate and infiltrate/filtrate this runoff per requirements set forth by the City of Shakopee's Comprehensive Water Resources Management Plan. E. The applicant will work with the City of Shakopee engineering department to address storm water runoff from the northwest corner of this site. At this time,the downstream system is inadequate and will need to be upgraded. F. The applicant will provide an adequate number soil samples/tests in close proximity of the infiltration systems to verify the infiltration rates of the existing soils. The system designs may need to be altered based on the results. G. The applicant will provide wetland vegetation,native prairie vegetation or some other type of minimum maintenance vegetation below the approved high water levels of the storm sewer systems. H. The applicant will provide adequate slopes in all areas designated as maintenance access points by the City Engineer. Access points will only be required in storm water systems encompassed by drainage and utility easements. I. The applicant will provide reinforced turf(Geogrid or similar product) in all areas designated as maintenance access points by the City Engineer. J. Class IV fieldstone riprap will be placed at each flared end section outletting to the storm sewer systems encompassed by drainage and utility easements. The riprap will be placed to the bottom of each system. K. Class IV fieldstone riprap will be placed at each of the two(2)ultimate outlets of the site. L. The applicant will eliminate all curb cuts in storm water basins encompassed by drainage and utility easements. The curb cuts will be consolidated into one(1)flared end section outlet. M. A certain amount of landscaping will be allowed in the filtration/infiltration areas encompassed by drainage and utility easements. However,the quantities and species will need to be approved by the City Engineer. The maintenance of this landscaping will be the responsibility of the property owner. N. Landscaping will need to be adequately set back from all storm sewer structures, storm sewer pipe and maintenance access points encompassed by drainage and utility easements. 0. Landscaping will need to be removed from within the drainage and utility easement encompassing the existing trunk sanitary sewer line along the east property line. P. The proposed 4th Avenue accesses will be aligned with the two(2) existing accesses along the south side of the roadway. Q. The applicant will install a bituminous trail along Shenandoah Drive and 4th Avenue. The minimum boulevard width is eight(8)feet. R. The design of the bituminous trail along 4th Avenue will slope towards the roadway. S. The survey of existing conditions received with the application needs to be updated. The submittal is missing 10 significant trees on the eastern portion of the site. T. Per Resolution No. 7164,this property is required to plant 278 replacement trees due to removal of 834 trees which took place previously to prepare the site for development. This replacement is based on the previous Tree Management Regulations(Sec 11.60 Subd. 9.)which was in place prior to June 5th, 2014. Any tree removal going forward on this site shall meet the requirements set in said ordinance. a. Currently there are 33 trees left on this site, 30 of which are large oak trees. Removing all of the existing trees would require 54 replacement trees in addition to those required in Resolution No. 7164. If the Applicant preserves all existing trees, 109 credits would be applied to the landscaping requirements reducing the number of required trees, per the current Landscaping Requirements. U. A financial security in form of cash escrow or letter of credit must be issued to the City for this tree removal. The tree replacement financial security=number of required replacement trees*$200*150%. This security shall be released in accordance with the current Landscaping Requirements. V. If the number of plantings can not be met on site the following is required: a. A cash payment of$400.00 per replacement tree shall be provided to the City to complete other vegetative or environmental alternatives. W. Street lighting installation shall be installed consistent with the current City of Shakopee Street Lighting Policy,with the applicant to pay the associated fees. Plans identifying the design for and installation of lights on these streets shall be submitted to the City of Shakopee and Shakopee Public Utilities for their review and approval. X. The developer should implement the use of Best Management Practices for erosion control and stormwater management during construction. III) The following procedural actions must be completed prior to the issuance of a building permit: If a grading permit is approved,record plans need to be provided per the City of Shakopee Design Criteria, Section 2.5 and Section 11.2 (A-L). The record plans need to be submitted to the engineering department. B. Any work proposed within the County right-of-way shall require a County permit. C. No berming, landscaping, ponding or signage shall be permitted in the County right-of-way. D. The applicant submitted a storm water management plan that was reviewed by engineering staff and WSB & Associates, Inc. The applicant will obtain final approval of the storm water management plan. E. The Applicant must have a landscape plan approved by the City Engineer which meets the City's current Landscaping Requirements(Sec 11.60, Subd. 8.), as well as in compliance with the most recent version of the City of Shakopee Easement, Fencing and Landscaping Policy. This submittal shall occur at time of building permit submittal. Replacement trees are required to be planted as follows: a. A minimum of four feet from impervious surfaces. b. Not in City owned right-of-way. c. Not below overhead utilities. d. No planted tree species shall comprise more than 30% of the total quantity of trees to be planted on the site. e. Consistent with the Shakopee Tree Planting Guidelines. f. Ash(Fraxinus sp.) and Colorado Blue spruce(Picea pungens) are not allowed to be planted. IV) Following approval and recording of the final plat, the following conditions shall apply: A A public 12"water main is required to be installed along Shenandoah Drive north from 4th Avenue and west across Shenandoah Drive so that the water main can be looped across the neighboring property to the existing stub located at the northeast corner of the SPU Service Center site. B. Building construction, sewer,water service,fire protection and access shall be reviewed for code compliance at the time of building permit application(s). C. The developer and/or their assigns shall be responsible for any required or desired noise or dust mitigation measures.
