No. 7576 (B) Action Sought The Council is asked to offer Resolution No. 7576, a resolution approving the Final Plat of Valley Park Business Center 3rd Addition, and move its adoption. Discussion Opus Development Company, LLC has submitted an application for final plat approval of Valley Park Business Center 3rd Addition. The plat (presently Outlot A, Valley Park Business Center 2nd Addition) proposes the creation of one new lot (19.58 acres), with the balance to remain as an outlot (8.80 acres). The subject property is located southwest of the intersection of Innovation Boulevard and Innovation Drive. The applicant is proposing the creation of this lot to accommodate the construction of a building that will be utilized for office and warehouse space. The facility is proposed to be approximately 216,000 square feet in size, with the potential for another 146,000 square feet of expansion. Staff did receive comments from City Engineering, SPUC, Parks & Recreation, and Natural Resources. Their comments have been incorporated into the draft Resolution for the Council's consideration. The conditions include references to drainage and utility easement requirements and park land dedication fees. Relationship to Vision This action supports: Goal B: Positively manage the challenges and opportunities present by growth, development and changes. Attachments: Resolution No. 7576 Final Plat Concept Plan Grading & Utilities Plans Engineering Memo Natural Resources Memo Parks Memo RESOLUTION NO. 7576 A RESOLUTION OF THE CITY OF SHAKOPEE,MINNESOTA APPROVING THE FINAL PLAT OF VALLEY PARK BUSINESS CENTER THIRD ADDITION WHEREAS,Opus Development Company,LLC,applicant and property owner, has made application for final plat approval of Valley Park Business Center Third Addition; and WHEREAS,the subject property is legally described as: Outlot A, Valley Park Business Center Second Addition, Scott County; and WHEREAS, the City Council reviewed the final plat on May 19, 2015. NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Shakopee, Minnesota that the final plat of Valley Park Business Center Third Addition is hereby approved subject to the following conditions: I) The following procedural actions must be completed prior to the recording of the Final Plat: A. Approval of title by the City Attorney. B. Provide electronic files (Auto CAD and Adobe Acrobat formats of the Final Plat to be recorded with datum on the Scott County coordinate system. C. Payment of park dedication fees in the amount required by the City Code and adopted City fee schedule. That amount equals the area of the dedicated lot minus public utility easement area, calculated at $6,930/acre. Park dedication fees will be required for the remaining outlot at time of Final Platting of that lot. D. Easements will be shown on the Final Plat as approved by the City Engineer. They include, but are not be limited to,the following: • Minimum drainage and utility easements for public sanitary sewer and public storm sewer need to be dedicated per the City of Shakopee Design Criteria, Section 10.1 (A-D). The easements need to be centered on the public utility alignments. • Should a retaining wall be proposed along the west property line, the design will allow for a minimum of ten (10) feet of useable drainage and utility easement. • Provide a 10 foot utility easement for use for future underground electric cables running east to west across the plat. The location of this easement shall be approved by SPUC and City Engineering. This review is preliminary, as more comments will follow with additional submittals. However, the engineering department offers the following comments at this time for the applicant and for the planning department: General Conditions The following item needs to be completed prior to release of the Final Plat for recording: 1. Provide electronic files (AutoCAD and Portable Document Format—PDF) of the Final Plat to be recorded with datum on the Scott County coordinate system. The following items need to be addressed/completed prior to approval of a grading permit and/or a building permit: 1. The applicant will grade the entire site, as proposed in the approved plans, in one (1) phase within one (1)year from the date of approval of the grading permit application. 2. The applicant will obtain a National Pollutant Discharge Elimination System (NPDES) construction site permit prior to any land disturbing activity. If bituminous trails and/or concrete sidewalks are to be constructed as part of this development, the applicant will install all the necessary pedestrian curb ramps. Curb ramp locations will be determined by the City Engineer. 4. The applicant will provide a landscaping plan in compliance with the City of Shakopee's Easement Fencing and Landscaping Policy. 5. The applicant will submit a detailed impervious surface drawing. 6. The Trunk Storm Water Charge will be paid, as required by the most current City of Shakopee Fee Schedule. This charge is due at the time of building permit issuance. Final Plat Conditions The following items need to be addressed/completed prior to release of the Final Plat for recording: 1. Easements will be shown on the Final Plat as approved by the City Engineer. Storm Water Management Plan Review The existing storm water basin located on Lot 1, Block 1 of the Valley Park Business Center 15t Addition is designed to accommodate runoff from this site. Therefore, no additional storm water management controls are required. Recommendation Engineering staff recommends approval of the Final Plat application subject to the conditions above being addressed/completed by the applicant. This property is not within a Natural Resources Corridor, therefore the City's Tree Preservation Ordinance (Sec 11.60 Subd 9.) does not apply. 2. Applicant is required to have a landscaping plan approved by the City before the building permit is issued, which meets the City's Landscaping Requirements (Sec 11.60 Subd. 8.). At the time of recording of final plat: 1. Park Dedication Given the location of the development, cash in lieu of land is recommended. 2. Park dedication fees in the amount required by the City Code and adopted City fee schedule shall be paid at the time of recording of the final plat. 3. Preliminary park dedication calculations (to be confirmed at time of final plat) are as follows: (Gross Acreage— Public utility easement (PUE) acreage) x $6,930/acre = Park Dedication required Based on current information (19.58 acres— PUE) X $6,930.00/acre = Max $135,689.40. (Lot 1, Block 1 only) 4. The exact amount of acreage accepted by the City for public utility easements, if any, must be submitted to the Parks and Recreation Director for the exact Park Dedication calculation.
