SHAKOPEE TO: Economic Development Authority FROM: Samantha DiMaggio, Economic Development Coordinator DATE: 05/19/2015 SUBJECT: Acquisition of 234 1st Avenue West Background The property located at 234 1st Ave. West is a former gas station and convenience store that is currently owned by Scott County as a result of tax forfeiture. The County has already paid to remove both the underground gas tanks and the above ground gas pumps from the site and the parcel has been enrolled in theMinnesota Pollution Control Agency (MPCA) Petroleum Brownfields Program (see attached letter). The County is preparing to offer the property for sale and has given the City the first option to purchase. Located at the corner of 1st Ave. and Atwood St., the 0.44 acre property sits on the edge of downtown and approximately two blocks east of the location where Rahr Malting is making a significant investment in new buildings. In its current state, the property appears to be a likely candidate for yet another used car lot or similar operation. However, with the other planned redevelopment in the corridor and increased traffic once the 101 bridge project is complete, there could be a higher and better use of the site. For example, the Laurent Building, which sits on the eastern corner of this same block, has an assessed value of$575,000 and is home to multiple businesses and jobs. Similarly, a once vacant lot on the other end of 1st Avenue was recently purchased and became the home of a new dental office -- contributing valuable tax base,jobs and economic activity to the corridor. The Planning Commission has found acquisition of this property to be consistent with the 2030 Comprehensive Plan and the EDAC has made a recommendation that the EDA acquire this property. Action Sought Adopt a motion authorizing the acquisition of 234 1st Avenue West for $106,626 from the Property Acquisition and authorizing the appropriate EDA officials to execute the necessary documents to finalize the acquisition. Based upon our review of the information contained in the above documents,MPCA staff has concluded that four petroleum storage tanks from which the release occurred have been removed from the Site. The removed underground storage tanks(UST)included three 5,000-gallon gasoline UST(s)and one 4,000-gallon gasoline UST. Due to the fact that the tank(s)from which the release occurred has been removed,the Commissioner of the MPCA has determined that the City of Shakopee will not be a responsible person as defined in Minn.Stat. §115C.021(2014),for any release from these tanks.The Commissioner is authorized to make this determination under Minn.Stat.§115C.03,subd.9(c)(2014). This determination extends to the heirs and assigns of the person to which it originally applies,if the heirs and assigns are not otherwise responsible for the release. This letter represents the views of the MPCA,and is based upon information disclosed to the MPCA as of the date hereof.This letter should not be construed to release persons who are"responsible persons" under Minn.Stat.§115C.021(2014)from liability for petroleum storage tank releases,which have originated at the Site.Issuance of this letter does not imply that petroleumstorage tanks are not present at other locations on the Site. Today, Amazon.com is a publicly traded an e-commerce platform for retailers and more than 2 million third-party sellers offering millions of unique, new, refurbished and used items. The company currently has fulfillment and customer service center locations in 18 states, including neighboring states North Dakota, South Dakota and Wisconsin, and it employs approximately 157,000 people worldwide. Amazon.com is considering leasing a new, build-to-suit building in Shakopee that would be located on 65.93 acres at the northeast corner of Shenandoah Ave. and 4th St. The proposed building would be 850,000 square feet. and would result in an increased tax base and job creation for the City of Shakopee. If granted the requested assistance, Amazon.com and its selected developer would begin construction on the building this spring with anticipated completion by fall of 2016. The proposed TIF district has been reviewed by Springsted, the City's financial consultant, and its analysis is attached for review. This proposal reflects the establishment of an 90% economic development TIF district which over the 9-year term would generate a maximum amount of$5,766,414. The State Auditor will retain $20,760 for administrative costs which leaves the tax increment available for distribution $5,745,654. The recommended allocation of these funds are as follows; •$3,379,250 to Scott County for infrastruction improvements to County Rd. 83 and County Rd. 101. •$473,280 to the City of Shakopee for administrative costs and TIF pooling which will be used to fund out of district infrastructure improvements which the City plans to use on 4th Avenue. •$650,000 to the City of Shakopee for is for in district infrastructure improvements which the City plans to use for infrastructure improvements to 4th Avenue. St-iAKoi i E TO: Mayor and City Council FROM: Jamie Polley, Parks & Recreation Director DATE: 05/19/2015 SUBJECT: Quarry Lake Park Large Shelter Design (A, B) Action Sought The City Council is asked to approve the design for the future large shelter at Quarry Lake Park as recommended by the Park and Rec Advisory Board (PRAB). Background On September 2, 2014 the City Council authorized a contract with WSB & Associates to design Quarry Lake Park, develop plans and specifications, bid the project and conduct construction administration. As part of the contract, WSB hired Hagen, Christensen & Mcllwain Architects (HCM) to design the buildings and develop plans and specifications for the buildings. On December 16, 2014 the City Council approved the final concept plan for the park and authorized the development of the final plans and specifications. On December 2, 2014, staff discussed the vision for a the large shelter with the City Council during a work session. The Council directed staff to design the large shelter as a fully-enclosed, multi-purpose shelter that could be used for rentals, events, programs and classes. The City Council commented that the second, smaller shelter should be similar to the shelters currently constructed throughout the City with the possibility of restrooms. The development timeframe of Quarry Lake Park has been extended one year. This extension will allow staff and the consultants to properly design the large park and to work closely with all of the interested parties surrounding the park. One of the items needed to continue with the final design of the park is approval of the concept plan and footprint for the large shelter. The shelter may be constructed as a second phase to the park, however, without knowing the plan for the shelter, the design of the surrounding ground work including trails and parking cannot be completed. Staff asked to design a building that included natural elements that might resemble the quarry as well as industrial elements such as steel beams that represented some of the surrounding buildings. Also, per the City Council discussion, further direction was given to utilize materials that fit well with or resemble other City park shelters. HCM presented staff with a number of ideas based on existing facilities. From that HCM developed two distinct designs for the shelter. On April 13, 2015 the PRAB reviewed the two design concepts for the shelter. The first concept is called Scheme A and is based off of the shelters at Huber Park. This concept includes a gable roof, two building sections, large gathering space, large windows and brick, wood and limestone features. The second concept is called Scheme B and depicts a more industrial style look. This concept includes a more modern roof, is one large foot print, large gathering space, steel beams and has limestone and wood features. Both concepts include two restroom areas, a catering kitchen, storage, small meeting room, mechanical room, large windows to view the lake and a seating area for 150-300 people. (The size of the seating area is yet to be determined and does effect the overall cost of the building.) The restrooms include one restroom that is accessible to the public that are using the park and one restroom that would be used by the building users. The PRAB is recommending Scheme B to the City Council. The PRAB favored this concept for its unique/distinct look, large windows and the feeling that users will be proud to have an event there. Many of the members think that since Quarry Lake will be such a unique park that the building should also be unique. During the discussions regarding Scheme B, PRAB members questioned how the roof would drain to avoid runoff into the lake and how the sun would effect the heating and cooling of the shelter during the day. Other comments from members of the also included depicting more plantings around the shelter and rotating the shelter about 45 degrees. Staff met with the architects on May 6 to discuss these comments. The architects have added a roof drain system that will direct water to down spouts in specific areas that will drain into rain gardens or other holding areas. HCM also did a simulation on the sun's movement throughout the day during the summer and winter solstice. During the winter, when the sun is lower, more light will come directly into the building and will assist with warming the facility. Shades may be desired at a later date. During the summer, when the sun is higher, the simulations show no sun coming directly into the large meeting area which is shaded by the overhang. This will assist in keeping the area cooler. The shelter is planned to have heating and air conditioning. Finally, the architects included more plantings and rotated the shelter 45 degrees as the Scheme A had shown. Staff is seeking Council's approval of this revised Scheme B concept, design and footprint for the shelter. When the time comes to construct the shelter, the concept and cost estimates will be brought back to the City Council for comment and authorization prior to moving forward with the bidding and construction of the shelter.
