SHAKOPEE TO: Mayor and City Council FROM: Bruce Loney, Public Works Director DATE: 05/06/2015 SUBJECT: Request for Extended Work Hours and Lane Closure on the Rahr Malting Malthouse #6 (D) Action Sought The Council is asked to approve a suspension of City Code Sec. 10.60, Noise Elimination and Noise Prevention, Subd. 3, Hourly Restrictions on Certain Operations, D, allowing continuous construction work (24 hours per day) on Rahr Malting's Malthouse #6 starting July 6 for 2 1/2 weeks and from August 24th to September 5th to expedite the work and to direct staff to publish notice of the suspension with the conditions as recommended by staff The Council is also asked to approve a lane closure on 3rd Avenue as depicted on the attached drawing, contingent upon the appropriate traffic control signage for the lane closure and detour as approved by the Public Works Director. Background Rice Lake Construction Group has requested that City Code Sec. 10.60, Noise Elimination and Noise Prevention, Subd. 3, Hourly Restrictions on Certain Operations, be suspended for certain work hours associate with construction of Rahr Malting's Malthouse #6. The above named section of the City Code restricts the hours of operation from 7:00 A.M. to 10:00 P.M. on weekdays, and from 9:00 A.M. to 9:00 P.M. on weekends and holidays. Rice Lake Construction Group is requesting suspension on the hours as per the attached letter to allow for work twenty-four hours a day beginning July 6, 2015 for 2 1/2 weeks and for.another continuous operation starting August 24th to September 5, 2015. This request is needed due to the slip forming process. Staff would recommend that if the suspension of hours is granted, that the approval be subject to the following conditions: 1. Approval is contingent upon minimizing noise exposure. 2. If property owner complaints are received by the City, the suspension can be revoked at the discretion of the Public Works Director. If Council approves the suspension, a public notice to meet the City Code requirements and notice such as a news release would be placed in the Shakopee Valley News. Also, Rice Lake Construction Group is asking for a lane closure on 3rd Avenue by the construction site in order to efficiently handle construction traffic. A traffic control plan with appropriate signage needs to be submitted and approved by the Public Works Director. The lane closure is expected to last for most of the project. Recommendation Staff recommends approval of the requested items. Budget Impact There is no impact on budget. Hourly restrictions on Certain Operations. The new construction of Malt House No.6 for the Rahr Malting Company will be performed with a slip forming process which requires continuous operation while erecting the main building structure. The project is currently scheduled in two phases with the first slip forming phase occurring on or around July 6th and completing in 2-1/2 weeks. During this time there would be construction operations around the clock until the slip forming has been completed. The second phase of the slip forming for the Kiln tower would start on August 24th and be completed by September 5th, again construction activities occurring around the clock. The noise levels during the extended hours of operation should be no greater than the current Rahr Malting facility operation. Along with the noise ordinance variance we are also requesting the following lane closure of Third Street adjacent to the construction site parameters in order to efficiently handle construction traffic. We have reviewed the proposed lane closure along with potential impacts to neighboring properties. I have also met and discussed this plan with Pat Huber of the Palmer Bus Co.
