SUBJECT: Transfer of Land to Shakopee Public Utilities (D)
Action Sought
The Council is asked to authorize the appropriate City officials to sign the attached
quit claim deed transferring ownership of the City owned parcel that is the western
half of the vacated Cass St. north of 1st Ave. to Shakopee Public Utilities.
Background
The attached letter was received from the Shakopee Pubic Utilities Commission
(SPUC) recently. It asks that the City transfer formal ownership of a small parcel
of land on the north side of 1st Ave. that is the current site of SPUC's substation
equipment.
In 2002 the City transferred ownership of several parcels of land from the City to
SPUC. These parcels were already in use by SPUC and there seemed to be no
reason for the City to continue to be the legal owner. However, it appears that the
parcel now in question was forgotten at that time.
It has come to light now as SPUC has acquired the parcel to the east and is
attempting to consolidate the two parcels, but must have ownership of both in order
to do so.
Budget Impact
There is no cost to the City for this action.
Relationship to Vision
This item corresponds to Goal D: Maintain, improve and create strong partnerships
with other public and private sector entities.
Recommendation
I recommend that Council authorize the requested transfer of ownership.

The Council is asked to authorize the appropriate City officials to sign the attached

RE: City Owned Parcel West Half of Vacated Cass Street North of First Avenue
Dear Kris:
Please accept this letter as a formal request to the City Council to transfer title to the above described
City owned parcel that has been the site of the Commission's Shakopee Substation for the past fifty
years.
As you are aware, last year the City approved a Conditional Use Permit for the Commission to update
and replace its substation equipment now located on the City owned parcel. The Commission acquired
the vacant parcel adjacent to the east of the City parcel to also accommodate the new equipment. This
was the parcel formerly owned by Mr.and Mrs. Plaisted that had been the location of the original Dairy
Queen and other subsequent fast food restaurants. The Commission would like to consolidate the two
parcels into one under a Registered Land Survey to accommodate the substation project. The new
substation will replace not only SPU's equipment, but also the Xcel Energy equipment that is located to
the west.
Attached is a copy of City Resolution#63 A Resolution Vacating Part of Cass Street adopted in May of
1965. Also attached is a Quit Claim Deed transferring the west half of the vacated Cass Street adjacent
to Lot 5, Block 13,Shakopee Plat from Northern States Power to the City of Shakopee. This is the parcel
that the Commission is now requesting be transferred from the City to the Commission.
Also attached is a Quit Claim Deed with associated documents dated June 18,2002 transferring several
other City owned parcels to the Commission as an example of what I believe is necessary to accomplish
the current requested action.
