Site Information Applicant: R.J. Ryan Construction, Inc. Property Owner: Rahr Malting Corporation Location: 500 — 700 Block of 1st Avenue West Current Zoning: Highway Business (B-1) Zone Adjacent Zoning: North: Agricultural Preservation (AG) Zone/Minnesota River South: Heavy Industry (I-2) Zone East: Highway Business (B-1) Zone West: Highway Business (B-1) Zone Comp. Plan: Mixed Use Lot Size: 7.293 Acres Introduction R.J. Ryan Construction, Inc. has made application on behalf of Rahr Malting Corporation for a Rezoning of property from Highway Business (B-1) Zone to Heavy Industry (I-2) Zone, a Conditional Use Permit to allow Overheight Structures, and a Preliminary & Final Plat, as part of a proposal to construct an office/warehouse for their business. The subject property is located north of 1st Avenue West, South of Spring Street, west of Scott Street, and east of Clay Street (see attached aerial/location map). Attached are the applicant's descriptive narratives and site/landscape plans for this proposal. The nature of the operation is to construct an 80,000 sq. ft. distribution warehouse, with receiving and processing/packaging of malt for their operations. The overheight elements of this structure are storage bins and a bucket elevator conveyance which will be no more than 70 feet in height. If you note the elevation, the bins and unloading system will not be that visible from 1st Avenue, as these elements are located on the north side of the building and are proposed to sit at a lower elevation than the building. Should this CUP request be approved, building permits will need to be submitted for review and approval. Planning staff did receive comments from several reviewing agencies, with Centerpoint Energy provided comments regarding services to the site, similar to those that had been submitted regarding the recent Vacation of Easements and Public Rights-of-Way. They raised objection to the request, unless Rahr were to make suitable arrangements with them by reimbursing them the cost of relocating the existing 2' distribution natural gas main, and provide the necessary easements. The applicant and Centerpoint have tentatively agreed to a realignment and have drafted a document pertaining to this agreement. Staff has also received memorandums from City Engineering, Parks & Recreation, and the Natural Resources Technician, which are attached to this report. Additionally, staff received comments from SPUC, which noted that concerning electric, the project will result in SPUC having to relocated its existing overhead feeder and lateral circuits to a mutually agreeable path around the building within a 10 foot wide easement; and concerning water, the project will require a looped 8" water main to be constructed between 1st Avenue/Scott Street and Pierce Street, and the alley north of 1st Avenue within a 20 foot wide easement. The City Finance Dept. commented that one of the properties recently purchased by Rahr (122 Pierce Street N.) has an assessment of$145.66 that is subject to payment to the City prior to recording the Final Plat. The proposed Plat complies with the required design standards for Heavy Industry (I-2) Zoned properties, provided the conditions as identified by staff are incorporated into the Final Plat prior to recording. The structure, as proposed, appears to comply with the design standards of the I-2 Zone as well, which will be reviewed and verified as part of a building permit application. Recent discussions between Scott County, SPUC, the City and Rahr have resulted in a revised site layout, which is identified on the site plan (dated Feb. 25, 2015) and revised grading plan (dated March 9, 2015). This revision results in a new 30' driveway that will provide access to Scott Street rather than directing the truck traffic directly via a driveway to 1st Avenue. The applicant will be further developing plans to address changes to the utility, grading, tree replacement and access details. Compliance with the draft conditions of Resolution No. 7560 will be reviewed by staff prior to recording of the final plat, and/or prior to time of building permit submittal. The change to the access does not directly impact the overheight structures, the rezoning, nor the Plat. Following is an outline of the direction discussed for access to the Rahr plat from Scott Street to the western terminus of the existing alley. There appears to be three options for creating an eastern access to the new warehouse via Scott St.: 1. Improve and have the City maintain a public alley. 2. Vacate the alley—resulting in ownership of the northern half falling to Rahr and allowing Rahr to construct a new driveway slightly to the north of the existing alley. 3. Retain the existing alley as is and have Rahr construct a new driveway parallel to the alley to meet their needs. City staff is inclined to recommend to the Council option #1, including: A. The City would retain the existing alley right-of-way; B. Rahr would dedicate additional right-of-way to the City to allow for the construction of a 26 ft. to 30 ft. improved public alley (design of which would ultimately be approved by the City Engineer); C. Rahr would construct the alley as a public improvement under the Developers Agreement; D. The alley design would provide access for the adjoining properties (owned by Total Partners LLC & Choice 100 LLC) to the north, and all utilities would be placed underground as a part of the improvement project at the expense of the utility companies; In the vicinity of where the public alley ends and Rahr's private driveway begins, Rahr would provide a private access easement to the owner of the Total Rental parcels so that they could access the parking lot parcel on the west side of the Total Rental building. The benefits to this option include: 1. Allows the parcel to the north to retain as many trees as possible. This also allows the potential for the parcel to be redeveloped in the future if Rahr chooses to sell it. 2. Maintains the access for the 4 parcels that Rahr does not currently own and provides for the future potential redevelopment of these parcels at a later date. The westerly parcel owned by Total Partners LLC still requires an access agreement due to the past vacation of that portion of the alley. 3. Current utilities are able to be consolidated easier by the City as the length of the alley is at or greater than 300 feet. This should relieve Rahr from much of the cost associated with utility relocation. 4. Creates a stronger incentive for Scott County to aide in the project cost as it benefits a public alley vs. a private drive (even if they had access easements, the case is stronger for the public access). 5. With the alley remaining public, Rahr is not responsible for the maintenance or upkeep. Additionally, the following is information provided by Shakopee Public Utilities (SPU), and should be incorporated into discussions concerning design improvements for this area: A. If an improved public right of way is so ordered by the Council, SPU would place their overhead wires underground and remove their power poles that are now on the north side of the 16 foot alley (and presumably Century Link would have to do the same with their pole and cables and Comcast would have to do the same with their cables). B. SPU would then have to place on the ground south of the alley and a minimum of five behind the curb (and even then protective bollards may be required) pad mounted equipment; i.e. a three phase feed thru cabinet and two single phase transformers to serve the Total Rental and Choice buildings. A 10 x 10 foot easement area on Choice property may be necessary for the pad mount equipment. It is noted that this is becoming similar to the mid 1990's project to improve something like 7 alleys and underground SPU's power lines in the downtown business district. C. SPU would also have to install some underground secondary from those transformers to two poles to be located on the north side of each building and south of the alley, possibly with guying issues to the north to attach the existing overhead secondary services to maintain electric service. Again, perhaps an easement for the two poles could be obtained from the property owners to allow the poles to be placed far enough south to allow for the necessary guying to the north. SPU would also install underground primary cables as a part of a lateral circuit to energize the transformers. D. Finally, SPU would install a(separate) concrete duct bank under the alley pavement for the existing primary feeder circuit with capacity to add future feeder circuits. The duct bank location would need to be coordinated with the other infrastructure in the corridor such as the public water main, storm sewer and the above described small utilities. Considerations— Conditional Use Permit City Code Sections 11.46 (Heavy Industry Zone), Subd. 3 (Conditional Uses) L (structures over 45 feet in height) and Section 11.88 Subd. 2. AA. provides guidelines for development of this property, of which two (2) are listed as conditions of approval in the draft resolution. Section 11.88, Subd. 2.AA. lists the specific standards for structures over the specified height, as follows: 1.shall submit a map showing shading patterns created by the over height structure; and 2.shall be set back from each property line a distance equal to half the structure height. The structure as proposed would meet the requirement for setback, and the shadows cast by this proposed structure would not negatively impact adjacent properties. The current applicant owns a significant amount of land in all directions from the segment of the structure proposed to be overheight, and it is a very minimal segment of building that is overheight. Findings— Conditional Use Permit The criteria required for the granting of conditional use permits are listed below with staff findings. Criteria#1 The use will not be injurious to the use and enjoyment of other property in the immediate vicinity for the purposes already permitted, nor substantially diminish and impair property values within the immediate vicinity; Finding #1 Staff has received no evidence that the proposed over height storage bins and bucket elevator conveyance will be injurious to the use and enjoyment of other property in the immediate vicinity, nor would it substantially diminish or impair property values in the area, provided the conditions of the resolution are met. Rahr Malting Corporation owns the property adjacent to this proposed structure. Criteria#2 The establishment of the conditional use permit will not impede the normal and orderly development and improvement of surrounding vacant property for uses allowed in the area; Finding #2 The conditional use permit, as proposed, will not impede future development and improvement in the area, provided the conditions of the resolution are met. The privately owned properties west of this project area have the same access to Clay Street and 1st Avenue as they have had in the past. Criteria#3 Adequate utilities, access roads, drainage and other necessary facilities have been or will be provided; Finding #3 Adequate utilities, access roads and drainage are provided or will be provided at the site. Criteria#4 The use is consistent with the purposes of the zone in which the applicant intends to locate the proposed use; and Finding #4 The use of the subject property is consistent with the purposes of the proposed Heavy Industry (I-2) Zone. Criteria#5 The use is not in conflict with the Comprehensive Plan. Finding #5 The use is not in conflict with the Comprehensive Plan. Findings - Rezoning The criteria required for the granting of a Zoning Ordinance Amendment are listed below for the Council's consideration. Criteria#1 That the original Zoning Ordinance is in error; Finding #1 The original Zoning Ordinance is not in error. Criteria#2 That significant changes in community goals and policies have taken place; Finding#2 Significant changes in community goals and policies have taken place. The most recent adopted Comprehensive Plan guides this area for Industrial and Mixed Use development in order to allow for flexibility in development along this corridor. Criteria#3 That significant changes in City-wide or neighborhood development patterns have occurred; or Finding #3 Significant changes in development patterns have not occurred. Development has occurred and is proposed consistent with the intent of the Comprehensive Plan. Criteria#4 That the comprehensive plan requires a different provision. Criteria#4 The request is consistent with the Comprehensive Plan guiding and would bring the zoning into compliance with the Comprehensive Plan. Staff Recommendation After evaluating the request against the stated criteria for a Rezoning and Conditional Use, Staff recommends that the City Council approve this request as the criteria for granting a CUP, Rezoning and Plat, provided that the conditions noted in attached Resolution No. 7560, will be met. Planning Commission Recommendation The Planning Commission reviewed the preliminary plat, CUP and Rezoning at its March 5, 2015 meeting, and by a 6-0-1 vote, they recommended approval of the application as presented. Alternatives 1. Approve Resolution No. 7560, a Resolution approving the Rezoning of property from Highway Business (B-1) Zone to Heavy Industry (I-2) Zone, a Conditional Use Permit to allow Overheight Structures, and Preliminary and Final Plat of Rahr First Addition, as presented. 2. Approve Resolution No. 7560, a Resolution approving the Rezoning of property from Highway Business (B-1) Zone to Heavy Industry (I-2) Zone, a Conditional Use Permit to allow Overheight Structures, and Preliminary and Final Plat of Rahr First Addition, with revisions. 3. Deny the Rezoning of property from Highway Business (B-1) Zone to Heavy Industry (I-2) Zone, a Conditional Use Permit to allow Overheight Structures, and Preliminary and Final Plat of Rahr First Addition, and direct staff to prepare the appropriate Resolution for the City Council's consideration. 4. The Conditional Use Permit Application is for structures over the specified height. The current design of the Brewers Supply Warehouse includes an 80,000 ft 2 warehouse with an approximate building height of 38 ft. In conjunction with the warehousing function this facility will receive and package malt from the Rahr production facility at 800 West 1St Avenue. To meet these receiving and processing needs the facility will require storage bins and a bucket elevator conveyance that will exceed the building height and exceed the 45' maximum allowed under the I2 zoning. He also uses the east side of Scott as a queue line for repairs waiting to be made and customer pickup. This parking is vital to his business and needs to be kept available. Allowing access and exits only from the north will insure no damage or burden is placed on our tenant. Our preference with the new road is to have it build on north side to the existing power lines. Doing this will eliminate any conflict with our electric lines. Our existing electrical service functions perfectly and no value would be added by modifying them in anyway. Forcing them to be placed underground would be a disruption to our tenants and cost tens of thousands of dollars that would need to be paid for by the City or the developer. We also want to make sure any grading changes near our parking lot and new road are made and paid for by the City or developer. Access to our parking lot needs to be maintained as it now exists.
