No. 795 CITY OF SHAKO PEE Memorandum 13.C~/, TO: Mayor and City Council Mark McNeill, City Administrator FROM: Julie Klima, Planner II DATE: April 22, 2008 RE: Fee Schedule Recommendations DISCUSSION The adopted 2008 fee schedule allows for the City to collect a pre-application review fee of$350. This fee is intended to cover the costs associated with review of the initial proposal. The fee schedule also allows for the collection of a pre-application escrow in the amount of $1600 for major subdivisions. The escrow funds are to cover the costs of on-going reviews, contacts, and meetings related to the pending project. City staff is recommending that the fee schedule be amended to allow the fee and escrow to be collected for Conditional Use Permits (CUP) and Planned Unit Development (PUD) development proposals, as well. The intent of the inclusion of CUPs and PUDs is to be able to capture costs associated with developments that may not require actual platting of the property but are substantial in their review process and staff time prior to an actual application being filed. Examples ofPUDs or CUPs that have occurred in the past without platting include: retail center PUDs, CUP for more than one structure per lot (construction oftownhome or apartment projects), CUP for vehicle sales, hospital PUD, CUP for schools. Specifically, staff recommends that the language in the fee schedule be amended as follows: (language underlined is added) II.Land Division Administration Fee: B. Major Subdivisions, Planned Unit Developments, and Conditional Use Permits 1. Pre-application review fee $350.00 Pre-application site review escrow $1650.00 Additionally, the adopted fee schedule allows for the collection of administrative costs. This provision is listed under Notes for the Planning Department Fee Schedule. As written currently, the requirement could be construed to include only Planning staff. Staff suggests that this language be broadened to clearly include all City staff. By extending this provision to all City staff, the City will be able to secure funds to cover costs related to requests for information and time associated with review and/or design of informal proposals. Staff recommends that the language in the fee schedule be amended as follows: (Language that is struckthrough is proposed for deletion, language that is underlined is proposed for addition) Notes for the PlaDDing Department Fee Schedule Administrative Costs - Actions requiring payment for administrative costs may be billed to the applicant. Administrative costs may include but are not limited to the following: staff time (including regular City employees and contracted employees), publishing costs, copying, printing and mailing. The actual hourly rates of the employees will be used plus a multiplier of 2.0 times for benefits. Administrative costs will accrue after the first meeting with the applicant. Any escrows received by the City shall be monitored to ensure sufficient escrow funds are held by the City. When an escrow account reaches a balance of 10% of the original escrow amount. the City shall invoice the applicant for the submittal of additional escrow funds in an amount consistent with the original escrow submittal. This process shall continue until the City has completed all necessary reviews. Julie Klima Planner II h:\cc\2008\04-22\fee schedule amendment - planning p&r 2.doc CITY OF SHAKO PEE Memorandum TO: Mayor and City Council Mark McNeill, City Administrator FROM: Historic Preservation Advisory Commission Mark Noble, Planner II DATE: April 22, 2008 RE: Fee Schedule Amendment - Demolition Permit DISCUSSION The Historic Preservation Advisory Commission, in conjunction with the proposed text amendment pertaining to demolition permit review, has proposed an amendment to the adopted 2008 fee schedule, to allow for the City to collect a fee of $200, or 2.54% of the contract price, whichever is greater, if a person were to begin demolition of a structure without the proper demolition permit approved by the city. City staff is recommending that the fee schedule be amended to allow this fee to be collected. The intent of this fee is to be able to secure funds to cover costs associated with the review of demolition permits in the situation where staff has incurred additional review time addressing the demolition of a structure without the proper approval, as well as provide an incentive for applicants to process the appropriate application in a timely manner. Specifically, staff recommends that the language in the fee schedule be amended as follows (Language that is struck through is proposed for deletion, language that is underlined is proposed for addition): Demolition Permit (pg. 7): $100.00, or 1.27% of contract price, whichever is greater. DISCUSSION As provided in City Code Section 11.60, Subdivision 9 relating to Tree Management Regulations a review of the Tree Management Plan and inspection and approval of the tree protection fencing is required prior to issuance of a grading or building permit. Developers and/or their consultants repeatedly request inspections of the tree protection fence due to changes in the plans. Staff is recommending a fee for each of these activities to cover staff time. Specifically, staff recommends that the language in the fee schedule be amended as follows: (language underlined is added) Natural Resources I. Tree Mana2ement Re2ulations: A. Financial Security An applicant shall provide the City with a cash deposit, a letter of credit or escrow, in favor of the City, in an amount of one hundred fifty (150) percent of the Tree Replacement Requirement estimate prior to approval of a grading or building permit. B. Preliminary Plat Review A fee of $400.00 for each Preliminary Plat Tree Management Plan submitted by the applicant or his or her designee is due at the time of application submittal. C. Preliminary Plat Tree Protection Fence Inspection Inspections will be charged on an hourly basis at actual hourly rates plus a multiplier of 2.0 for benefits. The City is authorized to draw against the Tree Management Regulations financial security for Tree Replacement Requirements to pay for inspections. The financial security is a result of the amended Woodland Management Regulations approved by Council at the April 8, 2008 meeting. The preliminary plat review and preliminary plat tree protection fence inspection fees are intended to reduce staff time reviewing plans and create an incentive for applicants to submit a completed Tree Management Plan.
