INTRODUCTION
City Council is asked to approve Change Order NO.2 for the contract with Badger Pools,
regarding the SandVenture Aquatic Park Slide Replacement and Shade Structure Addition
Project No. PR 2008-01. This would provide for two additional shade structures.
BACKGROUND
On March 5, 2008, City Council awarded the contract for the slide replacement and shade
structure addition to Badger Pools, Inc. The contract includes the replacement of the
waterslide, pool bottom reconstruction at the exit of the slide and the addition of four (4)
shade structures. The shade structures were to be installed as part of the Aquatic Park
Building project in 2007 and are therefore funded utilizing the remaining funds of that project.
DISCUSSION
The City was recently notified that it had prevailed in a suit against the contractor and its
bonding company on a bid question on the Aquatic Park building. The net result of that
means an additional $37,543 to the City. When received, payment will be placed back in the
project fund.
The original plans for the Aquatic Park Building project included the installation of six (6)
shade structures, three (3) along each side of the pool. Because of bids received, the funds
remaining in the Aquatic Facility project budget allowed for the purchase of only four (4)
shade structures. Each shade structure was bid at $8,300.
On April 16th City staff discussed with the contractor the possibility of adding back the two
deleted shade structures. The quote received was $11,305 per shade structure (with an
installation date of mid June) if ordered after April 22nd. The pool opens for operation June
th; therefore, the shade structures would have to be installed following the 2008 summer
season. However, the contractor indicated that if the shade structures were ordered on April
16th they would cost the bid price of $8,300 each, a net savings of $6010. Staff was given
permission to order the shade structures to secure the lower price and completion date prior
to the pool opening. A copy of the change order required to add two (2) shade structures to
the project is attached.
BUDGET IMPACT
The addition of two (2) additional shade structures will cost $16,600. Prior to the notice of
the Court award, the Aquatic Park Building fund had a balance of $34,000, from which the
four (4) shade structures would be purchased. The fund will now be increased by $37,543,
minus the $16,600. .

REQUESTED ACTION
If City Council concurs, it should approve Change Order NO.2 for the contract with Badger
Pools, providing for two additional shade structures to the Aquatic Park Slide Replacement
and Shade Structure Addition Project No. PR2008-01, with funding for the shade structures
to come from the remaining Aquatic Park Building fund balance.
