Action Sought
Approve a motion approving the concept of a Lateral Sewer Connection Charge
Concept for the extension of Jennifer Lane from Valley Creek Crossing 2nd
Addition to Wood Duck Trail and for the City to contribute funds for constructing
Jennifer Lane Street Improvements.
Background
On October 15, 2013, staff brought to Council the concept of constructing Jennifer
Lane from Valley Creek Crossing 2nd Addition to Wood Duck Trail and deferring
assessments to benefiting property owners with our approval of an assessment
agreement.
City and County staff worked with the property owners and couldn't reach an
agreement last fall. One of the issues with the property owners is that they did not
want to incur an assessment.
Staff has met with Scott County staff on the extension of Jennifer Lane to review
possible alternatives. Staff has suggested that a lateral sewer connection charge
could be done instead of assessments by adopting an ordinance. The ordinance
would define the amount and the area that the charge applies and when the charge
applies to the property.
Attached is a map showing the lateral sewer connection charge area and a
calculation sheet on the calculation of the charge.
SPUC would have to generate a lateral water connection charge to cover extension
of watermain.
City engineering staff would work with County engineering staff to design a road
connection from Valley Creek Crossing 2nd Addition to Wood Duck Trail. The
Menden's have indicated a desire to subdivide and in their subdivision, they would
construct a connection of Fairhaven Drive to Jennifer Lane.
The City would be responsible for 10% of the road cost and storm sewer/ponding
and that is estimated to be $89,074.00. This cost would be paid out of the Capital
Improvement Fund and a separate County Agreement would be done for this
project work and cost.
The connection of Jennifer Lane would provide alternate routes out of
neighborhoods that have to use Wood Duck Trail. The roadway would most likely
be reconstructed by a future developer to install services and other street
connections as the exact locations will not be known until the area is platted. The
main benefit for the City is the additional local road connections for public safety
and emergency management for the Lakeview Drive and Wood Duck Trail area.
Recommendation
Staff would recommend moving forward with a Lateral Sewer Connection Charge
to see if the property owners would agree to the extension of Jennifer Lane. Also
the extension of Jennifer Lane sewer to the Menden parcel would be better than
allowing septic systems.
Budget Impact
The City would need to front the sanitary sewer costs and be reimbursed upon
development of the area. Jennifer Lane street costs would need to be paid out of the
Capital Improvement Fund.
Relationship to Vision
This supports Goals A: Keep Shakopee a safe and healthy community where
residents can pursue active and quality lifestyles; and D: Maintain, improve and
create strong partnerships with other public and private sector entities.
Requested Action
Approve a motion approving the concept of a Lateral Sewer Connection Charge
Concept for the extension of Jennifer Lane from Valley Creek Crossing 2nd
Addition to Wood Duck Trail and for the City to contribute funds for constructing
Jennifer Lane Street Improvements.

ORDINANCE NO. , FOURTH SERIES
AN ORDINANCE AMENDING THE CITY'S FEE ORDINANCE BY ADDING A LATERAL
SANITARY SEWER CONNNECTION CHARGE FOR THE JENNIFER LANE SANITARY
SEWER EXTENSION PROJECT
Whereas, by Ordinance No. 897, the City Council adopted a new Fee Schedule
effective as of January 1, 2015; and
Whereas, Section 3.02 of the City Code authorizes the City Council to fix rates and charges for
sanitary sewer services, including but not limited to establishing sanitary sewer availability and connection
charges;and
Whereas,the city council has determined that a lateral sanitary sewer connection charge should be
established for the Jennifer Lane Sanitary Sewer Extension Project from Valley Creek Crossing 2nd Addition
to Wood Duck Trail so that the properties that received public sanitary sewer from the construction of that
project pay for the their fair share of the costs of the project;and
Whereas,the Public Works Director has calculated the amount of the charge that should be
established and the City Council has concluded that the proposed charge is just and equitable.
THE CITY COUNCIL OF THE CITY OF SHAKOPEE, MINNESOTA.ORDAINS:
Section 1. The Fee Schedule adopted by Ordinance 897 is amended by adding the
following provision under Paragraph I of the "Engineering Fee/Charge Schedule" portion on
page 9:
P. Jennifer Lane Sanitary Sewer Lateral Connection Charge
$ 3,863.49 per acre
This charge applies to all properties and developments abutting Jennifer Lane and
connecting to the Jennifer Lane sanitary sewer between Valley Creek Crossing 2nd
Addition to Wood Duck Trail.
The charge is to be collected at the earlier of the time of connection to the public sanitary sewer
or the recording of a final plat for a development utilizing the sanitary sewer.
