Michael Leek, Community Development Director SUBJECT: Text Amendment Regarding Outlots and Building Permits MEETING DATE: April 8, 2008 REVIEW PERIOD: NA, proposal initiated by City staff INTRODUCTION: It has been the City's policy for a number of years that building permits are not issued to outlots. The following proposed amendments to Shakopee City Code Chapters 4 and 12 are intended to clarify language that relates to that policy. DISCUSSION: The general reasons for designating outlots on a plat are a) to designate those areas of a plat that will be subdivided in the future for development, and b) to designate areas that may be useable for limited purposes but not for general development purposes. As a matter of policy, the City has not generally issued permits for buildings on outlots. A concern is that, should the City grant permits on outlots, it would create the impression that many outlots that were never intended for development are, in fact, buildable. So, for example, if a person were to acquire an outlot as the result of a tax forfeiture, that person might argue that the property is buildable, and the City should issue a building permit for their intended purpose. In order to clarify in Code the City's policy, the following changes are proposed to clarify the City's approach to outlots vis-a-vis building permits. Offer Ordinance No. 792, an ordinance amending Shakopee City Code Sections 4.06 and 12.33 regarding outlots as presented. 2. PLANNING COMMISSION RECOMMENDATION: The Planning Commission reviewed the proposed amendments at their meeting of March 6, 2008, and unanimously recommended approval of the proposed changes. THE CITY COUNCIL OF THE CITY OF SHAKOPEE, MINNESOTA, ORDAINS: Section 1 - That City Code Chapter at Sec. 4.06. INSPECTIONS, and Sec. l2.33. LOTS AND BLOCKS, are hereby amended by adding the language, which' is underlined. City Code Sec. 4.06. INSPECTIONS. Subd. 1. Survey. No building permit shall be issued for any building on an outlot. For all other lots, no building permit shall be issued for any building unless a survey of the lot upon which the building is to be erected is submitted and is prepared and attested to by a registered surveyor and provides the following information: City Code Sec. 12.33. LOTS AND BLOCKS. Subd. 4. Outlots. Lots designated as outlots on the final plat will be understood to be unbuildable lots for purposes of this chapter and Chapter 4, and building permits will not be issued to outlots under City Code Chapter 4. Section 2 - - Effective Date. This ordinance becomes effective from and after its passage and publication.
